SO( Ouestions & Concerns 1. He has already started his landscaping of this lot that he wishes to join to the bar property. His parking lot is pretty much in as far as I can see. Was this appropriate? Isn't he supposed to wait for variance approval before starting this? Drainage. Looking at the way the new parking area has been set up. It all slants to the properties behind him. Is this appropriate? What happens once he blacktops this parking area and water problems occur on the properties directly behind him due to this fact? Will he have to redo this? And will it be readily enforced? 2. The property that the owner of Kelly's wishes to join to his bar property also has a house on it. Is house property now part of bar and if so, what are lot requirements even if commercial. Bill has left very little yard around this house. 3. Is City liable if variance granted without knowing that house is part of bar property? If lawsuit occurs, it is the taxpayers who pay this? 4. Bill Bisek claims he needs these two lots joined due to the fact that he would like to add on to Kelly's and he needs more parking. There has always been street parking available. After seeing where his volleyball courts and parking lot are going he doesn't have much room left for addition of bar. Even if he does need additional parking it seems the parking lot he has created is rather large. 5. Has the lot that he wishes to join to the bar been surveyed? The reason for this question is that if the Zoning and Planning Commission pass his variance, I strongly request a 10 foot privacy fence which you cannot see through and the owner of the bar must maintain both sides of the fence when maintenance is required. Also this fence should run the south property line and east property line as close to Main Street as allowed. Also no gates. 6. Noise - What time do bars or any other business that have outside activities have to stop when they are surrounded by a residential area? Is it 8:00 or 9:00 p.m.? Then I would like to request a change in the time bars or businesses have to stop outside activities and how often they are allowed to have these outside activities. According to Kelly's recent mailing concerning their upcoming outdoor activities beginning in May and throughout the summer they are going to be having volleyball games 4 times a week. How late is this allowed to be played until? A few times last summer he has had volleyball games going on well after 9:00 p.m. because he has flood lights set up so they can play night games or whenever some of the customers decide that they want to go play a game of volleyball. I don't think this should be allowed. I live right across the street from Paul Montain's property. Paul owns Trio Bar and his volleyball teams only play once a week on Wednesdays. They start about 6:00 and they are usually done by 8:30. I have never had a problem with that. As long as they keep the games relatively quiet such as no really loud music or foul language. However, if you allow Bill to start having volleyball games 4 times a week I think we are starting to allow too much outside activity from this bar and of course then Trio Bar will want to do something like this to keep up with their competition and how are you going to say no. If he really wants 4 days a week of volleyball then I see no problem with his addition being an indoor volleyball court and then they could play all year round. Haven't there been enough complaints filed against Waterworks concerning noise? Now you want to allow this? 7. Horseshoe Pits are on the southeast corner of next lot that owner wishes for variance. In this corner is a huge parking light which recently has been put up, which I assume is by the owner of Kelly's. I am assuming this is for the parking lot but also since the horseshoe pit is set up right underneath it this could lead to late night games which the local residents will not put up with. This horsehoe pit should be moved closer to the bar. It is too far from the building. Also this light should have some sort of deflector put on it. 8. Volleyball Nets - The nets are set up so the games are played East to West with approximately a 6 foot fence on west side of courts. Centerville Road is on other side of privacy fence. Balls could easily fly over privacy fence onto Centerville Road. This could be a traffic hazard. Should privacy fence have a net extending above that to catch volleyballs that would have otherwise gone over privacy fence. 9. If this expansion of Bill Bisek's bar and property is approved both by Planning and Zoning and City Council there is a very good possibility that there will be more traffic on Progress and Sorel Street which in turn there should be children at play signs and a three -way stop signs posted at the intersection of Progress and Sorel Street. There are more children in this area in the last year and there is getting to be more traffic from the -2- bars due to the growth of this City and outdoor activities that these bars offer during the summer. Many patrons go this route to get from Kelly's to Trio or vice versa. They like to go this way because they do not have to then go to the four stop at Centerville Road and Main Street. 10. In actuality I don't believe there is any reason he needs to join these two lots. If he leaves his business the way it is he does not need more than one or two nights of volleyball games during the middle of the week when usually the bars are a little bit quieter I think in that he has plenty of parking. I am assuming from the changes he has made in the last couple of years to the bar that his business is doing well enough that he does not need to attract more patrons which in turn means more noise outside and more traffic and possibly more problems which could involve the calling in of police. 11. What does this do to property values in this area if expansion is allowed and it starts to create problems and how would the City be prepared to handle this? I have lived in this town for 13 years and never had a problem with Trio Bar or Kelly's. However, these bars never had any outside activities. Ever since the deck was built on the back of Kelly's the noise at times after 9:00 was way too loud. At times, on Saturday nights they have a band or the jukebox is playing loud enough that people come out onto the deck and leave the sliding glass doors open and the bass comes right through our house. We have to call over there to tell them to turn it down. On nice evenings during the summer especially on Friday or Saturday there has been plenty of noise coming off that deck until late at night from people that have had too much to drink. Obviously the bar is neglecting their duty as to supervision of the noise being created outside of the bar on their property and if they can't control it then the deck should be closed off after 9:00 p.m. We have three bars in this town as it is now and I don't think we need to add anymore problems by allowing them to add onto their businesses. I do not wish to see the variance granted. -3- TAX CREDIT PROGRAM AND EXAMPLE 1) TAX CREDITS ISSUED TO A PROJECT GO TO INVESTORS, NOT TENANTS, 2) THIS PROGRAM REPLACES GOVERNMENT OWNED AND OPERATED PROGRAMS OF HOUSING. 3) LOCAL INVESTORS AND CORPORATIONS OWN THEM, AND FOR INVESTING INTO THESE PROJECTS THE INVESTORS RECEIVE TAX CREDITS BASED ON THEIR INVESTMENT, THE MORE THEY INVEST THE MORE TAX CREDITS THEY RECEIVE. FOR EVERY DOLLAR IN TAX CREDITS THEY HAVE, THEY GET ONE DOLLAR OF THEIR FEDERAL TAX PAYMENT EVERY YEAR FOR TEN YEARS. EXAMPLE: INDIVIDUAL INVESTOR, INVESTS $ 35,000.00 ONE TIME IN YEAR ONE OF THE PROJECT AND THEY CAN RECEIVE $ 9,000.00 A YEAR OF " TAX CREDIT" OFF THEIR FEDERAL TAX OBLIGATION FOR TEN YEARS 4) LARGE CORPORATIONS LIKE N.S.P., 3 M, ETC, INVEST MILLIONS EVERY YEAR INTO PROJECTS LIKE THIS. 5) How IS THE PROJECT CONTROLLED: A) MINNESOTA HOUSING HAS THE RESPONSIBILITY OF MONITORING THESE PROJECTS. B) FIRST, THEY WILL NOT ISSUE TAX CREDITS TO A PROJECT THAT IS NOT FINANCIALLY FEASABLE. C) THEY MONITOR THE MANAGEMENT COMPANIES AND THE TENANTS THAT LEASE THE UNITS TO INSURE THE PROGRAM IS NOT ABUSED BY THE TENANTS AND THE OWNERS. D) MANAGEMENT AND OWNERS MUST HAVE AT ALL TIMES ALL THE DOCUMENTATION ON FILE AS LISTED ON THE ATTACHED SHEET. E) THEY CAN AND DO INSPECT PROJECTS AT ANY TIME WITH VERY LITTLE NOTICE. Forms to include: 1. File checklist • 2. All eight pages of our MHFA approved application - each applicant not related by blood, marriage or adoption must complete a separate application 3. Credit report (TRW) 4. Proof of waterbed insurance (if applicable) 6. Authorization for Release of Information 7. Bank verification - covering every account held including Cl), Money Market, et cetera 8. Employment verification - 1 per job for each person over 17, including any co- signers `" Co- signers are required for everyone 21 and under'• 9. Self-employment verification with a signed copy of their Federal Income Tax Return for the two most recent fiscal years. (if applicable) 10. Social Security verification 11. Income Certification It is extremely important that resident files contain all necessary documentation.
