Commission of the City of Centerville held their regular meeting
Tuesday, August 7, 1990 at City Hall- Chairman Tourville called
the meeting to order at 7:10 p.m. Present: Welk, Drilling,
Vermeulen. Absent: Wilharber_
Motion by Vermeulen, second by Welk to approve the July 12, 1990
meeting minutes; Aye - Vermeulen, Welk, Tourville; Abstain -
Drilling, motion carried.
OLD BUSINESS:
Automotive repair - Kevin Fuller - Site Plan
Kevin Fuller was not present. Chairman Tourville update the
Commission members on the originally proposed site plan in the
Industrial Park. Kevin Fuller is now apparently proposing being
on the commercially zoned property on Main Street. Chairman
Tourville also noted that there would be a need for a special use
permit for this site.
It appeared to be the general consensus of the Planning and
Zoning Commission that the originally proposed site would be a
better and more appropriate site. The Commission members
expressed concern over the complaints that might be generated
from the proposed commercially zoned site.
Commission member Drilling expressed that he would like to see
the commercially zoned area saved for something nicer giving the
example of a Hardware Store.
Motion by Vermeulen, second by Welk to table the discussion of
Kevin Fullers automotive repair - site plan, motion carried
unanimously.

Chairman Tourville noted that Gerald Rehbein's request to build
an eight -plex housing complex appeared to be a normal
subdivision.
Commission member Welk noted that she would like to wait on
making a decision until there is feedback from the Planner and
staff.
Chairman Tourville noted that Maier, Stewart and Associates
should be requested to complete a feasibility study.
Chairman Tourville also questioned on how the quality concerns of
the residents are to be addressed.
Commission member Drilling expressed that the concept appears to

be acceptable but would depend on how it is done, and that
something should be done to control the quality.
Chairman Tourville expressed that the proposed area needs park
land, tennis courts or pool, ect. He also questioned as to what
kind of control the city can place on this to assure quality.
Motion by Welk, second by Drilling to table Gerald Rehbein's
request for rezoning until Northwest Associates, city planner,
review the preliminary plat, motion carried unanimously.
Motion by Vermeulen, second by Welk to recommend to the City
Council that Maier, Stewart and Associates prepare a feasibility
study for Gerald Rehbein's proposed eight -plex, motion carried
unanimously.
May Overlays - Tom Wilharber.
Motion by Tourville, second by Vermeulen to table the discussion
of map overlays due to the fact the Commission member Wilharber
is not present, motion carried unanimously.
industrial Park - Possible rezoning to Commercial - Structural
quality of buildings - Permitted Uses.
It appeared to be the general consensus of the Commission that
since it was sold as Industrial, it would not be fair to the
property owners to rezone to commercial.
Motion by Vermeulen, second by Welk to recommend to the City
Council that at this time the Planning and Zoning Commission does
not find it necessary to rezone the Industrial Park properties to
commercial due to the possibility of down zoning of the
properties, motion carried unanimously.
Gerald Rehbein
Gerald Rehbein expressed concern about the preliminary plat
review checklist required by the City. Mr. Rehbein feels that
some of the requirements place a financial burden on the
developer.
Motion by Tourville, second by Vermeulen to revise the
Preliminary Plat Review Checklist as follows:
- that the pages be numbered;
- that the information required on page three-
, Subdivison Plat - (e) street pattern through page five
- Restrictions, be required after preliminary plat
approval;
motion carried unanimously.

Chairman Tourville discussed with Gerald Rehbein the Planning and
Zoning Commission's concerns about quality and park land. There
is also no need for the planned unit development special use
permit since all the buildings appeared to be within the set
backs. Chairman Tourville did suggest however that Mr. Rehbein
go with a PUD to allow flexibility for park land.
Mr. Rehbein was also informed of the Planning and Zoning
Commission decision to table his rezoning request and that Maier,
Stewart and Associates will be requested to prepare a feasibility
study.

Chairman Tourville stated that he could not see the difference
between a conditional use permit versus special use permit for a
site plan. Chairman Tourville also stated that he is not in
favor of grating special use permits for site plans. Chairman
Tourville expressed that conditions should be put into a site
plan versus granting a special use permit.
Commission member Drilling felt that this could be creating more
work for the City, but felt that the City was trying to protect
themselves against undesirable businesses.
Chairman Tourville felt that the requirement for a special use
permit for a site plan is discouraging development and that it is
an inappropriate use of a special use permit and /or a conditional
use permit. Chairman Tourville noted that the same thing is
required in the Commercial part of the Ordinance. Chairman
Tourville also expressed that he is not advocating the dropping
of site plan approval.
Motion by Tourville, second by Drilling to hold a public hearing
at their next regular scheduled meeting on the possibility of
deleting from Ordinance #4, Appendix A - A10 Site Plan and
Appendix B - B -10 Site Plan, motion carried unanimously.
Ordinance #4 - Appendix R - B21 No Outdoor Storage.
Chairman Tourville noted that questions arose from Kevin Fuller's
request for an automotive repair shop in the Industrial Park.
The ordinance allows car sales. The question appears to be what
is and what is not to be consider outdoor storage.
Commission member Drilling felt that in his opinion building
materials and equipment could be considered outdoor storage.
Commission member Welk expressed that it could be something that
would not be appropriate giving dented fenders as an example.

Chairman Tourville suggested looking into how other cities define
outdoor storage.
Commission member Vermeulen expressed that the ordinance should
be reworded to make it more flexible. Commission member
Vermeulen left the meeting at 8:20 p.m.
NEI BUSINESS
1.) Consider rezoning the following properties:
- 1973 Main Street
7105 20th Avenue North
- 1981 Main Street
1979 Main Street
_ 1976 Main Street
- 1969 Main Street
2.) Zoning of the property at 7140 - 20th Avenue North.
Tamara Miltz - Miller, Clerk Administrator, was present. Ms.
Miltz- Miller noted that at the July 25, 1990 five of the above
property owners were present at the City Council meeting and
appeared to be very receptive to the idea and would not have a
problem with the rezoning. Commercially zoned property would be
assessed at a higher rate if municipal water is extended to these
properties.
Ms. Miltz- Miller stated that the property at 7140 - 20th Avenue
North was included to be consistent with the Comprehensive Plan -
Future Land Use Plan.
Chairman Tourville expressed that this should be the property
owners decision to rezone their property, He also expressed that
it should be left commercial and have the property owners help
pay for the cost of the oversized water main. Chairman Tourville
also expressed concern about whether this would be serving in the
City's best interest, in his opinion long term commercial would
be more beneficial.
Commisison member Drilling felt that in his opinion it is more
desirable to have commercial zoned property. He would not like
to see it rezoned from commercial to residential.
Motion by Drilling, second by Welk to recommend to the City
Council the following properties:

the future development on County Road 14 could be a natural flow
of traffic, that Planning and Zoning could face the same problem
in reverse later, and to rezone just for the purpose of reducing
the water assessment is not enough justification, motion carried
unanimously.

RECREATTON EQUIPMENT,
Chairman Tourville noted that this issue arose from the concern
of the motor home parked in the Center Oaks Development.
Commission member Welk noted that there are other non- conforming
motor homes parked within the City. She also expressed that the
area is not zoned for more than one family. She would not see a
problem with visiting for two weeks.
Commission member Drilling would like to see the ordinance
enforced. He could go along with a two week permit. Any
extension of the two weeks could be referred to the City Council
for approval.
Motion by Drilling, second by Welk to hold a public hearing for
staff to draft a possible amendment. to Ordinance #4, Section
34.10 - MAJOR RECREATION EQUIPMENT to allow for a permit not to
exceed fourteen days, with the possibility of an extension to be
granted by the Clerk /Administrator, motion carried unanimously.

Commission member Drilling would like to see something done about
the children playing on Peltier Lake Drive.
Joint Meeting Date with the Park and Recreation Committee
Chairman Tourville stated that he would like to see more
coordination with the Park and Recreation Committee as far as
park land development in the City.
It appeared to be the general consensus of the Planning and
Zoning Commission that a joint meeting with the Park and
Recreation Committee would be a good idea if they would like to
meet with them.
City Staff will put this on the next Park and Recreation
Committee agenda to see if they would also like to have a joint.

Motion by Welk, second by Drilling to adjourn the meeting, motion
carried unanimously. Meeting adjourned 9:25 p.m.
