Commission of the City of Centerville held a public hearing on
Thursday, July 12, 1990 at City Hall. The purpose of the hearing
was to hear all persons present regarding the possibility of
rezoning the property described as follows:
The West half of the Northwest Quarter of the Northwest
Quarter of Section 24, Township 31, Range 22, Anoka
County, Minnesota, which lies Northerly of the
following described line: commencing at the Northwest
corner of said Northwest Quarter of the Northwest
Quarter of Section 24; thence proceeding South along
the West line of said Northwest Quarter of the
Northwest Quarter for 766.0 feet to the point of
beginning of the line to be described; thence
proceeding East and parallel with the North line of
said Northwest Quarter of the Northwest Quarter to the
East line of said West half of the Northwest Quarter of
the Northwest Quarter and said line there terminating.
and lying east of the Royal Meadows development and 20th
Avenue, north of Main Street, and presently in the MUSA *.
The proposed rezoning will be from Industrial to Single
Family Residential Sewered (R -2). The proposed land use
will be to build a Planned Unit Development consisting of
eight -plex units.

PUBLTC HEARING
Chairman Tourville called the hearing to order at 7:03 p.m.
Present: Wilharber, Vermeulen, Welk, liaison Pelton. Absent:
Drilling.
Chairman Tourville summarized the proposed rezoning to the
Commission and audience members.
Gerald Rehbein, developer, was present. Mr. Rehbein stated that
the reason for his applying for the rezoning was that it appeared
that his request for high density multi- family housing would be
consistent with Centerville's Comprehensive Plan - Future Land
Use Plan. Mr. Rehbein presented a schematic design to the
Planning and Zoning Commission and members of the audience did
view this plan.
Chairman Tourville noted that this area is presently in the
Metropolitan Urban Service Area, but that sewer and water would
need to be extended to this area. The proposed use would be
under the Planned Unit Development (PUD) section of Ordinance #4.
Commission member Vermeulen questioned Mr. Rehbein if the units
would be privately owned.
Mr. Rehbein stated that they would be privately owned. The units
would consist of three different styles.

Liaison Pelton questioned as to the number of bedrooms per unit.
Mr. Rehbein stated that he believed that there are two or three
bedrooms. He will not be the builder, his plans are only for
developing the property.
Dan Belland, 1994 North Robin Lane, presented a petition from
twenty -six of the residents of Royal Meadows. This petition is
on file with the Clerk /Administrator.
The following audience members asked questions and made comment
regarding the public hearing on the proposed rezoning:

Robert Hill, 1983 Cardinal Drive
Joy Walsh, 1989 North Robin Lane
Dan Belland, 1994 North Robin Lane
Ryan Walsh, 1989 North Robin Lane
Linda Sanborn, 1994 South Robin Lane
Some of the following comments were made by the above audience
members:
- Why was an eight -plex versus single family housing.
- How far back from 20th Avenue would they sit.
- Is this consistent with the Comprehensive Plan.
- Would this be subsidized low rental units.
- Want quality construction.
- Estimated sale price.
- Increase in traffic.
- Safety of children in area.
- Resale value of homes in the Royal Meadows development
could be lessened.
- What if the property does not sell and it does become
rental property.
Joy Walsh, 1989 North Robin Lane, presented a letter from Rob and
Sandee Heineman, 1989 North Robin Lane who were unable to attend
the Public Hearing. This letter is on file with the
Clerk /Administrator.
Comments responding to resident concern were made by Gerald
Rehbein. Some of the concerns addressed were as follows:
- It would be more economically feasible for either high
density housing or its present industrial use.
- The project would roughly sit 100' from 20th Avenue.
- The units would be privately owned with one common
ground, everybody pays dues to maintain through a home
owners association.
- High density in this area appears to be what the City

would like for this area.
- If the residents voicing complaints did not want this
type of project close to them, they could purchase the
land from him and could then do what they pleased with
the land.
- The starting price range is around $50,000.
- Would consider building single family housing if he
would be allowed to have a development similar to the
Royal Meadows development lot sizes.
Liaison Pelton expressed that the City felt there was a need for
multi - family housing when the Comprehensive Plan was being
developed. The City Council could have a Planner review the plat
and give their professional opinion on what would be best suited
per City ordinances. They do need to have the public's opinion,
but that the ordinances must be followed.
Liaison Pelton also expressed that one of the reason for high
density housing in this area was to create a transition from
single family to the current industrial use.
Commission member Welk explained that the only concern the
Planning and Zoning Commission is here to addresses is what the
zoning will be.
Motion by Wilharber, second by Vermeulen to adjourn the public
hearing, motion carried unanimously. Hearing adjourned 8:19 p.m.
Liaison Pelton asked if any one would like to be the contact
person in regards to this proposed development.
Dan belland, 1994 North Robin Lane, asked that he be the contact
person.
Pursuant to due call and notice thereof the Planning and Zoning
Commission of the City of Centerville held their regular meeting
on July 12, 1990 at City Hall. Chairman Tourville called the
meeting to order at 8:20 p.m. Present: Vermeulen, Welk,
Wilharber, liaison Pelton. Absent: Drilling.
Motion by Wilharber, second by Tourville to table approval of the
June 5, 1990 meeting minutes, motion carried unanimously.

Man Overlays - Tom Wilharber
Commission member Wilharber updated the Planning and Zoning
Commission on his appearance before the City Council on July 11,
1990, on the proposal for the City Council to pay for half of the

cost of computerized map overlays. The City Council did vote to
pay for half of the cost of the computerized map overlays from
Maier, Stewart and Associates. Commission member Wilharber also
I noted that Maier, Stewart and Associates agreed that rights to
the maps would belong to the City.
Commission member Wilharber will present examples of the map
overlays at their next meeting.
ORDINANCE #4 - APPENATX B
B10 - Site Plan (Special Use Permit)
Chairman Tourville noted that this problem arose from the last
meeting when Kevin Fuller presented his site plan for the
Industrial Park. The Planning and Zoning Commission had
questioned the need for a special use permit for a site plan.
John Stewart, City Engineer, was present. Mr. Stewart rioted that
a lot of Cities become disenchanted with the way people run their
businesses. The special use permit allows the City the
opportunity to comment on the site plan.
Liaison Pelton stated that this requirement allows you to put
conditions on the use. The use may be appropriate, but the way
they want to set -up may not be.
Chairman Tourville stated the Vandais Heights Site Plan
Requirements appeared to address the concerns that might arise
with no need for a special use permit. Chairman Tourville also
stated he felt this was a misuse of a special use permit.
Commission member Wilharber stated that the Planning and Zoning
Commission still wants to have control over a site plan.
John Stewart noted that once approved the special use permit
allows you to go back and review the site plan on a yearly basis.
It appeared to be the general consensus of the Planning and
Zoning Commission that the problem was not with the idea of
having control over a site plan, but with the calling it a
special use permit. They felt that this is not a "use ".
Motion by Wilharber, second by Welk to table the discussion of
Ordinance #4 - Appendix B - B10 Site Plan (Special Use Permit)
and B21 No Outdoor Storage, motion carried unanimously.

NKW BUSINESS
Rezoning Request - Gerald Rehbein
John Stewart, City Engineer, was present. Mr. Stewart made
comments on the preliminary plan, The density with the County
right -of -way would be 8.3 per acre. The density with out the
County right -of -way would be 9.13 per acre.
The typical density for multi- family /townhome project is 8 -15 per
acre. This use does not appear to be out of line with what is
seen in other communities. The proposed development does not
appear to be an unduly burden to the sewer and water systems.
The estimated number of trips on the streets is 960 trips per
day, and in view of this you may want to consider street wider
than 32'.
It appeared to be the general consensus of the Planning and
Zoning Commission that the concept of multi - family housing would
be a good use for this ten acres of land.
Liaison Pelton asked Gerald Rehbein if Kenco Construction would
be the builder. Ms. Pelton stated that because of the current
problems that the City is having with Kenco Construction she
personally would not be comfortable with them as the builder.
Mr. Rehbein stated that he could find another builder.
Motion by Wilharber, second by Vermeulen to table the discussion
of the rezoning request until their next meeting, motion carried
unanimously.
apecial Use Permit - Gerald Rehbein (To build a PUD)
The Planning and Zoning Commission requests that City Staff
research what other Cities have for requirements for PUDs.
Motion by Wilharber, second by Vermeulen to table the discussion
of Gerald Rehbein's special use permit to build a PUD until their
next meeting, motion carried unanimously.
Industrial Park - Possible rezoning to Commercial - Structural
auality of building- Permitted uses
Motion by Welk, second by Vermeulen to table the discussion on
the Industrial Park until their next meeting, motion carried
unanimously.

1991 Budget
Motion by Wilharber, second by Welk to recommend to the City
Council that the Planning and Zoning Commission Budget be set at
$2,030; that the balance of $1812.32 be carried over to allow for
codification of ordinances, seminars, ect., motion carried
unanimously.
