HomeMy WebLinkAbout1990-05-01 Minutes r Pursuant to due call and notice thereof the Planning and Zoning Commission of the City of Centerville held their regular meeting on Tuesday, May 1, 1990 at City Hall. Chairman Tourville called the meeting to order at 7 :05 p.m. Present: Wilharber, Vermeulen, Drilling, Welk, liaison Neumann. Motion by Vermeulen, second by Welk to approve the minutes of the April 3, 1990 meeting, aye - Tourville, aye - Welk, aye - Wilharber, aye - Vermeulen, abstain - Drilling, motion carried, OLD BUSINESS: POSSIBILITY OF AMENDING ORDINANC #4 TO INITIATE AN R -5 ESTATE ZONING DTSTRICT Chairman Tourville summarized to the Commission members comments made by John Stewart, City Engineer, at the April 19, 1990 .joint public hearing with the City Council. Chairman Tourvilie also noted Gunnar Pettersen "s, Building inspector, concern on how the minimum square footage is to be interpreted. It appeared tilde the concern is whether or not this is to be the outside dimension or living space. Commission member Drilling expressed that in his opinion it 1.s to be the finished living area. Commission member Vermeulen questioned as to what the difference is for a split level with a minimum of three levels versus a split entry. Chairman Tourvilie noted that the difference is that a split entry has an entry that either goes up /down, and that ;a split level ;nears separate levels. Discussion on the suggestions made by John Stewart, City Ong , at the Apr _a _ ..90 ni nr, Public Hearing. It was suggested by Mr. Stewart that Article 2, Section 24, 24. (1) "Ali structures shall have permanent concrete or wood foundations which..." be amended to= All structures shall have permanent concrete foundations which..." Commission member Wilharber expressed agreement with the City Engineers comments on wood foundations. Commission member Drilling noted that a soil problem could hamper the feasibility of a wood foundation. Chairman Tourville noted that with proper construction a wood foundation could be feasible, Chairman Tourville also expressed that in his opinion this would be an elimination of a choice, and that it should be the Building Inspector "s responsibility to • P &Z Meeting Minutes Page Two May 1, 1990 • insure that a wood foundation is installed properly. It appeared to be the general consensus of the Planning and Zoning Commission that they would not like to see the amendment eliminating wood foundations as a choice. • It was suggested by Mr. Stewart that. Article 2, Section 24, 24. (6) "...Sheet metal siding shall not be permitted in such districts not over at least fifty (50) percent of the entire structure." be amended to: "...Sheet metal siding shall not be permitted in such districts not at least fifty (50) percent of exterior walls." it appeared to be the general consensus of the Planning and Zoning Commission that the proposed amendment would be good. It was suggested by Mr. Stewart that Article 2, Section 24, 24. proposed (8) "Ali future new dwellings in an R -5 single family residential district shall have an attached double garage of a minimum of 600 square feet." be amended to: "Ali future new dwellings in an R -5 single family residential district shall have an attached multi -bay garage of a minimum of 600 square feet.' It appeared to be the general consensus of the Planning and Zoning Commission that the proposed amendment would be good. Discussion on Gunnar Pettersen "s, Building Inspector, comments that the headings under "AMEND TO READ; SCHEDULE OF DISTRICT REGULATIONS MINIMUM GROUND FLOOR AREA OF LIVING SPACE." They should both read "MINIMUM GROUND FLOOR AREA OF LIVING SPACE" or "MINIMUM LIVING SPACE PER UNIT (SQ. FT.) ". The Planning and Zoning Commission discussed " MINIMUM LIVING SPACE PER UNIT (SQ. FT.)' noting that this deals with space on all floors versus ground floor only. Commission member Wilharber felt that some one could build a two story unit with 525 feet on the first floor, and 525 feet on the second floor. Commission member Drilling questioned as to what is classified as a unit. Chairman Tourviile expressed that in view of the above concerns that he would prefer the wordage of ground floor area of living space. P&Z Meeting Minutes Page Three May 1, 1990 Discussion on "MINIMUM GROUND FLOOR AREA OF LIVING SPACE". Commission member Welk questioned as to what will ground floor area of living space be interpreted as. Chairman Tourville expressed that in his opinion this would be the main living area of a home. Commission member Vermeulen questioned as to what would be considered the ground floor in a split level home. Chairman Tourville felt that it would be for the Building Inspector to interpret. Commission member Welk noted that she would like the Building Inspector to clarify the definition of ground floor. It appeared to be the general consensus of the Planning and Zoning Commission that the Building inspector should be asked for the definition of ground floor area of living space, and that the definition should be included in the amendment. Discussion as to whether under "AMEND TO READ SCHEDULE OF DISTRICT REGULATIONS MINIMUM GROUND FLOOR AREA OF LIVING SPACE" if the "*Ali basementiess dwellings in this district shall be required to provide an additional 100 square feet of floor area to house utilities. should apply to all zoning districts or just the proposed R -5 District. Chairman Tourville questioned if utility rooms are/are not considered living space. Commission members Welk and Drilling expressed that utility rooms are not included in living space. It appeared to be the general consensus that an additional 100 square feet of floor area to house utilities should apply to all zoning districts. Discussion on the appropriate recommendation for minimum square footage from the range under R -5 given on the "AMEND TO READ: TABLE B SCHEDULE OF DISTRICT REGULATIONS AND LOT AND YARD REQUIREMENTS." Chairman Tourville expressed that in his opinion the lot size should be based on the pay back offered to the community. Chairman Tourville also noted that many of the plats presented to the City have been in the excess of 15,000 square feet. L. P &Z Meeting Minutes Page Four May 1, 1990 • Commission member Welk expressed that in her opinion a lot of people like large lots and that if the City only offers smaller lots you lose people who would prefer a larger lot. Chairman Tourville noted that he would be willing to go along with the larger lots if the size of the houses currently required in the R2 /R2A districts do not change. It appeared to be the general consensus of the Planning and Zoning Commission that the minimum lot and yard requirements in the R -5 zoning district be set at a minimum of 17,500 square feet with a minimum frontage width of 100 feet. Discussion on the appropriate recommendation for minimum square footage for living space from the ranges given on the "AMEND TO READ: SCHEDULE OF DISTRICT REGULATIONS MINIMUM GROUND FLOOR AREA OF LIVING SPACE." Commission member Wilharber noted that the school district is already overloaded and will become more overloaded as more new housing is built in Centerville. Commission member Wilharber would like to see a minimum of 1,200 square feet in the R -5 zoning district and the minimum recommended range for all other zoning districts as presented at the public hearing. Commission member Drilling expressed agreement. with Commission member Wilharber "s comments. Commission member Vermeulen noted that she would prefer a minimum of 1,300 square feet in the R -5 zone and the minimum recommended range for all other zoning districts as proposed at the public hearing. Commission member Welk noted that she would recommend a minimum of 1,200 square feet in the R -5 zone. Chairman Tourville expressed that it appears to be, in his opinion, the purpose of the proposed amendment would be to increase the cost of all housing in the City of Centerville. Commission member Welk noted that most of the new homes in Centerville are already over the minimum square footage requirements. Chairman Tourville noted that he is opposed to the increase in minimum ground floor living area in all other districts except the R -5 zoning district. A young couple would need to spend $10,000 more for a new home, and that this would put new housing beyond their reach. I P &Z Meeting Minutes Page Five • May 1, 1990 Commission member Wilharber noted that the regulation of sizes of homes could improve the future tax base. Motion by Wilharber to recommend to the City Council to amend Ordinance #4 - "SCHEDULE OF DISTRICT REGULATIONS MINIMUM GROUND FLOOR AREA OF LIVING SPACE" as per addendum A attached to and made part of these minutes; with a one year grandfather clause for platted lots from implication of amendment., motion failed due to Lack of second. Motion by Vermeulen, second by Drilling to recommend to the City Council to amend Ordinance 44 to incorporate an R -5 zoning district with the minimum lot and yard requirements in the R -5 zoning district be set at. 17,500 square feet with a minimum of 100 foot frontage width; the minimum ground floor area of living space in the R -5 zoning district be set at. 1,200 square feet, with all other zoning districts remaining at the current minimum square footage; to amend Ordinance 44, Article 2, Section 24, 24 (6): now reads: Sheet metal siding shall not be permitted in such districts not over at least fifty (50) percent of entire structure." amend to read: "... L P &Z Meeting Minutes Page Six May 1, 1990 NEW SPECIAL USE PERMIT REQUEST - LAKE AREA TITILITY CONTRACTING - TOM DRESHAR (RENTER) Tom Dreshar was present. Mr. Dreshar explained to the Commission members that Lake Area Utility Contracting is the applicant for the Special Use Permit, but that he would be renting space from them for the purpose of oper'ating a consigned equipment sales. This would be a new venture and would consist of selling construction equipment and the taking in of consigned pieces of equipment (i.e. backhoes, cranes, bulldozers, ect.) He would like to put all of the equipment he has for sale in one central location to show prospective buyers. Mr. Dreshar stated that all of the equipment would be in operable condition. Mr. Dreshar stated it could consist of 20 - 30 pieces of equipment. In Mr, Dreshar opinion the request he is making is consistent with the business that. Lake Area Utility is currently conducting and is of the same type of construction equipment that the surrounding commercial property owners are storing. Mr. Dreshar also stated that he does not have plans for a building. Chairman Tourville familiarized the Commission members with the location of Lake Area Utility Contracting, noting that the surrounding property is zoned R -3 Single Family Expansion and the Center Oaks II development abutts the back end of this property. Commission member Wilharber asked Mr. Dreshar what improvements he would be considering. Mr. Dreshar stated that Lake Area will do the improvements and that a fence is all that is being considered. Mr. Dreshar stated that no lighting would be necessary because there would be no night sales. Mr. Dreshar also stated that he would not be repairing any equipment. Mr. Dreshar noted that he would start up and run the equipment for prospective buyers. Commission member Vermeulen asked if there would be an office. Mr. Dreshar noted that his office is located in his home and that he would be contacted there and would meet at the site. Chairman Tourville noted that some type of buffer zone, as long as this use is permitted in a commercial zone, should be set up. Chairman Tourville also noted that. the Ordinance was amended on April 27, 1988 so that a contractor's yard would not be permitted in a commercially zoned area. The present commercially zoned land owners have grandfathered rights. Chairman Tourville also J r r &Z Meeting Minutes Page Seven May 1, 1990 expressed concern as to whether this would be an expansion of the grandfathered rights of Lake Area, Mr. Dreshar noted that the type of equipment he is proposing to sell would not be too different from that of a farm implement dealership, which is an allowable use in a commercial zone. Chairman Tourville expressed that the concerns he felt needed to be addressed were two fold. The first being if this use fits the uses allowed, and second the complaints from the residential district. Mr. Dreshar stated that he would not be starting the diesel engines at odd hours. His use would not extend further back than the 300 feet zoned commercial. He does not have any proposed improvements except for a chain link fence for protection. Commission member Drilling expressed that if you limit the business hours to 8 a.m. to 5 p.m. this could help eliminate some of the complaints from nearby residents. Mr. Drilling also questioned as to what category this would be under, suggesting maybe a Construction Business. i Commission member Welk expressed concern over the fact that if Mr. Dreshar is allowed not to make any improvements this would set a precedent. Ms. Welk felt strongly that some sort of screening be provided. Liaison Neumann agreed with Commission member Welk that buffering is important to the residents so that it does not become an - eye- sore to people living next door. Commission member Wilharber felt there would be no over all problems if the hours of business were restricted and screening was provided. Mr. Wilharber also expressed that this use could fall under that of a Construction Business or that of a Farm Implement Sales under the table for special use permits. Commission member Wilharber question Mr. Dreshar as to what benefit it would be for the City to grant this special use permit. Mr. Dreshar noted that he expects his business to expand and this could lead him to purchase land and build a building. Mr. Dreshar noted also that the land being used could attract more businesses, and bring people into Centerville. Motion by Wilharber, second by Drilling to recommend that the City Council grant Lake Area Utility Contracting their request I. P&.Z Meeting Minutes • Page Eight May 1, 1990 for a Special Use Permit under Uses Permitted on Special Use Permit as either Construction Sales or Farm Implement Sales - for the purpose as requested by Tom Dreshar, the Special Use Permit is to cease upon the termination of Tom Dreshar "s requested use, • not to exceed the Commercial Zoned area and with the following conditions: - hours limited to 8:00 a.m. - 6:00 p.m. Monday- Friday - Screening /fencing must be provided - no lighting - no repairs - limit number of units allowed - six month review of permit, annually thereafter motion carried unanimously. OLD _BUSINESS: POSSIBILITY OF AMENDING ORDINANCE L4 ARTICLE 4 NON CONFORMING USES & STRUCTURES The Planning and Zoning Commission reviewed Lino Lakes and Hugo's ordinances pertaining to non - conforming uses and structures. Chairman Tourville noted that he personally did not like section 45.04 - AMORTIZATION PERIOD FOR BUILDINGS and would like to see this deleted from the present ordinance. The remaining parts of the ordinance are not substantially different than that of Lino Lakes and Hugo's ordinances. Commission members Well and Vermeulen expressed their opinion that 45.04 -- AMORTIZATION PERIOD FOR BUILDINGS was worthless and could not be enforced. Motion by Tourville, second by Vermeulen to delete Article 4, Section 45.05 - AMORTIZATION PERIOD FOR BUILDING from Ordinance #4, motion carried unanimously. MAP OVERLAYS Chairman Tourville expressed that in his opinion the Clerk/Administrator should initiate zoning maps. City staff has recommend a scale of 1" to 400'. It appeared to be the general consensus of the Planning and Zoning Commission that computerized snaps would be nice but that they did not budget $3,200 for maps. P &Z Meeting Minutes Page Nine May 1, 1990 Motion by Wilharber, second by Drilling for Commission member Wilharber to ask Maier, Stewart and Associates for samples of maps for the Planning and Zoning Commission to review at their next meeting, motion carried unanimously. Motion by Welk, second by Drilling to request the City Council to help fund the purchase of maps if the Planning and Zoning Commission chose to order the computerised maps, motion carried unanimously.
