HomeMy WebLinkAbout1989-08-01 Minutes Pursuant to due call and notice thereof, the Planning and Zoning Commission of the City of Centerville held its regular meeting on August 1, 1989 at City Hall. Chairperson Tourville called the meeting to order at 7:06 p.m. Present: Welk, Drilling, Vermeulen, Lindgren and liaison Neumann. Motion by Vermeulen, second by Welk to accept the minutes of the July 5, 1989 meeting, motion carried unanimously. OLD BUSINESS: Discussion of the variance request from Dan Bellard, 1994 North Robin Lane, to build a garage 15 feet into the setback at 1994 North Robin Lane (10 feet from the property line). Mr. Bellard was not in attendance. It appears, based upon the sketch included with the variance request, that the need to place the garage into the setback is due to the placement of the deck on Mr. Bellard's home. It appeared the general consensus of the Commission members was Mr. Bellard's situation was a result of his own planning, and that there may be other alternatives to construct a garage on his property that would not require a variance. Commission member Welk noted that there did not seem to be justification based upon the four criteria listed in ordinance #4 to grant a variance to Mr. Bellard. Commission member Lindgren stated that he was in favor of granting the variance. He felt development behind the property at 1994 North Robin Lane may change Mr. Bellard's situation. Motion by Drilling, second by Vermeulen to recommend to the City Council to deny the variance request made by Dan Bellard at 1994 North Robin Lane, to build a garage 15 feet into the setback at 1994 North Robin Lane (10 feet from the property line) for the following reasons: - there do not seem to be special conditions and circumstances existing which are peculiar to the land, structure, or building involved, as the setting of Mr. Bellard's home and deck seem to be his own doing; P & Z Meeting Minutes August 1, 1989 Page Two - granting the variance requested would seem to confer on the applicant special privilege that is denied by this ordinance to other lands, structures, or buildings in the same district, and may set a precedence for other property owners to request the same variance based on their own planning situation, as opposed to following the building requirements of the ordinance; Welk - aye, Drilling - aye, Tourville - aye, Vermeulen - aye, Lindgren - nay, motion carried. A copy of the variance request is on file with the Clerk/ administrator. Discussion of St. Genevieve's Day Care center. It appeared the general consensus of the Commission members was that the State of Minnesota and the County of Anoka governed the specifics of these businesses, therefore it would not be necessary for the City to become involved in that area. This business is not presently listed in Ordinance #4 as a use for any zone within the City of Centerville. Motion by Welk, second by Vermeulen to recommend to the City Council that Day Care /Nursery, for up to 12 children, be permitted in all districts, excluding Commercial and Industrial; and that a special use permit be required for those businesses caring for 13 or more children, motion carried unanimously. Motion by Welk, second by Vermeulen to define Day Care /Nursery as a use where care is provide for children, for pay, motion carried unanimously. Discussion of the 1990 Planning and Zoning budget. It was noted that the Planning and Zoning Commission would appreciate being notified of any map purchases being made from their budget in order for them to be aware of their standing with their budget figures. P & Z Meeting Minutes August 1, 1989 Page Three It was also noted that Commission members Tourville, Welk and Vermeulen were not receiving their Minnesota Cities Magazine, and would appreciate Clerk /Administrator checking into this. Motion by Tourville, second by Vermeulen to request the following budget amount for 1990: $650.00 Meetings $ 30.00 Magazines $150.00 Seminars $1200.00 Maps $2030.00 Total for 1990 noting that the amount requested is the same as the budget amount for 1989, motion carried unanimously. NEW BUSINESS: Liaison Neumann updated the Commission members on the August 9, 1989 City Council meeting. Commission members have been requested to attend as the Council will be addressing the issue of County improvements to Main Street. The Council is looking for Commission members input on specifics of this improvement. Commission member Lindgren noted that he will be unable to attend this meeting. He also noted that he will be resigning from the Planning and Zoning Commission effective after the September meeting. Mr.Lindgren has served on the Planning and Zoning Commission for 15 years. Liaison Neumann updated the Commission members on the options the Council was researching for a new municipal facility. Chairman Tourville stated his agreement with the need for a new municipal facility, but cautioned against the possibility of over taxing the residents of Centerville and putting the City in a regressive position. Motion by Drilling, second by Vermeulen to adjourn meeting, motion carried unanimously.
