HomeMy WebLinkAbout1989-03-07 Minutes 1 Pursuant to due call and notice thereof, the Planning and Zoning Commission of the City of Centerville held a public hearing on Tuesday, March 7, 1989. The purpose of the hearing was to hear all persons present regarding amending Ordinance #4, TABLE B, ( + +) footnote, to consider deleting, or possibly rewording, the last two sentences concerning setbacks in the Commercial and Industrial zoning districts. Chairperson Tourville called the hearing to order at 7:00 p.m. Present: Vermeulen, Welk, Drilling and Council liaison, Mayor Haberman. Absent: Lindgren. Chairperson Tourville recapped discussions from the January and February, 1989, meetings concerning the above footnote. Mayor Haberman stated that it should be kept in the Ordinance for the residential districts and only eliminated for commercial and industrial districts. Commission appeared to agree that Section 34.03 covered this for the residential districts. Motion by Drilling, second by Welk, to adjourn the hearing, motion carried unanimously. Hearing adjourned at 7:16 p.m. Pursuant to due call and notice thereof, the Planning and Zoning Commission of the City of Centerville held a second public hearing on Tuesday, March 7, 1989. The purpose of the hearing was to hear all persons present concerning a request for variance from Ordinance #4, TABLE B, SCHEDULE OF DISTRICT REGULATIONS, LOT AND YARD REQUIREMENTS, ERQNT YARD SETBACK, to erect an attached garage and addition within the setback of the property described as follows: Lot 6, Block 2, Burque Addition I, Subject to utility easement. Chairperson Tourville called the hearing to order at 7:17 p.m. Present: Vermeulen, Welk, Drilling and Council liaison, Mayor Haberman. Absent: Lindgren. John Scherbel, 1567 Peltier Lake Drive, owner /resident of the property was present with Mrs. Scherbel and reviewed his request, drawing, and pictures, which had heen submitted for P & Z review. He also presented a blueprint of the proposed garage and addition. He stated that the present house is 28 by 23 feet; the addition and garage is 30 by 40 feet and would be 27 feet from the setback line of Peltier Lake Drive; the garage on the house next door (south) is 16 feet from the setback line; all other setbacks are met; and he feels the addition will greatly improve the neighborhood. Chairperson Tourville asked Mr. Scherbel what would happen if the variance were not approved. Scherbel stated that he would have to go straight across with the garage, and would not be able to have a screen porch on the back of the house, because of the setback from the lake having to be met. He stated that he may even decide to not do it at all. John Watson, 1585 Peltier Lake Drive, stated that he is here to P & Z Meeting Minutes Page 2 March 7, 1989 give his support, and to learn. He said that he may be interested in asking for a variance himself, in the future. The Commission and Mayor Haberman agreed that the addition would improve the property and the community. But, Chairperson Tourville stated that he can see nothing unique about the property and wonders if P & Z can justify the granting of a variance. Motion by Drilling, second by Vermeulen, to adjourn the hearing, motion carried unanimously. Hearing adjourned at 7:38 p.m. Pursuant to due call and notice thereof, the Planning and Zoning Commission of the City of Centerville held its regular meeting on Tuesday, March 7, 1989, at City Hall. Chairperson Tourville called the meeting to order at 7:39 p.m. Present: Vermeulen, Welk, Drilling and Council liaison, Mayor Haberman. Absent: Lindgren. Motion by Vermeulen, second by Welk, to approve the minutes of the February 7, 1989 meeting, motion carried unanimously. OLD BUSINESS Discussion of Pole Building Ordinance concerns and recommendations. Mayor Haberman stated that Council member Peterson had made the statement that it may be best to not use "pole building" wording, as such; that it may be better to include specific structural design wording such as "Type V" instead. Haberman also noted that the Lino Lakes Building Design Ordinance was easier to understand and interpret than the sample submitted by the City Planner. Chairperson Tourville also prefers the Lino ordinance and stated that he feels the paragraph dealing with expansion of pole barns, which had previously been crossed out, should be left in. Motion by Vermeulen, second by Drilling, to recommend the City Council adopt the Lino Lakes Building Design ordinance, contingent upon the Building Inspector substituting appropriate wording to replace "pole -type building ", and contingent upon the section dealing with expansion of pole barns, which had previously been crossed out, being reinstated; motion carried unanimously. P & Z Meeting Minutes Page 3 March 7, 1989 NEW BUSINESS Discussion of possible amendment to Ordinance #4, footnote ( + +) to Table B. Motion by Drilling, second by Vermeulen, to recommend that the City Council amend Ordinance #4, deleting the last two sentences of the footnote to TABLE B, ( + +), motion carried unanimously. Discussion of variance request for 1567 Peltier Lake Drive. Mary Jane Lang, 1559 Peltier Lake Drive, was present and stated that she is a neighbor; she is all for the addition; they will be improving the property and she has only good things to say about it. Member Vermeulen noted that she has nothing against the request and the plans look great; but, she can't think why this is a unique situation. Mr. Scherbel stated that he is puzzled and asked if the P & Z ever grants variances. He said that none of the neighbors object, and the addition will extend out somewhere between what he has now and what is already next door. Chairperson Tourville read from Section 65.03, reasons for granting a variance and noted that P & Z has a problem with # -1, which states that special conditions and circumstances must exist which make the property unique, or which make this a unique situation. Mary Jane Lang said that she feels people on the lake should be granted variances because of Section 65.03 -1, because of the lake setback having to be met and because they are taxed so highly on their property. Member Vermeulen would like to hear the Building Inspector's ideas on Section 34.03, which uses averaging, being used to grant a building permit and maybe refunding Scherbel's fee for a variance request. The question of why the property at the corner of Main Street and Peltier Lake Drive did not need a variance, when it appears to be much closer to the street, was raised. Assistant Clerk will ask the Building Inspector. Mayor Haberman explained the wording in 34.03 which uses a variation of only six feet being used for averaging and stated that he feels this is what Gunnar Pettersen, City Building Inspector, has a problem with. P & Z Meeting Minutes Page 4 March 7, 1989 Motion by Drilling, second by Vermeulen, to table the variance request pending clarification from the Building Inspector and ask that he be at the next meeting to explain the problem with Section 34.03 of Ordinance #4, unless he decides that the section can be used to grant a building permit, motion carried unanimously. After the Scherbel "s and their neighbors left the meeting, more discussion took place. Member Vermeulen stated that she has a problem with it, when people come in and say they like whatever the person is asking for, just because they may want to do the same thing in a year or two. Chairperson Tourville stated that he has always felt that if a variance doesn't hurt anyone, why not grant it. Mayor Haberman stated if this happens, they will keep pushing until they are up to the street. Member Welk referenced Section 34.07 -1, and said that she has a problem with the exception made here for detached garages to be allowed five feet from the side yard line, as apposed to ten feet for attached garages. She stated that five feet is five feet - why should there be a difference. Discussion of a public hearing for possible approval of the Comprehensive Plan, which is to be held at the Planning and Zoning level any time after April 13th, 1989. Chairperson Tourville would want the City Attorney to see the draft first, and stated, "How can we hold a public hearing on something we haven't seen ?" Motion by Vermeulen, second by Drilling, to table the Comprehensive Plan public hearing, motion carried unanimously.
