HomeMy WebLinkAbout1989-01-03 Minutes r Pursuant to due call and notice thereof, the Plannina and Zoning Commission of the City of Centerville held a Public Hearing on Tuesday, January 3, 1989 at City Hall. Chairman Tourville called the hearing to order at 6:40 p.m. Present: Welk, Drilling and Council liaison Peterson. Absent: Vermeulen and Lindgren. The purpose of the hearing was to hear all persons present regarding a request for variance from Ordinance #4, PTlCJ _4.- NON CONFORMING USES AND STRUCTURES, Section. 44.02 STRUCTURAL CHANGE to add on to the building, and a Special Use Permit for. #12. Construction Businesses, TABLE A, under 8-1 Commercial, USES PERMITTED ON SPECIA t JS PEPMIT for the property at 7087 - 20th Avenue South (Eagle Trucking). This notice is attached to and made a part of these minutes. Dick Hubers, owner of Eagle Trucking, presented drawings and plans for the addition. Hubers stated that the addition would be 48 feet long by 28 feet wide, and would be 20 feet from the side yard setback and 30 feet from the setback line of 20th Avenue. Drilling questioned the fact that the plan showed 27 feet from the street setback line. Hubers stated that he and the Building Inspector had measured the area and it is 30 feet. Commisssi_on referenced Clerk annotation concerning Building Inspector's interpretation of the footnote to Table B which states "Where adjacent structures have front yard setbacks different from those required, the front yard setback shall conform to the average setback of the adjacent structures." Mr. Hubers stated that he feels that his building is the first building on 20th Avenue South, because the Centerville Plaza on the corner of 20th Avenue and Main Street has a Main Street address. Chairman Tourville expressed concern of Ordinance #4 not addressing the difference between Contractor's Yard and Construction Businesses. Hubers stated that it is a construction business. A short discussion of past similar variances followed. Chairman Tourville asked for comments from the audience. None were made. No persons with property within 350 feet of the property in question were present. Motion by Drilling, second by Welk, to adjourn the hearing. Hearing adjourned at 7:04 p.m. Pursuant to due call and notice thereof, the Planning and Zoning Commission of the City of Centerville held a second public hearing on January 3, 1989, at City Hall. Chairman Tourville called the hearing to order at 7:06 p.m. Present: Welk, Vermeulen, Drilling, Lindgren and Council liaison Peterson. P , Z Minutes Page two January 3, 1989 • The purpose of the hearing was to hear all Persons present concerning a request for variance from Ordinance #4, AiT?CLE 3- aUEPLEMENTARY REGULATIONS., Section 34.09 STRUCTURES TO HAVE ACCESS, Section 42.02 LOTS IN SAME OWNERSHIP and TABLE B, Minimum Lot Size in the R -2 Residential District, for a lot split at 1745 Main Street. The Notice is attached to and made a part of these minutes. Don and Myrna Opp, 1554 Holly Drive, Lino Lakes, were present to discuss the request. Mr. Opp presented a new and different proposal for comparison with the proposal presented at the December 6, 1988 meeting. He stated that he prefers the first proposal, but would use the second if it were more feasible. These proposals are attached to these minutes. Mr. Opp stated that he would like to make the best use of the property to benefit the City as well as himself. He would like to get going on something soon because the house which is presently on the property is in need of repair. He would like to repair the present house and sell it (Parcel A), and build a six or nine unit apartment building on the remaining part of the property (Parcel B). He feels either would be a tax benefit to the City. George Haberman, newly elected Mayor of the City, was present and participated in the discussion and asked questions. Chairman Tourville asked for comments and questions from the audience. None were made. Tourville noted that there were no neighboring property owners present. Motion by Lindgren, second by Drilling, to adjourn the hearing, motion carried unanimously. Hearing adjourned at 7:20 p.m. Pursuant to due call and notice thereof, the Planning and Zoning Commission of the City of Centerville held their regular meeting at City Hall on January 3, 1989. Chairman Tourville called the meeting to order at 7:21 p.m. Present: Welk, Vermeulen, Drilling, Lindgren and Council liaison Peterson. Motion by Vermeulen, second by Lindgren, to accept the minutes of the December 6, 1988 meeting, motion carried unanimously. OLD BUSINESS Discussion of Lot Split and Special Use Permit for 1745 Main Street. Chairman Tourville asked the Commission for comments. Lindgren stated that he prefers the first proposal because there J r P & Z Minutes Page three January 3, 1989 would be no access onto Main Street, He Prefers aC:c.SS from Progress Road. Drilling prefers the second proposal because only ()Fie variance would be needed. He would like to see Parcels A and B of the first proposal left as one lot. Vermeulen prefers the second plan, but again referenced Sectinn 42.02 of Ordinance #4. She feels that cieviatinn from this section is not justified. Welk stated that the first proposal has tee much on a 1: She prefers one house and more space, and feels that the second . proposal better meets the City's criteria. Mr. Opp referenced the fact that he had approached the City about two years ago concerning building a 17 unit apartment building on this property and that it was his understanding that the City was not opposed to it. Chairman Tourville stated that the City never approved it. Mayor Haberman and Council member Fetersuh participated in the discussion that followed. Chairman Tourville expressed concern . that about one-third nf the land appears to be unusable because of the ridge that drops down toward the creek. Opp stated that he intends to grade and level ridges out and that this area would be very nice- for e yard. Possible commercial use of this area was discussed and tiefitor Nabei.,11 stated that the revised Comprehensive Flan appears Lo not want that area commercial because residential is across the street. Mr. Opp stated that he has thought of putting a Hardware Store there, but the City doesn't see it that way. He feels that the second proposal is the best possible use of the property, and is asking for a variance to lot size for Parcel A and a Special Use Permit for Parcel B. Motion by Welk, second by Drilling, to table the request until February for further discussion, motion carried unanimously. Tourville stated that if P & Z does not make a recommendation within 60 days, Mr. Opp can approach the City Council directly. He stated that the Commission would be interested in any improvements to the plan that Opp could come up with. I. — NI P 6,r, Z Minutes Page four January 3, 1989 NEW BUSINESS Dick Hubers, owner of Eagle Trucking, again presented hie plans for Vermeulen and Lindgren, because they were not present at the public hearing. Discussion followed, Motion by Welk, second by Drilling, to approve the variance request for Eagle Trucking for the following reasons: - the setbacks are met; - the business is "grandfathered in; - the addition enhances the community; and - granting the variance request will not confer on the applicant any special privilege that is denied by this ordinance to other lands, structures or buildings in the same district; and recommend its approval to the City Council, motion carried unanimously. It waa the concensus of the commission. that tf Gunnar Pettersen, City Building Inspector, has further problems with interpretation of setbacks in the Commercial zone, it will be addressed at a future date. Wayne Kendrick, Pastor of Living Waters Lutheran Church, 6421 Tomahawk Trail, Lino Lakes, was present to ask for a Special Use Permit to hold Sunday services at the St. Genevieve 's Sclool and Day Care Building. He stated that they plan to use the east end of the building. Ted Erkenbrach, 7377 Peltier Circle, was present with Pastor Kendrick and stated that he did not feel that a Special Use Permit was needed because the building is already being used for church services. He further stated that they are renting not buying. Assistant Clerk stated that people bringing' their children to religion classes and dropping them off, as is presently on vas not the same as parking and staying there for services, as is being proposed. The Commission asked questions: - What time will the service be? 9:15 a.m. - Has the building been inspected for maximum safety capacity? He doesn't know. - How many people is the building coded for concerning fire protection? He does not know, but guesses about 100, ' - How much parking space is available? No one knew, but it was suggested that the east yard area could be used for parking. • Notion by Tourville, second by Drilling, that because the use of 1 Page five January 1989 the building will not change, no Special Mse Pe ,ded, motion carried unanimously. He feels that Centerville deeelioping rapidly is next in line. Mr. Huber further atated that he is here for one purpose - to do something with his property by 1990. He wants a MUSA extension and is asking that it be petitioned for now. Chairman Tourville stated to Mr. Huber that he was repeating what he had stated at the Planner Meeting and it was the intent of the outgoing City Council to wait for Comprehensive Plan completion. Mayor Haberman agreed with Tourville"s statement, and further stated t.hat he agrees with most of what he sees in the Comp. Plan with a few minor changes. He feels that it should be complete by March or April. Tourville stated that the Ordinances take t reside_ce over the Comp. Plait and he feels that the new Flan is too through. Discussion continued. Lindgren left th.c: meeting at 9:55 p.m. Motion by \✓ermeulen, second by Welk, to appoint Chairman Tourville as liaison to communicate with the Planner representing Planning and Zoning, motion carried unanimously. • Discussion of the City Survey followed.
