HomeMy WebLinkAbout1988-12-06 Minutes r Pursuant to due call and order thereof, the Planning and Zoning Commission of the City of Centerville held their regular meeting on December 6, 1988. Chairman Tourville called the meeting to order at 7:15 p.m. Present: Vermeulen, Welk, Drilling, and Lindgren. There was no Council liaison present. Motion by Drilling, second by Lindgren to approve the minutes of the November 1, 1988 meeting, motion carried unanimously. OLD BUSINESS Discussion of computer copies of Ordinances #4 and #8. Chairman Tourville noted that the amendment on page #3, dated 7/27/88, should state "square" feet. Assistant Clerk noted that this amendment was left out of the TABLE OF CONTENTS, and will be added. She will add the word "square" appropriately in the copy, also. Tourville also stated that much needs to be done yet on Ordinance #4, and he is very happy with the addition of Appendix's A and B, concerning Commercial and Industrial zones. Motion by Vermeulen, second by Welk to approve the computer copies of Ordinances #4 and #8 for distribution to the public as official copies, motion carried unanimously. NEW BUSINESS Don Opp, 1554 Holly Drive, Lino Lakes, presented an updated copy of his plan to split the property at 1745 Main Street into three lots. He stated, that he plans to repair the present house that is on the lot (Section A) and sell it; build a house on the second section (Section B - east of the present house) and sell it; and build a six -plex on the third (Section C - northern) section for rental units. A sketch of his proposal is attached to and made a part of these minutes. Opp further stated that he has acquired two small sections on the northeast and on the northwest of Section C and straightened lot lines. He plans to use a strip of land on the southwest end of his property on Progress Road (14 unit apartment) for a private road to give access to the six -plex proposed for Section C. The Commission expressed concerns and asked questions of Mr. Opp: - How far would the six -plex be from the hill on the east? About 30 feet. - Is the property in the flood plain? About 30 feet from it. - Would the six -plex impact the schools? No, because it would have 1 efficiency and 5 one - bedroom units. (The Progress Apartments have 14 units. Most are one - bedroom units and there is only one child living there.) P & Z Meeting Minutes Page 2 December 6, 1988 - Is the house at 1745 Main occupied now? Yes, it is rented. - Is the private street there now? Yes, it is part of the driveway to Progress Apartments. - Can the City Sewer System handle the extra usage? That was already answered "Yes" (per letter from Deb Gonsior, dated 1 -1986, which is on file at the City Hall). Drilling questioned whether it would be more advantageous to make Section C a part of the Progress property for reasons of square footage needed. Opp stated that it was a possibility. Welk brought up the fact that anyone having 175 feet of frontage could ask for the same thing. Lindgren stated that he had no problem with it. It appeared to be a good use of the land. Vermeulen referenced Ordinance #4, Article 4, Section 42.02. LOTS IN SAME OWNERSHIP. She has a problem with variance from this section. Tourville read from Section 64.04 CONDITIONS, concerning Special Use Permits. He stated that P & Z and City Council can impose conditions and protect the interests of the surrounding area of the City. Motion by Drilling, second by Vermeulen to hold a Public Hearing on January 3, 1989 at 7:00 p.m. to discuss a request for variance to Ordinance #4, ARTICLE 3 - SUPPLEMENTARY RFGUJATIONS, Sections 34.09 STRUCTURES TO HAVE ACCESS and 42.02 LOTS IN SAME OWNERSHIP, and TABLE B, Minimum Lot Size in the R -2 Residential district, and a Special Use Permit to build a six -unii. apartment i p Li.iilu lies in the R -2 Residential district; motion carried unanimously. Chairman Tourville instructed Mr. Opp to get more complete drawings (to scale), and suggested that P & Z look at the property in question. After Mr. Opp left the meeting, the Commission expressed frustration concerning the fact that they try to fit the Ordinance to the individual's problems and needs, rather than making the individual fit their Ordinance. Drilling mentioned having gone to the city of Scandia for a variance and being turned down flat. He stated that they know what they want and property owners must prove a hardship or conform. L P & Z Meeting Minutes Page 3 December 6, 1988 Discussion of the wording for a Special Use Permit for Sporting, Athletic and Music events in the residential districts of the City. Lindgren reviewed the reason that the amendment was put in the ordinance. The residents on LaValle Drive and other areas close to the Waterworks ball field have had problems with people from the tournaments trespassing on private property, making noise, damaging cars, parking in unauthorized areas and using property owners yards as toilets. He would like to have something to say about wording of Special Use Permits. It appeared that the rest of the Commission disagreed, and felt that Park and Recreation was better suited to handle this type of situation. Motion by Vermeulen, second by Drilling to recommend to the City Council that the amendment to Ordinance #4, concerning Sporting, Athletic and Music Events, be deleted because it is inappropriate, and a Special Use Permit is not necessary for this purpose; a permit would be sufficient; motion carried unanimously. A discussion of accomplishments and events of the past year at Planning & Zoning level followed. Chairman Tourville commended the Commission on the amendments to Ordinance #4, and stated that it still needs work. Drilling stated that they, as a group, should go to another city's P & Z meeting and see how they handle problems. He feels that our Commission needs to be more strict. Welk stated that the City does not need to take the first offer that is made; the right thing will come along. Motion by Drilling, second by Vermeulen to adjourn, motion carried unanimously.
