Pursuant to due call and notice thereof, the Planning and Zoning
Commission of the City of Centerville held a public hearing on
Tuesday, September 6, 1988. The purpose of the hearing was to
hear all persons present concerning a request for variance to
Ordinance 44, Section 24. SCHEDULE OF DISTRICT REGULATIONS., (7),
to allow eight homes to be built without attached garages in the
Royal Meadows subdivision, which is zoned 8-4 SINGLE FAMILY
MANUFACTURED HOUSING. Chairman Tourville called the hearing to
order at 7:08 p.m. Present: Welk, Linr3gren, Drilling and
Councia. liaison, Neumann. Absent: Vermeulen.
Al Schrnleo of Hart Custom Homes, developer of the Royal Meadows
subdivision, was present and. stated that the subdivision was
started. in 1084, requires 7,500 square foot lots, and there are
only eight lots left. He explained that 24 feet by 42 feet is
the normal size of the homes beTha built there, and it would be a
hardship to require a 440 square foot attached garage on homes of
this size built on lots of this size. This is entry level
housing, and most buyers cannot afford another $7,000., which is
the appralmate cost of an. attached garage.
Chairman. Tourville asked for comments from the Commission.
Lindgren stated that he would just as soon see detached garages.
Drilling warts attached, but said this may be a special case.
Welk stated. tha t smaller garages would be better thar none.
ChaTrman Tsnrville asked for comments from the audience. None
were made.

hearing on Tuesday, September 6, 1988, The purpose of the
hearinm was to review the preliminary plat of Hardwood Fonds,
which is described as "The south 10 ten acres of the west one-
half of the northeast quarter of the northeast quarter, Section
23, Tow.idhi.'. 31 Rana'' 22 Anoka County, Minnesota.
Chairman Tourville called the hearing to order at 7:24 p.m.
Present: Welk, Lindgren, Drilling and Council liaison, Neumann.
Absent: Vermeulen.
Gordon Rehbein was present representing Gerald Rehbein, who is
the developer of the proposed Hardwood Fonds subdivision.
Mr. Rehbein stated that the plan is to get utilities in, and
develop the area south of Brian Way on Brian Drive to get started
building there as soon as possible.
Chairman Tourville pointed out that several items called for in
Ordinance 48, Article 4, Section 43 - Preliminary Plat., were not
included in the map submitted by Rehbein. The fact that lot 14,

Block 1 of the plat appears to not be in compliance with the 80
foot width requirement was also discussed.
Tourville also presented a copy of a letter from the City Clerk
to Gerald Rehbeln concerning the possibility that foundry sand
may have been stored at the site (This letter is attached to,
and made a part of these minutes.)
John Stewart, City Engineer, stated that the Poliution Control
Agency must investigate this situation because of possible
contamination.

Tuesday, September 6, 1988, at City Hall. Chairman Tourvilie
called the meeting to order at 7:42 p.m. Present: Welk,
Lindgren, Drilling and Council liaison, Neumann_

Motion by Lindgren, second by Drilling to approve the minutes of
the August 2nd,1988 meeting (including the revised page #5),
notion carried unanimosly,

ion by Drilling, second by Lindgren to recommend City Council
accept the preliminary plat for the south ten acres of Hardwood
Ponds subdivision, contingent upon the submission of all items
addressed in Ordinance #Th Article 4, Section 43. - Preliminary
Flat, 43.82. SITE MAP. (43.0 -2, - 3. -4, -5, -8, -7, -8, and
-9.), 43.03. SUBDIVISION PLAT (43.03-5) and 43.04 ENGINEERING
PLANS (43.04-1, -2, and -3); that all lots have at least 80 feet
of .frontage; and contingent upon favorable results of the testing
for possible contamination from the possible storage of foundry
sand at the site; and that next plat show Brian Drive as a 66
foot road; motion carried unanimously.

John Stewart stated that Brian lj.....2-f is shown as 32 feet and should
be 36 feet.
Mort Huber, Acorn Creek development, (north of Centerville
Heights and east of Mill Road) and Richard Chromey, Centerhill
development, (north of Royal Meadows, west of 20th Avenue and
east, of Acorn Creek), presented site plans of their proposed
developments and how they have tried to follow Planner
recommendations and coordinate collector streets, parks, etc.

Mr. Huber stated that he disagreed with the Planner
recommendation that the developer pay for 100 percent of the cost
of the collector street. He feels that all who have access
should pay. He asked for sketch plan approval and direction on

Discussion followed. George Haberman, 7288 Mill Road, asked

along Mill Road that are already in. He stated that, the proposed
area of Acorn Creek is presently zoned R -1 and that there will be
a lot of objection to the rezoning to R -2A by residents on the
north. He stated that the developer is making coincessi?ns for
the north side by making larger lots and asked "What about people
west and south with large lots ?"
Nr. Huber stated that they could put. 30 foot lots (lots 12
through 15) by cutting down the size of lots 10 and 11. He said
that the development would be done in two phases, with the south
end being first.
Motion by Lindgren, second by Drilling to recommend that the laity
Council amend the Comprehensive Plan and apply for a MUSA
extension for the north , on::_ -'half of Hardwood Ponds, and Acorn

It appeared to be the concensus of the Commission that it woiuld
be premature to approve the sketch plans for Acorn Creek and
Centerhill until after the approval by Metro Sewer of the MUSA
extension:.

Mt. Huber and Mr. Chromey questioned whether they should appear
at the next City Council meeting on September 14. Council
liaison Neumann suggested that they do. Assistant Clerk was
asked to relay request to City Clerk.
Discussion of budgeting for the League of Minnesota Cities
magazine for members Welk and Vermeulen, at a cost of $30 for one
year.
Motion by Lindgren, second by Drilling to approve of adding $30
to the 1989 budget for the League magazine, motion carried
unanimously.

NEW BUSINESS
Motion by Drilling, second by Welk to grant a variance to Hart
•
Homes to build homes on the remaining eight lots in Royal Meadows
subdivision without attached garages, motion carried unanimously.
Chairman Tourville asked Mr. Schrader if the homes will be placed
on the lots in such a way as to allow room for garages. Mr.
Schrader said that they will be placed, and have been in the
past, all the way to the 10 foot setback on one side, and that a
cement pad is placed on each lot at the back of the driveway to
accomodate a garage.
Motion by Drilling, second by Lindgren to adjourn the I(leeting,
motion carried unanimously. Meeting adjourned at 9:19 p.m.

Dear Mr. hehb._ in:
It has been brought to my attention, by a City employee, that you
may have or have had foundry sand" stored or the property
proposed as Hardwood Pond Estates. I have contacted the
Pollution Control Agency and the Anoka County Health Department
for information on - foundry sand ". The Anoka County Health
Department has recommended that the site where the - foundry sand"
is or was stored be tested for Heavy metal content.
Please have the site where the "foundry sand is or was stored, •
tested under the supervision of a representative of Maier,
Stewart and Associates and a City Public Works employee,
submitting the results to the City Office. Please also submit
documentation as to where and when the .:and was obtained and what
was the content of that sand.
I will rc to the Planning and Zoning Commission and the
City Coot :LL that any approval of a preliminary plat be
contingent upon receipt of an acceptable test result, or
correction of the site if unacceptable test, results are received.
