Commission of the City of Centerville held a Public Hearing on
Tuesday, June 7, 1988. Chairman Tourville called the hearing to
order at 6:40 p.m. Present: Vermeulen, Lindgren and Council
liaison Fritchie. Absent: Welk and Drilling.
The purpose of the hearing was to hear all persons present
regarding a request for variance from Ordinance #4, TABLE B
"SCHEDULE OF DISTRICT REGULATIONS, LOT AND YARD REQUIREMENTS ", to
allow a two- - family dwelling to be constructed on a lot 100 feet
in width versus 150 feet in width. The property for which the
variance is requested is 4.64VA of Centerville Road, 4g4t. of
LaMotte Drive and south of Heritage Street and shall be described
as follows:
That part of Lot 15, Auditor's Subdivision No. 48,Anoka County,
Minnesota, described as follows: Commencing at the intersection
of the North line of said Lot 15 and the Westerly right -of -way
line of CSAH No. 4 (a /k /a Centerville Road); thence Southerly
along the said Westerly right -of -way line 255 feet; thence West
at right angles 247 feet to the point of beginning; thence
continuing West on same described line 100 feet; thence North at
right angles and to the North line of said Lot 15; thence East on
said North line 100 feet more or less, to an intersection with a
line extending North from the point of beginning and parallel
with the Westerly right -of -way line of CSAH No. 4; thence South
to the point of beginning.
Scott Mower, 6823 East Shadow Lake Drive, Lino Lakes, presented
the request and stated that the proposed two- family dwelling
would fit nicely on the lot and would stay within the 10 foot
side yard setbacks.

Chairman Tourville expresc.od concern that the Ordinance states
that P & Z must justify why a variance is granted.

Hearing on Tuesday, June 7, 1988. Chairman Tourville called the
hearing to order at 6:58 p.m. Present: Lindgren and Council
liaison Fritchie. Absent: Welk and Drilling. (Vermeulen
stepped down for the duration of the hearing.)
The purpose of the hearing was to hear all persons present
regarding a request for variance from Ordinance #4, TABLE B
"SCHEDULE OF DISTRICT REGULATIONS, LOT AND YARD REQUIREMENTS ", to
build an addition /garage outside the setback requirements of 50
feet from the traveled roadway to 31 feet 8 inches from the edge

of the traveled roadway at 1645 Peltier Lake Drive which is
described as follows:
The easterly 100 feet of that part of Lot 8 of Auditor's
Subdivision No. 47 Revised, described as follows: Commencing at
a point in the west line of said Lot 8 located 154.63 feet south
of Meander corner No. 26, which point is also the southeast
corner of Lot 1, Block 2, Burque Addition No. 1, the point of
beginning of the part to be described: thence north on said west
line a distance of 114.63 feet to a point in the City of St. Paul
Water Department Flowage Line on a deflection angle of 85 degrees
52 minutes to the right a distance of 130 feet to a point thence
continuing on said Flowage Line on a deflection angle of 15
degrees 17 minutes to the right a distance of 504.2 feet to a
point.; thence on a deflection angle of 90 degrees to the right a
distance of 474.38 feet to a point; thence on a deflection angle
of 11 degrees 09 minutes to the left a distance of 135.64 feet to
a point of beginning.
Together with a perpetual easement for road purposes over a strip
of land 50 feet wide lying southerly from and adjacent to the
above described part of said Lot 8 of Auditor's Subdivision No.
47 Revised.
John Vermeulen, 1645 Peltier Lake Drive, presented the request
and stated that the plan is to raise the garage floor because of
water problems that have worsened since Peltier Lake Drive was
reconstructed in 1987.
Member Drilling arrived shortly after 7 p.m.
Brian Miller, City Engineer, was present and stated that the
elevation has been checked and it is the same as before the
street. reconstruction. (A Iettcr concerning this is on file at
City Hall.) The curb is higher, but the driveway and the street
are the same as before.
The Building Inspector has looked at the property and has
informed the City that there are other ways of handling the
problem. He advises that it is possible to regrade the front
yard around the home to the lake. He further advises that there
is space on the east side of the home for the proposed addition.
Mr. Vermeulen stated that their case fits the requirements for
justification for a variance because it is a special or unique
situation.
After Commission members asked questions and expressed concerns,
Chairman Tourville asked for comments from the audience.

Pursuant to due call and notice thereof, the Planning and Zoning
Commission of the City of Centerville held its regular meeting on
Tuesday, June 7, 1988. Chairman Tourville called the meeting to
order at 7:50 p.m. Present: Vermeulen, Drilling, Lindgren and
Council liaison Fritchie. Absent: Welk.
Motion by Lindgren, second by Drilling to approve the minutes of
the May 3, 1988 meeting, motion carried unanimously.
OLD BUSINESS
Gerald Rehbein was present concerning Sketch Plan approval for a
development east. of Brian Drive and south of Main Street. Mr.
Rehbein pointed out the differences between this plan and the
first plan which he had presented at the May 3rd meeting.
Mr. Rehbein also stated that he would want Municipal Water for
the project and prefers a park dedication fee rather than land
for a park.
Motion by Vermeulen, second by Lindgren to approve the Rehbein
Sketch Plan. Aye: Tourville, Vermeulen and Lindgren. Nay:
Drilling.
Council liaison Fritchie pointed out that a Planner will be on
board soon and City Council will decide at their June 8 meeting
whether or not to make it City policy to collect a $500 Planner
escrow from developers at the sketch plan stage. The Planner
would review the plan for aesthetics, compatibility to the City
and compliance to City ordinances.
Member Drilling stated that he would like to wait for the Planner
before approving this plan.
Motion by Lindgren, second by Vermeulen to recommend to City
Council that a feasibility study be done on the proposed Rehbein
development, contingent upon Park and Recreation Committee
approval. Aye: Tourville, Vermeulen and Lindgren. Nay:
Drilling.
Discussion of vacation of Westview from Main Street east to
Centerville Road. Neither of the abutting property owners were
present.

Motion by Drilling, second by Lindgren to hold a Public Hearing
to discuss vacating Westview contingent upon City researching
that there are no easements there and contingent upon the
abutting property owners paying all costs incurred, motion
carried unanimously.
Discussion of the Assessment Manual for the City of Centerville.
Brian Miller, City Engineer, and Tammy Miltz-- Miller, City Clerk,
pointed out changes to the manual from the original copy. Ms.
Mi.itz- Miller also pointed out areas of the manual that were
changes in City policy.
Motion by Lindgren, second by Drilling to recommend City Council
approval of the Assessment Manual pending investigation by the
City Engineer on wording and changes for page 4 - #5 Emit
Footage a. Singe Frontage hots and page 6 - 48. Assessment
Period (budgeting versus assessment for bituminous overlay) and
page 22 (same concern) with the understanding that. the City
Attorney will be reviewing it, motion carried unanimously.
Discussion of wording for Attached Garages. Chairman Tourville
set aside this amendment. to Ordinance #4 to be handled along with
other proposed amendments under New Business.
NEW BUSINESS
Motion by Lindgren, second by Drilling to table Scott Mower
request for variance pending review by the City Planner, motion
carried unanimously.
Motion by Drilling, second by Lindgren to table Vermeulen request
for variance pending Vermeulen discussing "average setback"
criteria with the Building Inspector for his interpretation and

abstained.
Clyde Rehbein, Northway Construction, Inc., was present to
discuss his variance request to build a pole -type building on Lot
2, Block 1, Industrial Park. Mr. Rehbein stated that he is
presently tearing down the building in Shoreview and would like
to have it rebuilt on the new site. He further stated that he
only heard about our Moratorium Ordinance in April.
Motion by Drilling, second by Lindgren recommending City Council
deny the variance request of Clyde Rehbein based on the prior
case and until the Planner can look at it and tell the City his
feeling on the Moratorium Ordinance, motion carried unanimously.
Discussion of appointment of two P & Z members to work with the
Planner on an Economic Development Plan for the City. Chairman

' Tourville and member Lindgren volunteered to represent P & Z.
Members Vermeulen and Drilling will be alternates.
Discussion of the addition of Appendix B - Industrial to
Ordinance #4. Suggested changes are:
1. B -5 wording to match page 9 - 33.02 and amending
Appendix A - Commercial to read the same.
2. B -16 (1.) increase "forty (40) feet" to "one
hundred (100) feet" and amending Appendix A to
read the same.
Discussion of proposed Fencing Amendment. Commission felt
34.02 -5 in Section 34.02 should be deleted and Section 25.11.
FENCES. (with proposed wording) should be added to replace it.
City Clerk will contact the City Attorney for appropriate wording
to be added to R -1 and R -2 Agricultural concerning fences.
Discussion of proposed Setback Amendment to TABLE B - SCHEDULE OF
DISTRICT REGULATIONS, LOT AND YARD REQUIREMENTS. It was
suggested that for all "R" districts and "P -1" district, FRONT
YARD SETBACK'S be changed from "50 feet" to "35 feet" and that
ail districts have the following footnote:
( + +) From the edge of the street right -of- -way. Sites abutting
County Roads shall require a review by the County Engineer.
Where adjacent structures have front yard setbacks different from
those required, the front yard setback shall conform to the
average setback of the adjacent structures. If only one adjacent
lot is occupied by a structure, the front yard setback shall be
the average of the required setback and that of adjacent
structure. (City Clerk noted that R -2A and Commercial districts
already use "street right -of- way".)
Motion by Vermeulen, second by Lindgren to hold a Public Hearing
on July 5, 1988, to discuss all the proposed amendments with the
changes discussed, motion carried unanimously.
Chairman Tourville asked that the minutes reflect his concern
about the increased number of bikers and walkers on Centerville
• Road and that thought should be given to possible hazard there.
Motion by Vermeulen, second by Lindgren to adjourn the meeting,
motion carried unanimously.
