HomeMy WebLinkAbout1988-05-03 Minutes P r— Pursuant to due call and notice thereof, the Planning and Zoning Commission of the City of Centerville held a Public Hearing on Tuesday, May 3, 1988. Chairman Tourville called the hearing to order at 7:11 p.m. Present: Vermeulen, Welk, Drilling, Lindgren, and Council liaison Neumann. The purpose of the hearing was to hear all persons present regarding amending Ordinance #4 to include changes to TABLE B and Article 32.03 Signs, and the addition of Appendix A - COMMERCIAL DISTRICT. The proposed amendments are attached to and made a part of these minutes. Chairman Tourville stated that A -10 - :ri Flan wording stating Site plans for all developments require special use permits prior to the issuance of building permits." seems unnecessary as far as he is concerned. Vermeulen agreed. Tourville also stated that A -16 Driveways wording of "(1 ") No driveway shall be located within forty (40) feet of any right -of- way line of a street intersection." is too close. No further comments from the Commission or the audience. Motion by Lindgren, second by Drilling to adjourn the hearing, motion carried unanimously. Hearing adjourned at 7:17 p.m. Pursuant to due call and notice thereof, the Planning and Zoning Commission of the City of Centerville held its regular meeting on Tuesday, May 3, 1988. Chairman Tourville called the meeting to order at 7:18 p.m. Present: Vermeulen, Welk, Drilling, Lindgren and Council liaison, Neumann. Motion by Drilling, second by Lindgren to accept the minutes of the April 19, 1988 special meeting, motion carried unanimously, OLD BUSINESS Short discussion of Amendments to Ordinance #4. Motion by Vermeulen, second by Welk to table Amendments to Ordinance #4, pending more information concerning wording in A- 10 and A -16 (as previously mentioned), motion carried unanimously. Discussion of Rehbein proposed development north of Main Street and east of Shad Avenue. Jerry Rehbein, 6266 Otter Lake Road, Lino Lakes, was present and stated that he would like to move along on this project enough to get Municipal Water through to the development he is proposing south of Main Street and east of Brian Drive. L P P & Z Meeting Minutes Page 2 May 3, 1988 Chairman Tourville referenced the motion made at the April 13 City Council meeting denying P & Z's recommendation to order a feasibility study for this development and tabled further discussion of Rehbein developments until the New Bbsiness portion of the meeting. Discussion of the new zoning map. It was stated that this map is a redrawing and clarification of present zoning. Members of the audience expressed concerns and asked questions: Dennis Murray, Consultant to Willy Lessard of Lake Area Utility Contracting, 6995 - 20th Avenue South - Murray stated (concerning R -3 zoning), "We want to register concern about this particular type of zoning. Lake Area wants to stay and wants to be treated fairly. We are paying taxes on totally Commercial property." Willy Lessard, Lake Area Utility Contracting, 6995 - 20th Avenue South Carol Pelton, 7178 Mill Road Gerald Rehbein, 6266 Otter Lake Road, Lino Lakes Brian Miller, City Engineer, arrived at 7:52 p.m. Discussion of Zoning map continued for quite some time. Dennis Murray asked for a recommendation from P & Z to appear at the Council level to voice Lake Area's concerns about present zoning, especially the R -3. A recommendation was given, no m„+ i n,, P & Z wants it on record that they feel the southwest corner of the zoning map is incorrect. The Bowman property is not in the MUSA boundary. NEW BUSINESS Kevin Mullens, 7000 West Shadow Lake Drive, Lino Lakes, appeared to ask for a lot split for a 30 by 50 foot parcel to be split from Lot 9, Block 12 (the Bob LaMotte property) and sold to him. He stated that this parcel makes his lot a buildable lot. Motion by Welk, second by Vermuelen to accept the lot split and make recommendation for it's approval to the City Council, with the stipulation that it be a part of the Mullens property, motion carried unanimously. P P & Z Meeting Minutea Page 3 May 3, 1988 P & Z tabled discussion of vacating a portion of Westview because Robert Phillips, who requested the vacation, was not present. City Office was asked to research whether this vacation took place some time ago. Several members of P & Z are certain that it did. Discussion of Sketch Plan for proposed Rehbein development south of Main Street and east of Brian Drive. City Engineer and Commission members expressed concerns about flood plain, dead -end street, long cul -de -sacs, how Municipal Water could be brought to the site, rezoning, etc. Motion by Lindgren to recommend to City Council that a feasibility study of the proposed Rehbein development be done. Motion failed, lack of second. Motion by Vermeulen, second by Welk, to table the matter for further discussion. After more questions from Mr. Rehbein, Vermeulen withdrew the motion and Welk withdrew the second. Motion by Lindgren, second by Drilling to recommend to the City Council that a feasibility study, paid for by the developer, for phases 1 and 2 of the proposed Rehbein development south of Main Street be done, motion carried unanimously. Discussion of Sketch Plan for a residential development by Kenco Construction between Centerville Road and Central Park. Bob Barett, 6953 Centerville Road, and Marcel Rivard, 7072 Progress Road were present and, along with the Commission, expressed concerns about the two landlocked parcels (one of which is owned by Mr. Barett). Kent Roessler of Kenco Construction was present and stated he was willing to work with neighboring property owners. Motion by Drilling, second by Welk recommending Kenco Construction go to the City Council with the concept of an R -2 residential development and request a MUSA extension, motion carried unanimously. Discussion of Bob Barett request for variance to erect a shed on his back lot. Commission told him that because there is no access to the lot, he cannot build on it unless he changes the title and combines his lots under one PIN number. Mr. Barett stated that he knows what his next step has to be and he will wait and see what happens. Motion by Vermeulen, second by Welk to make recommendation to the City Council that rezoning of Central Park to P -1 be done -P--&- L r P & Z Meeting Minutes Page 4 May 3, 1988 concurrently with the next Comprehensive Plan Amendment, motion carried unanimously. Discussion of the length of P & Z meetings followed. Motion by Welk, second by Vermeulen to adjourn the meeting, motion carried unanimously. Hughes Assistant City Clerk PROPOSED AMENDMENTS TO ORDINANCE #4 TABLE B SCHEDULE OF DISTRICT REGULATIONS LOT AND YARD REQUIREMENTS Amend to: YARD SETBACK (FEET) FRONT ++ ma BIDE B - 1 COMMRRCTAT, All uses 30 30 20 Amend to: ( + +) From the edge of the street right of way. Sites abutting County Roads shall require a review by the County Engineer. Where adjacent structures have front yard setbacks different from those required the front yard set -back shall conform to the average set -back of '.the adjacent structures. If only one adjacent lot is occupied by a structure, the front yard set -back shall be the average of the required set -back and that of adjacent structure. Addition.of Appendix A -- COMMERCIAL DISTRICT Section: A -1 - Purpose. The purpose of the Commercial District is to provide for a limited mixture of land uses, made mutually compatible through controls and high quality standard. To facilitate more intensive and higher valued development and redevelopment of areas convenient to the Metropolitan market Area. This District shall allow opportunities to integrate quality . commercial uses, providing the opportunity to benefit from excellent visibility from major arterial routes in conjunction with major local thoroughfares. A -2 - General Minimum Reanirrmentr. Tpe following minimum requirements, as set forth in Appendix A herein, shall apply to all .buildings that may be erected, converted or structurally altered in Commercial Districts. A - - Permitted Prinr,inal Uses/Uses Permitted on Special Use 'Permit. As provided in TABLE A - SCHEDULE OF DISTRICT REGULATIONS, PERMITTED AND SPECIAL USES in this ordinance. A -4 - Sethank. See TABLE B - SCHEDULE OF DISTRICT REGULATIONS LOT AND YARD REQUIREMENTS. A -5 - Building Height in Commercial DiRtrinta. Building height in Commercial Districts shall be limited to two (2) stories. A -6 - Off Street Parking. As provided in Section 36 of this • -/- ordinance. In addition to Section 36: (1.) Space for a single vehicle shall be nine (9) feet by eighteen (18) feet or larger. (2.) Off street parking area shall be surfaced with asphalt or concrete, and with permanent concrete curbs to define driveways and parking limits. Plans and specifications for parking areas shall be reviewed by the City Engineer, and approved by the City Council prior to construction. (3.) All open off street parking areas having more than six (6) parking spaces shall be effectively screened by a wall, fence of acceptable design, or compact hedge along all sides which adjoin or are directly across the street, from a property in a residential zone or institutional use. Such wall, fence or hedge shall be maintained in good condition.' Plans for fencing shall be approved by the City Council. The fence shall not be used for advertising purposes. (4.) There street within 15 feet any other lot line. (5.) Off street parking areas shall be so graded and drained as to shall be tolapproval water. Drainage plans City Engineer. A - - Puffer Zone Between Commercial and Residential Districts. Where a Commercial District abuts a Residential District, any new development' shall include a buffer zone. There shall be a protective strip of not less than ten (10) feet . in width. This protective strip shall contain no structures, shall not be used for parking, off street loading, or storage, and shall be landscaped. The landscape treatment shall include a compact screen wall or fence, but shall not extend within fifteen (15) feet of the street right-of-way. The planting or fence design must be approved by the City Council as.being in harmony with a residential neighborhood' and providing sufficient screening of the commercial 'area. The hedge or fence shall be no less than six (6) nor more than 'Six and one half (6 1/2) feet in height. A - $neenina City Council requires variance or special use permit, the applicant shall comply with the following conditions: (1.) File a copy of the screening plans with the Zoning Administrator. (2.) The screening, planting or construction, or both shall be complete within one year from the date' of building permit, subject to extension by the City Council. (3.) The screening shall be maintained after completion. — 2 — mw (4.) A dollar amount of one and one -half times the estimated cost of planting and construction of the screening, shall be filed with the City in the form of a cash escrow or letter ' of credit. The cash escrow or letter of credit amount shall be forfeited to the City if any provision of this section is violated. A -9 - J,andscaping. Three (3) percent of the surface area of the land within a parking area shall be landscaped with grass and shrubbery or other approved ground cover. Landscaped areas will be maintained by the property owner on a continuous basis. Green areas within abutting street right - of -ways will also be maintained by the property owner. A -10 - Bite Plan. Site plans for all developments require special use permits prior to the issuance of building permits. At least the following information shall be submitted for review: (1.) Site development plan. (2.) Building plans, including building elevations, indicating mass, building materials, and color of all exterior surfaces, including all materials proposed to meet the screening requirements of this Ordinance. (3.) Landscape plans, including the number, species, and size of all plantings. (4.) Grading, drainage, and utility plans. A-11 - Accessory structures. Garages, accessory structures, screen walls and exposed areas of retaining walls shall be of similar type, quality, and appearance as the principal structure. A -12 - Exterior of Building. All buildings shall be finished on all sides with permanent finished materials of consistent quality. A - - permitted Encroachments. The following shall not be considered as encroachments on setbacks subject to other conditions within this Ordinance: (1.) Off street open parking spaces, flues, belt course, leaders, sills, pilaster, lintels, cornices, eaves, gutters, awnings, open terraces, service station pump islands *, open canopies, steps, chimneys, flag poles, ornamental features, open fire escapes, sidewalks, and fences, except as hereinafter amended. A - - Exterior Merchandise. There shall be no exterior storage or exterior display of merchandise, unless approved by the City Council through a special use permit. * Center line of pump island shall be no less than twenty -five (25) feet from a street right of way or property line. -3 - A -15 - J,iahtina. All lighting shall be shielded, deflected or diffused so as to not cause any beamed, directed or intense lighting to fall upon adjacent land being utilized for residential purposes, or to not cause andy traffic hazard. A -16 - Driveways. (1.) No driveway shall be located within forty (40) feet of any right -of -way line of a street intersection. Said distances shall be measured along the property line from the corner right -of -way line. (2.) Access drive onto county roads shall require a review by the County Engineer. This review shall be acquired prior to the issuance of any building permits. A - 17 - $penia) Use Permits,. As provided in section 64 of this ordinance. Criteria for Issuance of Special Use Permit. When reviewing an application for a special use permit the Planning and Zoning Commission and City Council shall consider the following criteria: (1.) Impact on traffic. (2.) Impact on parks, streets, and other public facilities. (3.) Compatibility of the site plan, internal traffic circulation, landscaping and structures with contiguous properties. (4.) Impact of the use on the market value of contiguous properties. (5.) Impact on general public health, safety and welfare. (6.) Compatibility with the City's comprehensive plan. A -1.8 - Sienn. As provided in section 32.03 of this ordinance. A -19 - Refuse. (1.) All premises shall be provide with, at owners expense, an adequate number of approved containers to hold the garbage accumulated. by such 'premises until such garbage is removed from the premises. Such containers shall be made of metal or other suitable material, shall be water tight, insect and rodent proof, and shall be of a material not easily corrodible and equipped with suitable handles and tight fitting covers and shall be • kept covered when there is garbage stored therein. (2.) Garbage and rubbish containers shall be placed at the rear of the premises or in such a manner as to be out of view from the street. In no event shall container or their enclosures be placed or maintained in such a way to unreasonably interfere with the use or enjoyment of adjoining property. (3.) All garbage containers located adjacent to land utilized for residential purpose shall be screened with a suitable enclosure. (4.) Every garbage or rubbish container required shall be • maintained in as sanitary a condition as is possible and shall be thoroughly cleansed as needed. If, upon inspection by the Administrative Authority a container is found to be in poor repair, corroded or otherwise defective the Administrative Authority shall notify, in writing, the provider or user of the container of the deficiency and shall require the repair or replacement of the container within fifteen (15) days. All container enclosures shall also be kept in good repair. Article 32.03 Signs Amend Article 32.03 -6 to: (4) Roof signs, flashing signs, motion signs and those•aigns ' giving off an intermittent or rotating beam or ray of light shall be prohibited. (7) Signs shall not be painted directly on the outside wall of a building. Signs shall not be painted on a fence, tree, stone, or other similar objects. (8) Window signs shall not exceed fifty (50) percent of the total area of the window in which they are displayed. (9) Signs and /or posters which are tacked on trees, fences, utility poles or other such permanent supports is prohibited. Amend Article 32.03 -7 to: (3) Shopping centers, warehouses and other buildings with multiple businesses shall submit a sign plan to be reviewed by the Planning and Zoning Commission and the City Council. This special use permit will be renewed annually by the City Council. Properties in noncompliance will not be renewed.
