HomeMy WebLinkAbout1988-04-19 Minutes Pursuant to due call and notice thereof, the Planning & Zoning
Commission of the City of Centerville held a special meeting on
Tuesday, April 19, 1988, at City Hall. The purpose of the
meeting was to discuss items tabled at previous meetings and
further amendments to Ordinance #4. Chairman Tourville called
the meeting to order at 7:15 p.m. Present: Welk, Drilling and
Lindgren. Absent: Vermeulen and Council liaison Burgstahler.
Motion by Lindgren, second by Welk to accept the minutes of the
April 11, 1988 meeting, motion carried unanimously.
OLD BUSINESS
Sonny DaBruzzi of Ro -So Contracting, 7137 - 20th Avenue North,
was present to try to clarify Permitted Uses in the Commercial
Zone.
Chairman Tourville stated that there are no definitions of the
stated Permitted Uses in Ordinance #4.
Mr. DaBruzzi made statements and comments to the effect that
there are very few uses that could be in his building. He stated
that the process for a Special Use Permit is too involved and
time consuming, and at this time he is going to forget about
adding to his building or renting out part of it and use the area
vacated by the Cabinet Shop for his office. One -half of the
building is vacant at this time.
Discussion of extension of Lino Lakes street off LaMotte Drive
for Kenco "s proposed 17 lot development. Lino Lakes would like
Centerville to consider the possibility of a road out from this
development to the east, to connect with Centerville Road. Their
letter dated March 21, 1988, concerning this is on file at City
Hall.
Shirley Drewlo, 7029 Centerville Road, was present and
participated in the discussion.
Motion by Lindgren, second by Drilling to have Assistant Clerk
write a letter to Lino Lakes City Planner stating that they are
not in favor of this. (It is too far in the future - the area is
non - sewered - property to the east of this development is zoned
R -R - the Comprehensive Plan does not call for any more MUSA
extensions.) Motion carried unanimously.
Discussion of letter from Lino Lakes P & Z concerning
coordinating street names of our cities.
P & Z asked Assistant Clerk to write a letter to Lino Lakes
recommending that they approach our Street Naming Committee for
their feelings on the subject. They also suggested the Fire
Department should review any new street names. (This letter is
also on file at City Hall.)

Discussion of proposed amendment to Ordinance #4 concerning
adding Appendix A regulating commercial development.
Chairman Tourville stated that Ordinance #4 has been lacking in
this respect until now, and the changes are appropriate. P & Z
will address this further at the Public Hearing before the May 3
meeting.
Discussion of changes in house sizes.
Chairman Tourville asked members if they were satisfied with
present house sizes. Drilling - yes. Welk - yes. Lindgren -
yes, with garages.
Discussion of attached garages.
Motion by Drilling, second by Lindgren to have City staff
research language and /or wording to add the requirement of
attached garages for new residential construction and placement
of this language in Ordinance #4, motion carried unanimously.
Discussion of amendment to Ordinance #44.
Motion by Welk, second by Drilling to recommend adoption of the
amendment to Ordinance #44 as proposed, motion carried
unanimously. This amendment is attached to and made a part of
these minutes.
Motion by Welk, second by Lindgren to adjourn the meeting, motion
carried unanimously.

AMENDMENT TO ORDINANCE 044
This is an amendment to Ordinance #44 to include, after Section
#5. Appeal Provisions., the following:
Section #6. Variance Standards. Variances from the literal
provisions of the ordinance may be granted in instances where
their strict enforcement would cause undo hardship because of
circumstances unique to the individual property under
consideration.
In considering all requests for variance or appeal and in taking
subsequent action, the city shall make a finding of fact:
(1) That the property in question can not be put to a
reasonable use if used under conditions allowed by the
official controls.
(2) That the plight of the land owner is due to
circumstances unique to his property not created by the
land owner.
(3) That the hardship is not due to economic considerations
alone and when a reasonable use for the property exists
under the terms of the ordinance.
(4) That granting the variance requested will not confer on
the applicant any special privilege that would be
denied by this Ordinance to other lands, structures, or
buildings in the same district.
.(5) That the proposed actions will not unreasonably
diminish or impair established property values within
the neighborhood.
(6) That the proposed actions will be in keeping with the
spirit and intent of the ordinance.
Sections #6,7, and 8 to be renumbered accordingly.
