Pursuant to due call and notice= thereof the Planning and Zoning
Commission of the City of Centerville held a special meeting
Tuesday, March 22, 1988. The purpose of the meeting was to
discuss items tabled at previous meetings. Chairman Tourville
called the meeting to order at 7:22 p.m. Present: Welk,
Vermeulen and Council liaison Neumann. Absent: Lindgren and
Drilling.
Motion by Welk, second by Vermeulen to approve the minutes of the
March 1, 1988, meeting with the following change to the last
paragraph of page 1, the East 246.44 x 310.89 feet" instead of
"the East 225 x 275 feet ", motion carried unanimously.
OLD BUSINESS
Discussion of amending Ordinance #4. Tamara Miltz- Miller, the
City Clerk, was present to express some of her concerns and help
the Commission decide on some needed changes.
Motion by Vermeulen, second by Welk to set up a Public Hearing to
discuss making the following changes to amend Ordinance #4 and to
make recommendation to the City Council for their approval at the
April 13, 1988 meeting:
TABLE A
Under I -1 Industrial, remove #5. Supply Yard; #7. Truck Terminals,
#8. Public Parking, #9. Parking Lots, #11. Contractor's Yard from
the list of PERMITTED PRINCIPAL USES and add them to the list of
USES PERMITTED ON SPECIAL USE PERMIT.
Under B -1 Commercial, PERMITTED PRINCIPAL USES change #3. Offices
and Banks to Financial Institutions, #4. Personal & Professional
Services to Personal & Professional Business Offices, also add
#11. Barber & Beauty Shops and #12. Laundry /Dry Cleaning/
Tailoring, move to the list of USES PERMITTED ON SPECIAL USE
PERMIT #6. Parking Lots and make it #13. and add #14. Car Washes,
also remove 44. Supply Yards from the list.
Also, add this paragraph to the bottom of TABLE A, B -1
Commercial* and I -1 Industrial* - *Upon application it is the
policy of the Planning & Zoning Commission to make recommendation
to the City Council to consider amendments to the Zoning
Ordinance which would add to this list those uses which are not
specified in the Ordinance but are compatible with those listed
permitted uses. Fee to be set by Council Resolution."
TABLE B, SCHEDULE OF DISTRICT REGULATIONS - LOT AND YARD
REQUIREMENTS
Change - "( + +) from the edge of the traveled roadway, setbacks on
County roads is 69 feet from the edge of the traveled roadway,"
to read, "( + +) from the edge of the traveled roadway, setbacks on

County roads will comply with County requirements. "Motion carried
unanimously.
Motion by Vermeulen, second by Welk to Table #2. House Size
Changes, and #3. Attached Garages, until all Commission members
are present, motion carried unanimously.
Motion by Tourville, second by Vermeulen for City Clerk to
research and take appropriate action on LaMotte Drive /Mound Trail
issue, motion carried unanimously.
NEW BUSINESS
Discussion of Moratorium on pole buildings.
Motion by Welk, second by Vermeulen to send the following
proposed amendment to Ordinance #44 to the City Attorney for his
approval, and then make recommendation to the Council:
After Section #5. Appeal Provisions., add:
"Section #6. Variance Standards. Variances from the literal
provisions of the ordinance may be granted in instances where
their strict enforcement would cause undo hardship because of
circumstances unique to the individual property under
consideration.
In considering all requests for variance or appeal and in taking
subsequent action, the city shall make a finding of fact:
(1) That the property in question can not be put to a
reasonable use if used under conditions allowed by the
official controls.
(2) That the plight of the land owner is due to
circumstances unique to his property not created by the
land owner.
(3) That the hardship is not due to economic considerations
alone and when a reasonable use for the property exists
under the terms of the ordinance.
(4) That granting the variance requested will not confer on
the applicant any special privilege that would be
denied by this Ordinance to other lands, structures, or
buildings in the same district.
(5) That the proposed actions will not unreasonably
diminish or impair established property values within
the neighborhood.

(6) That the proposed actions will be in keeping with the spirit
and intent of the ordinance."
Sections #6,7, and 8 to be renumbered accordingly, motion carried
unanimously.
Motion by Vermeulen, second by Welk to adjourn the meeting,
motion carried unanimously.
Meeting adjourned at 10:10 p.m.
