Commission of the City of Centerville held a public hearing
Tuesday, September 1, 1987 at City Hall. Chairman Tourville
called the hearing to order at 7 :08 p.m. Present: Buesseler,
Welk, Lindgren, Vermeulen, Council liaison Fritchie.
The purpose of the hearing was to discuss: 1. Amending
Ordinance #4 under B -1 Commercial - Schedule of District
Regulations, from PERMITTED PRINCIPAL USES to USES PERMITTED ON
SPECIAL USE PERMIT 2. Amending Ordinance #4 regarding HOME
OCCUPATIONS.
Chairman Tourville introduced City Building Inspector, Gunnar
Pettersen. Mr. Pettersen stated his concern that our Zoning
Ordinances do not cover enough; the list needs to be expanded.
He made references to Roseville's Zoning Ordinances and left a
copy for P & Z review. The Commission and Council liaison
Fritchie voiced their concerns and asked questions of Inspector
Pettersen.
Discussion of the Home Occupations portion of Ordinance #4
followed. The Commission expressed concerns about more
distinction between Special Use and Home Occupation permits.
Compliance to the Ordinance was also discussed.

Pursuant to due call and notice thereof, the Planning and Zoning
Commission of the City of Centerville held a public hearing
Tuesday, September 1, 1987 at City Hall. Chairman Tourville
called the hearing to order at 7 :43 p.m. Present: Buesseler,
Welk, Lindgren, Vermeulen, Council liaison Fritchie.
The purpose of the hearing was to hear all persons present
regarding the possibility of granting a variance to Ordinance #8,
Article 2 -21.05 to separate parcels of land -the Prachar property.
The purpose being to sell the property at some future time and
keep the MCI tower separate.
Walter Prachar, Box 78A Little Pine Route, Aitkin, MN, presented
the variance request. Discussion followed. Peter Nadeau, 6644-
20th Avenue South, asked questions of Mr. Prachar and expressed
concerns and objections to the variance.
Hearing adjourned at 8:10.

on September 1, 1987 at City Hall. Chairman Tourville called the
meeting to order at 8 :12 p.m. Present: Buesseler, Welk,
Lindgren, Vermeulen, and Council liaison Fritchie.

meeting. Changed paragraph 5, page 1 - Shirley to Sheila Godwin.
Changed paragraph 6, page 2 - 04 & 05 to Ordinance 08 regarding
land swaps, and general changes to Ordinance 04.
Motion by Buesseler, second by Vermeulen to approve the minutes
of August 4 meeting with the two changes above and notation ( *see
attachment) added to paragraph #7 of page 01, motion carried
unanimously.
APPEARANCES
Ed Albrecht, 1729 Peltier Lake Drive, appeared to discuss the
possibility of a variance to erect a 12 X 16 building on Outlot
A, which is a part of his property. He stated that he had
discussed this with the Building Inspector and discovered it was
a drainage easement. He needs direction.
Discussion followed.
Motion by Buesseler, second by Vermeulen recommending the City
Engineer look into the situation and advise P & Z if Outlot A is
needed for a drainage easement, motion passed unanimously.
Marcel Rivard, 7072 Progress Road called and asked P & Z to
discuss his request to erect an office addition to his building
at 7087 Progress Road. City Building Inspector stated that it is
zoned Commercial and is in the old part of town. Set back and
lot size variances are needed. Commission member Buesseler
referenced Ordinance 04, Section 43.01 - CHANGE IN NON - CONFORMITY
and SCHEDULE OF DISTRICT REGULATIONS. He feels Commission would
not grant a variance. Chairman Tourville asked how it can be
dealt with. Bldg. Inspector stated if neighbors don't object and
needs such as parking are taken care of. (Inspector Pettersen
volunteered to attend working sessions Qf i & Z)
OLD BUSINESS
Discussion of Ordinance 04, B -1 Commercial - SCHEDULE OF DISTRICT
REGULATIONS.
Motion by Buesseler, second by Lindgren to accept amendments as
proposed, motion carried unanimously.
Discussion of Prachar request for variance to Ordinance 08,
Article 02- 21.05. Commission feels request does not meet any of
exceptions 01 through 06. Stated 01, 2, and 3 are to prevent
land- locked pieces.
Motion by Lindgren, second by Buesseler to table Prachar variance
request until receipt of information from other communities,

motion passed unanimously.
Assistant Clerk was asked to have the information at the next
meeting.
Discussion of Wegleitner Plat. City Attorney feels the only
problem is on 60 day time limit and current Ordinance should be
used.
Motion by Buesseler, second by Vermeulen to grant a variance to
Ordinance #8, Section 45.04 -3, Mr. Wegleitner must file within
60 days of Council approval as required by current Ordinance,
motion carried unanimously.
Motion by Buesseler, second by Lindgren recommending City
Engineer supply City Council with written recommendation of
approval of Wegleitner Plat, motion carried unanimously.
Discussion of Ordinance #8 regarding land swaps. Clerk stated
that Donald Opp feels he already paid his attorney, why must he
pay for City Attorney? Chairman Tourville replied that we have
no choice but to have our attorney review property descriptions
and City Clerk must sign to the County that it is correct.
Motion by Tourville, second by Buesseler to table changes to
Ordinance #8 regarding land swaps, for receipt of more
information.
Recess at 10:08.
Meeting resumed at 10:20.
Discussion of general changes to Ordinance #4. Motion by
Tonrville, s?rond by Welk to Mart working cn changes to
Ordinance #4 at the extra meetings beginning the third Tuesday in
November with setting goals, and starting again in January.
Motion carried unanimously.
Discussion of City Maps. Commission member Welk stated we can
use monies left over from 1987 to add to the $1200 budgeted for
1988. After the November meeting we will have a better idea of
the amount we will have.
Motion by Tourville, second by Welk to table the issue of City
Maps until November, motion carried unanimously.
Discussion of Public Hearing regarding Article #1, Section 32.01.
Motion by Buesseler, second by Vermeulen to amend Ordinance #4,
Section 32.01 as indicated in Public Notice except Section
Planning and Zoning Commission

32.01 -1 will be stricken and all the remaining Sections numbered
accordingly, motion carried unanimously.
The above mentioned Amendment is attached to and made a part of
these minutes.
NEW BUSINESS
Discussion of letter of complaint from Charles and Lisa LeMay,
6620 - 20th Avenue South, Lino Lakes, concerning the hours of
Rehbein Trucking. Council liaison Fritchie stated that City
Council wants a recommendation from P & Z concerning time limits
for running trucks.
Motion by Buesseler, second by Lindgren for City Clerk to send a
letter to Rehbein Trucking asking that their trucks enter the
freeway from County 14 instead of County J before 7 a.m. and
after 5 p.m., motion carried unanimously.
CLERK ADVISEMENTS
City Clerk advised Commission that Will Sykes of Jer -neen Spring
Manufacturing has inquired about buying and building in our
industrial park. Discussion of our Zoning Ordinances followed.
Commission member Buesseler advised P & Z that this is his last
meeting because he is moving out of Centerville. He will be
missed a great deal.
City Clerk will advertise the vacancy on P & Z.
Motion by Vermeulen, second by Welk to adjourn the meeting,
motion carried unanimously.

ance with the following requirements:
32.01 -1- PERMIT REQUIRED. No home occupation may be conducted in a dwelling
unit without a special use permit. Permits will be issued by the
City Clerk upon approval of City Council and the payment of the
scheduled fee. When a permit is issued, the City Clerk will notify
the abutting property owners in writing within thirty (30) days.
32.01 -2- SUBORDINATE USE. The use of the dwelling unit for the home occupa-
• tion shall be clearly incidental and subordinate to its residential
use, and not more than twenty (20) percent of floor area of the f
dwelling unit shall be used.in the conduct of the home occupation.
32.01 -3- EMPLOYEES. The home occupation shall be carried on by a member of
the family residing in the dwelling unit with not more than one
employee who is not part of the family.

NOTICE OF HEARING ON VARIANCE
NOTICE IS HEREBY GIVEN that a public hearing will be
held before the Planning and Zoning Commission of the
City of Centerville, at the City Hall, on the 4th day
of August at 7:00 P.M. The purpose will be to hear all
persons present regarding a variance request to build a
garage outside the side setback requirements of 1585 Peltier
