HomeMy WebLinkAbout1987-07-07 Minutes Pursuant to due call and notice thereof, the Planning and Zoning Commission of Centerville held a public hearing Tuesday, July 7, 1987 at City Hall. Chairman Tourville called the hearing to order at 7:05 p.m. Present: Buesseler, Welk, Lindgren, Council liaison Neumann. Absent: Vermeulen. The purpose of the hearing was to hear all persons present regarding a request for variance to Ordinance #8 to straighten lot lines by purchasing or land swapping of the parcels involved. Charles Underwood would obtain title to the property: Beginning at the northeast corner of Lot 7, Block 3, Centerville thence North 50 feet along the northerly extension of the East line of Lot 7, Block 3, Centerville; thence West 15 feet along the North line of vacated Westview Street; thence South 50 feet parallel to the northerly extension of the East line of Lot 7, Block 3, Centerville; thence East 15 feet along the North line of Lot 7, Block 3, Centerville to the point of beginning. Donald Opp would obtain title to the properties: The South 30 feet of the East 25 feet of Lot 9, Block 3 in the Village of Centerville. The East 15 feet of the North 20 feet of Lot 9, Block 3, Centerville. Parts of Lots number 3, 4 and 5 of Block 3 in village of Centerville described as follows: Commencing at the northeast corner of Lot 2, Block 3 in the village of Centerville, thence North 0 degrees 14 minutes 08 seconds East along the east line of said Lot 3 a distance of 49.93 feet to the norhteast corner of said Lot 3 thence North 6 degrees 43 minutes 36 seconds West a distance of 66 feet, thence North 1 degree 32 minutes 16 seconds West to a point 6 feet south of the North line of said Lot 5 thence West parallel with said North line of said Lot 5 to a point distance of 74 feet east of west line of caid Lot 5, thence Southeasterly 147 feet to the point of Beginning. The East 15 feet of Lot 8, Block 3, Centerville except the North 6 feet of the East 15 feet thereof. Donald Opp, 1745 Main Street and Charles Underwood 7128 Progress Road presented the request. Discussion of variance request followed. Commission recommends the City Engineer review the property descriptions to make sure they are correct. The purpose of the hearing was to hear all persons present regarding the request of Gene Wegleitner, 6808 117th Avenue to rezone the following described lands: That part of the West 714 feet of the South 250 feet of the Northwest 1/4 of the Northeast 1/4 laying easterly of the east line of James Commercial Addition; excluding road; subject to easement of. The east 150 feet of the West 924 feet of the South 250 feet of the Northwest 1/4 of the Northeast 1/4; excluding road; subject to easement of REC. Members of the audience asked questions of the rezoning: David West, 1824 Main Street Donal Opp, 1745 Main Street Commission member Buesseler did does not feel comfortable with the rezoning of this property at this time. He expressed concern regarding the limited City quality control in Ordinances 08 and 04 regarding design or layout of a business that may want to operate in Centerville. The current standards are to broad. He would prefer to wait until a proposal is made and fit the business and the rezoning in at that time. He was - noted that Centerville does not have a direct plan regarding zoning. Chairman Tourville noted that he can see the section of Main Street east of Centerville Road having the potential to become similar to West Broadway in Forest Lake, gradually changing from residential use to commercial use. He feels that the majority of the monies to be made by a business are on that section of Main Street. He is concerned about the need for buffers between commercial and residential properties and feels this should be addressed in the ordinances. He also feels that is important to the City to be able to have some control over the type(s) of business that come into Centerville. He has no concern to rezoning this property if the above concerns are addressed. Hearing adjourned 8:12 p.m. Pursuant to due call and notice thereof, the Planning and Zoning Commission of Centerville held their regular meeting on April 7, 1987 at City Hall. Chairman Tourville called the meeting to order at 8:13 p.m. Present: Buesseler, Welk, Lindgren, Council liaison Neumann. Absent: Vermeulen. Motion by Buesseler, second by Lindgren to accept the minutes of the June 2, 1987 meeting, motion carried uanimously. P &Z Meeting Minutes Page Three July 7, 1987 OLD BUSINESS Discussion of the request of Keith Kruger, 6719 Centerville Road to operate an auto repair shop at that location which is currently zoned rural residential. Mr. Kruger has not applied for his building permit to erect the building. Floyd Kruger, father of Keith Kruger, spoke to say that as none of the neighbors object to the proposed operation, he could not see why the Commission could not conform Ordinance #4 to suit Keith Kruger. The Commission agreed that they did not want to rezone that property at this time and they were hesitant to add to the list for Allowed Special Uses. It was suggested that the Commission look further into changing the home occupation portion of Ordinance #4. Motion by Buesseler, second by Kathy to table the request of Keith Kruger for an auto repair shop at 6719 Centerville Road, pending receipt of information from the League of Minnesota Cities of other city ordinances regarding home occupations, motion carried uananimously. Discussion of the L'Allier land swap to add Tract A: The North 16.5 feet of the East 159.00 feet of Lot 5, Block 2, L'Allier Estates, Anoka County, Minnesota; to Lot 4, Block 2 L'Allier Estates. To add: That part of Lot 9, Auditor's Subdivision number 47 (revised), laying Southerly of L'Allier Estates and laying Easterly of Southerly section of West line of L'Allier Estates, except the East 191.31 feet thereof subject to easement of REC; to Lot 5, Block 2 L'Allier Estates. The purpose of the swap was to correct setback violation for a garage that was built from a Centerville building permit and erected on the lot line. Motion by Buesseler, second by Welk to grant Ralph L'Allier, representative of L'Allier Estates, a variance to Ordinance #8, section 21.05 for the land swap of the above discussed properties, motion carried uananimously. Justification for this variance: 1. does not interfere with the purpose of the subdivision regulations in Ordinance #8, 2. lot size and set back requirements are met, 3. the variance would correct an existing problem (garage on lot line), 4. variance results in a more reasonable use of the land P &Z Meeting Minutes Page Four July 7, 1987 (the most southerly 16.5 foot parcel in question could be used by itself). NEW BUSINESS Motion by Buesseler, second by Lindgren to grant Donald Opp, 1554 Holly Drive, RR 1, Hugo a variance to Ordinance #8, section 21.05 for the changing of lot lines as described in the above public hearing, motion carried uanimously. Justification for this variance: 1. does not interfere with the purpose of the subdivision regulations in Ordinance #8, 2. lot size and set back requirements are met, 3. the variance would correct and existing problem (the nonconformity of shape of existing property lines as compared to other City lots), 4. variance results in more reasonable use of land, 5. does not leave any land locked parcels, Commission also recommends that the City Engineer review the property descriptions to make sure that they are correct before the City Council grants the variance. Discussion of the Gene Wegleitner request to rezone the above properties addressed in the above public hearing. Motion by Welk, second by Buesseler to table the rezoning request of Gene Wegleitner contingent on the City Clerk researching as to whether it is possible for the City Council to approve the rezoning of the property from residential to commercial contingent on restrictions for property use, motion carried unanimously. Clerk will also check with the attorney to see if the City Council can move on the final plat of the Wegleitner Addition if the property is not rezoned commercial at this time. Jim Lagoon of Merrill Lynch Realty and Pete Johnston, P.O. Box Forest Lake appeared before the Commission to get their feelings on a variance request to Ordinance #4 to possibly build a garage within the setbacks of 1585 Peltier Lake Drive. They feel that it is a hardship to try to sell a home with a one stall garage. Commission could not state a reason why this request is unique to this property, and expressed concern over the use of retaining walls, and possible drainage or erosion problems. Discussion of possibly changing Ordinance #8 with regard to small land swaps and minor straightening of property lot lines. Motion by Lindgren, second by Welk to table the changing P &Z Meeting Minutes Page Five July 7, 1987 Ordinance #8, pending the City Clerk receiving advise from the City Attorney as to whether a public hearing would be required to change the Ordinance with regard to land swaps and property line straightening under section 21.05, motion carried unanimously. All Commission members will make a notation to come to the August 4, 1987 P &Z meeting with prepared amendment wording for Ordinance #8. Chairman Tourville advised the Commission that high priority will be given to amend Ordinance #4 in the coming months. Motion by Welk, second by Lindgren to table the issue of nursery plants being stored at 6923 Tourville Circle until September, as Mike Massie has stated the plants will be gone in the fall, motion carried unanimously. Chairman Tourville advised the Commission members that the first City Council 1988 budget meeting will be held July 28, 1987. All members are requested to come to the August 4, 1987 meeting with dollar amounts to be used in consideration of the 1988 Planning and Zoning Commission budget.
