HomeMy WebLinkAbout1987-06-02 Minutes Pursuant to due call and notice thereof, the Planning and Zoning Commission of Centerville held a public hearing Tuesday, June 2, 1987 at City Hall. Chairman Tourville called the hearing to order at 7:10 p.m. Present:. Buesseler, Welk, Lindgren, Council liaison Laska. Vermeulen arrived at 7:20 p.m. The purpose was to hear all persons present regarding a request for a special use permit to do auto repair consisting of frame repair, suspension repair, general auto repair and welding; and to request a variance to erect a building for use for the auto repair to an average height from the top of the sidewall to a peak of 15 1/2 feet which does not comply with Ordinance 04, by Keith Kruger, 6719 Centerville Road. Mr. Kruger advised that the operation would be low key evening and weekend, no employees, as noise free as possible, clean and neat, no auto body work which requires chemicals, will always be enclosed in the proposed 40' X 60' building. The building would be 150 feet from the road, 60 feet from the house, 40 feet from any neighboring property, and that the lot is 219 feet wide. Members of the audience expressed favorable opinions to the operation and the building: Bob Koran, 6759 Centerville Road Tom Wilharber, 6849 Centerville Road Floyd Laska, 1393 Mound Trail Also present was Floyd Kruger, father of Keith Kruger and former owner of the above property. Poll of Commission members: Lindgren - Feels the special use permit and variance would be OK as there will be no pollution, only torch work. Vermeulen - Has no problem with the special use permit or the variance request. Buesseler - Ordinance #4, Section #34.06 implicitly refers to residential, the zone in question is rural residential. The proposed building is consistant with other buildings in that area. The special use permit should be for annual renewal. The auto body work is to not include body work. Welk - Has no problem with the requests. She has lived near the old business and did not experience any problems. Conditions are put on many special use permits, so would not be singling Mr. Kruger out by doing so on his permit. Tourville - No complaints from former neighbors. Only problem is interpreting Ordinance #4 regarding home occupation to a special use permit. The operation would not be in a home it is in a building to be erected, and may be a secondary use of the property. He has no objection to the building and the use of it, but does have an PAZ Meeting Minutes Page Two June 2, 1987 objection to the interpretation of the Ordinance. Unless specifically written in the Ordinance, he feels that the City can not issue the permit. Hearing adjourned 7:30 p.m. Motion by Buesseler, second by Lindgren to accept the minutes of the May 27, 1987 meeting, motion carried unanimously. Ralph L'Allier or a representative from Merrill Lynch Realty was scheduled to appear to request a special hearing for the L'Allier land swap. No one was present. No action taken. John Johnson and Dick Wedell appeared to represent the Centerville Heights development project. Terry Mauer, City Engineer presented the feasibility study for Centerville Heights. It was noted that a final response on the Comprehensive Sewer Plan Amendment is expected by June 25, 1987. Mr. Johnson advised that they do not anticipate having to import fill material, but will use the good material on site and move it around. He also noted that if the MUSA line change is not approved by Metropolitan Council the project would still go ahead, but would have to amend the final plat. Discussion of municipal water. City Engineer advises that the water system as proposed would offer limited flow for fire protection. If the City were to pursue municipal water it should be aware that this would increase City maintenance; flushing valves, checking hydrants, etc. The proposed municipal water building would be about 15' X 20'. Per City Engineer, the worst thing the City could do would be to start a municipal water system and not to expand. Cost per user would decrease with the expansion of users. It was noted that in case of a power shortage there is no back up at present, however once the City had a storage system (such as an overhead tower) this would not be a problem, as it would fill at night for use during the day and would allow ample fire protection storage. Mr. Johnson noted that St. Paul may be interested in selling their water system in Centerville. Chairman Tourville noted that Glenn Taylor of Anderson Party Supplies is in the process of looking for property. They presently have 4 -5 facilities and want this all under one roof with room for expansion. However, they do want water due to their overhead sprinkler system. He feels that if we could tie this into the Centerville Heights municipal water system, it would benefit the community. P &Z Meeting Minutes Page Three June 2, 1987 Discussion of drainage of Centerville Heights. Mr. Johnson will ask the Rice Creek Watershed if it would be feasible to drain the water west versus south. If so, he feels that he may be able to lower some of the ponds and get some full basements. He stated that the water in the ponds will be below the water table and that they have to meet FHA criteria. If the water were to get above the water table the pipes in the pond would pump the excess water out. He does not feel that the ponds will make the water problem any greater for existing homes and that ponding controls the water table more efficiently. Members of the audience asked questions of the development: Maureen Asleson, 7232 Mill Road Brad Gulsvig, 7246 Mill Road Motion by Buesseler, second by Welk to recommend that the City Council request that Maier, Stewart, and Associates, Inc. prepare a feasibility study for city municipal water for the City of Centerville; as the Commission feels that if there is a need for municipal water, it needs to be done now if at any time, motion carried unanimously. Motion by Buesseler, second by Lindgren to recommend approval of the rezoning of the proposed Centerville Heights property from an R -2 to and R -2A and the preliminary plat of Centerville Heights as presented pending: - potential changes to the MUSA boundary by the Metropolitan in the northeast corner, - modification of water storage areas to a medium, - final recommendation of park dedication from P &R, - feasibility study by Maier, Stewart and Associates, Inc. for municipal water system for the City of Centerville, -time completion of the the feasibility study and decision by the City Council by the July 8, 1987 City Council meeting, motion carried unanimously. Motion by Buesseler, second by Lindgren to recommend to P &R that they consider setting aside some land in the upper southeast section of the 10 acred non sewered section of Centerville Heights; and that P &R try to work this park area into the ponding area off Royal Meadows; with the two areas together it may be large enough for fish and wildlife, motion carried unanimously. Appearance of Gene Wegleitner to discuss Wegleitner Addition plat. Per City Engineer drainage is tied to the Centerville Heights development and Mr. Wegleitner may want to go along with the development when approaching Rice Creek Watershed to save time and money. He may want to replat the addition to get rid of some of the easements, ditches and ponding on the present plat. P &Z Meeting Minutes Page Four June 2, 1987 Clerk will check with City Attorney to determine whether a public hearing is required for a variance to the replat requirement if the City Council chose to do this. Motion by Buesseler, second by Welk to table the storing of nursery plants by Mike Massie at 6923 Tourville Circle, as he is not present, motion carried unanimously. Motion by Tourville, second by Lindgren to grant a special use permit to Keith Kruger at 8719 Centerville Road for auto repair with the conditions: 1. That the permit is reviewed yearly by the city for compliance to stated conditions, 2. That the auto repair will consist of frame repair, suspension repair, general auto repair and welding; NOT to include body work, 3. That the special use permit terminates on sale of the property or if Keith Kruger were to move from the premises, motion carried unanimously. Reasoning for granting the permit is that it does not disturb the neighborhood, does not create additional traffic, and does not create additional public expense, as required in Ordinance #4, Section #64.02. Motion by Buesseler, second by Vermuelen to grant a variance to Ordinance #4, Section #34.06 to allow Keith Kruger of 6719 Centerville Road to erect a building for use for the auto repair operation to an average height from top of sidewall to peak of 15 1/2 feet: -it is consistant with heights in the rural residential area and neighborhood buildings, no neighbors complained about the height and will not affect the appearance of the neighborhood, -the land is rural residential and not sewered, -the parcel of land on which the building will be erected is a large piece of land, motion carried uanimously. Motion by Buesseler, second by Vermeulen to recommend that the question of enforcement of ordinances and the determination of what is the goal of the City and what does it have to do to attain that goal be on the agenda for the CC, P &R, and P &Z special meeting the end of the month, motion carried uanimously. Motion by Tourville, second by Welk to recommend to the City Council that Peter Buesseler, Planning and Zoning Commission member be the facilitator of the CC, P &R, and P &Z special meeting at the end of the month, motion carried unanimously. P &Z Meeting Minutes Page Five June 2, 1987 The majority of the Commission members can be present at the above mentioned meeting between June 17 and June 30. The Commission addressed a letter of complaint from Larry Brokke of 6795 20th Avenue South, Lino Lakes regarding L &G Rehbein at 6805 20th Avenue, Centerville. The Commission feels that the majority of the concerns can be dealt with under the nuisance ordinance, but that a buffers could be a consideration. P &Z refers the letter to the City Council for action. Motion by Welk, second by Vermuelen to adjourn the meeting, motion carried unanimously.
