Centerville held a public hearing Tuesday, May 5, 1987 at 7:10 P.M. Present:
Welk, Buesseler, Vermeulen, Lindgren, Chairman Tourville, Council liaison
Robischon.
The purpose was to hear all persons regarding the possibility of amending
Ordinance #8 to incorporate an R -2A zoning district with regard to corner
lots.
Questions were asked by Cindy Meyer, 7223 dill Road to help her better under-
stand the proposed amendments.
Hearing adjourned 7:15 P.M.
Pursuant to due call and notice thereof, the Planning and Zoning Commission
held a public hearing, Tuesday, May 5, 1987 at 7:20 P.M. Present: Welk,
Buesseler, Vermeulen, Lindgren, Chairman Tourville, Council liaison Robischon.
The purpose was to hear all persons present regarding the rezoning from R -2
to R -2A for the area described as: Lot 11, Auditor's Subdivision number 47,
Fection 14, To.nship 31, Range 22, and part of Lot 1, Auditor's Subdivision
number 48, Section 23, Township 31, Range 22, Anoka County.
Members of the audience expressed opposition to the rezoning:
John Probst, 7176 'Mill Road
Leo Hensel, 7136 Main Street
Cindy Meyer, 7223 Mill Road.
The preliminary plat of L'Allier Estates II was discussed as it directly pertains
to the rezoning. Gerry Parent, Parent Construction, noted that the majority of
the lots on the proposed plat have 22,000 to 15,000 square feet, only 7 lots on
the plat are under 15,000 square feet. The ,iidth of the lots is the only major
change.
Commission mem.uers questioned the feasibility of this project as the Metropolitan
Council has not yet responded to the proposed Comprehensive Sewer Plan Amer.d-
ment. Terry Mauer, City Engineer, advisee that the City of Centerville has the
serer capacity and the proposed L'Allier Estates II is '::lt'hin the MUSA boundary.
This plat would use up the remainder of the current sever capacity. The City
may be able to get a te4orary permit from the Metropolitan Council to put in
the sewer until formal approval of the Comprehensive Sewer Plan is received.
Terry Mauer, City Engineer, presented the Feasibility Study for Sanitary Sewer
Municipal Water, Storm Drainage and Street Construction of L'Allier Estates
Plat 2, dated April 1987. The feasibility study is on file with the City
Clerk.
The feasibility study states that there are 41'lots on the plat, this is in error,
as 34 lots are platted.
City Engineer advised that the study includes a general observation on soils and
is not saying that each lot is buildable. The Rice Creek Watershed will issue
the grading permit as the plat is near Clear Water Creek. City Engineers are
currently working on submittal to Rice Creek Watershed.
lo results have been obtained on the feasibility of a well for muncipal water
for Centerville Heights project and that water being incorporated into L'Allier

Estates II. If feasible the municipal water could possibly be tied into six
existing homes on Mill Road. The water would be served by a six inch main.
This is suitable to provide fire protection and a future City water tower if
needed.
L'Allier Estates II preliminary plat shows 60 foot culdesac radius, City
Ordinance requires a 75 foot radius. Parent Construction requests a variance.
City Engineer does not see a problem with a 60 foot radius from an engineering
standpoint.
City Engineer noted that the soils information in the feasibility study was
taken from a very generalized reap and that he encourages the developer to make
sail borings on individual lots. He feels the developer could make'lot corrections
where necessary by taking out poor soils and bringing in better soil. The
building inspector will have the final determination of the buildability of
individual lots. The Rice Creek Watershed will determine elevation developer
will have to build above. The City Engineers will also be involved all through
the project, so would have some input into the buildability of lots.
1r. Parent pointed out that the building site is his primary concern. May have to
excavate and refill some areas, but feels soils are good or wouldn't be putting
his money in on the project. He feels that the soils map is 35 years old and
inaccurate.
Norman Livgard, for Parent Construction advised that the majority of the water
would drain to the west away from 'Sill Road. Any other water drainage would
go to the street, flow to Mill Road and go back west into Clear Water Creek.
Mr. Parent advised that the homes in the L'Allier Estates II project would
be between $100,000 and $120,000 in value. Re also noted that he did not
want to disturb the trees on the banks of Clear Water Creek, as he feels
they help prevent erosion.
Commission members expressed concern as to whether a lb foot drainage ease-
ment would be enough for that area and as to what type of City maintenance
would be needed for ponuu g areas.
Hr. Livgard told Commission members that holding ponds must be above 891.4 foot
elevation to meet the Rice Creek Watershed 100 yearflood plain requirements.
The majority of water will drain into Clear Water Creek ana any remaining water
in the holding ponds will evaporate within a 24 hour period. He feels the
15 foot drainage easement is large enough to serve potential excess water.
Ne feels that the holding ponds would be on private property, citizens will tend
to mow and take care of their OA property, and that the pond will pretty much
take care of its self requiring little if any maintenance for the City.
Terry Mauer, City Engineer, does not see this as , big problem, the plat is
relatively small and there should be minimum waterflow. It should be 15 -20
years before the City would have to worry about cleaning out of any accumulated
sediment. He feels 15 feet is an adequate width for a drainage easement.

The purpose was to hear all persons regarding the preliminary plat of L'Allier
Estates II for the area described as: Lot 11, .Auditor's Subdivision number 47,
Section 14, Township 31, Range 22,and part of Lot 1, Auditor's Subdivision
number 48, Section 23, Township 31, Range 22, Anoka County.
Northern States Power will put in street lights per the City's approval of monthly
electricity charges. All utilities for L'Allier Estates II will be underground.
Park and Recreation Committee park dedication for L'Allier Estate II was discussed.
That recommendation is attached to and made part of these minutes. Commission
members felt there was some merit to connecting trails within Centerville,
but are not sure how it should be set up. Potential problems could be City
maintenance of the trail. Also the trail as recommended by P u would have to
be worked out with th Rice Creek Watershed District, as the City of Centerville
,could also need grading permits.

Pursuant to due call and notice thereof, the Planning and Zoning Commission of
Centerville held their regular meeting on May 5, 1987 at City Hall. Chairman
Tourville called the meeting to order at 9:11 P.M. Present: Buesseler, Welk.
Vermeulen, Lindgren, Council liaison Robischon.
Motion by Buesseler, second by Welk to accept the minutes of the April 6, 1987
and April 7, 1987 meetings, motion carried unanimously.
Commission member Welk requested that the City Clerk put a copy of the monthly
Receipts and Disbursements in each P &Z member packet. Clerk will do so.
APPEARANCES
Appearance of Donald Opp, 1745 Main Street to get advise on splitting of lot
lines and to request a public hearing if necessary. 'lap of proposed splits
is attached to and made part of these minutes. Commission member Buesseler
requests the City Clerk recheck with the City Attorney and Building Inspector
to clarify where it is stated that P &Z has to have a public hearing on splitting
up and straightening out lot lines, and what are the approval requirements.
Clerk will do so.
Motion by Buesseler, second by Welk to hold a public hearing July 7, 1987 at
7:00 P.M. regarding lot splits and straightening of lot lines by Donald Opp,
1745 Main Street, motion carried unanimously.
Appearance of Keith Kruger to get P &Z advise on height restriction of a proposed
garage type building, the possibility of a Special Use Permit to allow him to
operate a small business in that proposed building at 6719 Centerville Road,
and to request a public hearing if necessary. He assures the Commission that the
business will be part time, low key, weekends and evenings. The business will
be frame and suspension repair, and welding. The garage would be 40' X 60', and

be 17 feet tall.
Commission member Buesseler is concerned that this may be a rezoning versus a
special use permit issue.
All Commission members agree that a public hearing is required for both the
variance request and the special use permit.

7:00 P.n. to hear the variance and special use permit requests of Keith Kruger,
6719 Centerville Road, motion carried unanimously.

Discussion of park dedication recommendation of P:R. Gerry Parent feels the
proposes) trailway Mould bo to much trouble for the City. He does not want to
take away from the privacy of the home owners. He would go along with the
:roposal if necessary, but is against a walkway between two properties as is
proposed between lots 12 and 13. He .could Le more in favor of a trailway all
the ,way down Clear Water Creek to ; Street. A walkway between lots 12 and
13 would make those lots substandard.
''orman Livgard, suggested an easement versus actual land dedication. If the
trail,vay were dedicated the City would own the property and would have to
maintain it until the trail were developed.
Poll of Commission members feelings on the P£.": park dedication reco- •a,iendation:
- Commission member Lindgren is in favor of the payment of park dedication
fee versus land dedication.
- Commission member Vermeulen agrees with Lindgren. She feels that P&R
did come up with a good idea, but there would be to many potential
problems with a trail.
- Commission member Buesseler feels there are problems in the proposal,
but that it is consistent_with the Comprehensive Plan. It is an
appropriate objective for the City to follow and a stated objective
for the Conservation District. The houses will be on an upper elevation,
the proposed trail is at a lower elevation. He feels this is a good
opportunity for a recreational corridor with minimal impact. If the
trail is not approved it will eliminate the possiblity of a linear
corridor in Centerville forever. He feels the future of the park
system is at stake.
- Commission member Welk agrees this is a unique setting, but is not in
agreement with the proposal that PER has presented. She feels it is not
fair that the information for something of this importance be presented
the night of the P &Z meeting in which the issue is to be decided.
- Chairman Tourville feels there is merit to the proposal, but that the

park dedication fee is a better option at this time.
Motion by Buesseler to pass Planning Commission member concerns on to the
Park and Recreation Committee:
- possibility of an easement versus land dedication,
- concern of an easement /walkway between lots 12 and 13,
- general concern of the way the trail design fits along Clear Water
Creek;
and suggest that the Park and Recreation Committee discuss and modify their
recommendation, from which the Planning and Zoning Commission will hear on
May 26, 1987, and then make their recommendation to the City Council at the
May 27, 1987 City Council meeting; to table L'Allier Estates II preliminary
plat and rezoning recommendation pending further discussion of the Park and
Recreation Committee, no second.
Motion by Welk, second by Lindgren to recommend the City Council accept the
L'Allier Estates II preliminary plat conditioned on;
- an easement for park dedication purposes is provided, the width
and extent to be determined by Planning and Zoning Commission,
Park and Recreation Committee, and the L'A1lier Estates II
developer, along with the Conservation District,
-soil tests are conducted by the developer, results available
at the May 13, 1987 City Council meeting,
- street lights are installed, per Ordinance #8,
-grass on vacant lots is established to the point that it can be
mowed;
and that the Council grant a variance to allow 60 foot culdesacs versus the
required 75 foot culdesac, motion carried uanirnously.

dedication.... ", motion carried unanimously.

NEW BUSIMESS
John Johnson and Jim Wedell representing the Centerville Heights project presented
a sketch plan of Centerville Heights and request a public hearing to hear the
preliminary plat. Harstad Companies will share information with Centerville City
Engineers to help put a feasibility study together.
Mr. Wedell questions the need of a feasibiity study. He suggests a review of the
information already accumulated and that a feasibility study cover those .subjects
not in the review.
Wedell would like to know if Centerville is looking at a potential municipal
rater system for the whole City, just L'Allier Estates II and Centerville Heights,
or just Centerville Heights.
City Engineers would like to study the issue further and get back to the City
of Centerville by the May 26, 1987 P &Z meeting.

Motion by Buesseler, second by Uelk to schedule a public hearing and special
meeting ;lay 26, 1987 to hear Centerville Heights development project, motion
carried unanimously.
City Clerk advised that Gene Wegleitner, of Wegleitner's Addition claims his land
along Mill Road, east of James Refrigeration and west of the Shad Avenue homes
should be zoned commercial per approval of his final plat in January of 1982.
All City Hall records indicate that land is zoned residential. The land was
zoned residential in the 1980 Comprehensive Plan, Clerk and City Engineer can
find no zoning changes to that platted area from 1980 to date. P &Z. recommends
Clerk bring this before the City Council for direction.
Notion by Tourville, second by 'Welk to adjourn the netting, motion carried
