HomeMy WebLinkAbout1987-04-07 Minutes r Pursuant to due call and notice thereof, the Planning and Zoning Commission of Centerville held a public hearing Tuesday, April 7, 1987 at City Hall. Chairman Tourville called the hearing to order at 7:05 P.M. Present: Buesseler, Vermeulen, Welk, Council Liaison Fritchie. Lindgren arrived at 7:25 P.M. The purpose was to hear all persons present regarding a request for variance to replace an existing garage with a new structure of the same width, 10 feet longer, 8 feet from the East property line at 7124 Main Street, also known as Lots 7 -10 inclusive, Block 9, City of Centerville. Bill LaLonde, 1687 Westview Street could not be present at this hearing, but per his telephone conversation with the City Clerk, he requests the Planning and Zoning Commission grant the variance if the garage fits cosmetically with the surrounding residential area. He feels it would be a plus for the city if the old garage were torn down. The Commission members agreed that the use was conforming, a new garage would be an asset to the community, according to current ordinance the structure is non conforming and is not within the current setbacks. Motion by Buesseler, second by Welk to recomuuend that the City Council grant a variance to replace an existing garage with a new structure of the same width, 10 feet longer, 8 feet from the East property line at 7124 ?lain Street, motion carried unanimously. Required standards for variances seem to he met for the variance: 1. Existing Special Circumstances - Due to slope problems on the lot it is unreasonable to move the structure. - 2. Literal interpretation of provisions would deprive him of rights enjoyed by others. 3. Granting this request will not confer special privileges. 4. This variance will not impair the property values, public health, safety or welfare of the residents of the City. Does not change character of the neighborhood and does improve the condition of the structure as it is now. Hearing adjourned 7:30 P.M. Pursuant to due call and notice thereof, the Planning and Zoning Commission of Centerville held a public hearing Tuesday, April 7, 1987 at City Hall. Chairman Tourville called the hearing to order at 7:31 P.M. Present: Buesseler, Vermeulen, Welk, Lindgren, Council Liaison Fritchie. The purpose was to hear all persons present regarding the preliminary plat of Center Oaks II described as follows: The South Half of the North Half of the Southeast Quarter, Section 23, Township 31, Range 22, Anoka County, Minnesota except that part platted as CENTER OAKS I. Also excepting the Westerly 470 feet of the Northern 380 feet and the West 470 feet of the Southerly 225 feet. Subject to that part taken for County Road No. 54. Containing 26.13 acres, more or less. Kent Roessler of Kenco Construction presented the Center Oaks II pre- liminary plat, a copy is on file with the City Clerk. r Page Two - Planning and Zoning Commission Meeting Minutes April 7, 1987 Terry Mauer, City Engineer, presented the Center Oaks II feasibility study. He expressed concern that the southern designated park area chosen by the Park and Recreation Committee as park land is a ponding area that is required by the Rice Creek Watershed District. He also stated that concrete curb and gutter on the streets in the development would be the preferred method, but this was a policy decision that would have to be made by the Planning and Zoning Commission and the City Council. The estimated cost of the project is $275,000. Council member Buesseler expressed concern over the poor soil conditions and questioned whether all of the severe soils were on the park land and if not the feasibility of building homes on lots with severe soils. He inquired as to whether the builder could go out to the land and specifically determine where severe soils are to determine if the lots in question are buildable in the design stage of the project. Mr. Roessler advised that his soil person was out to investigate the land prior to purchasing or platting. He feels that all of the lots are buildable with slight corrections. The corrections to the lots would be determined on an individual basis by the building inspector. Mr. Roessler's construction will all be FHA approved, soil borings will be done to their specifications, and he pointed out that FHA is usually very strict. He also points out that currently in the State of Minnesota, builders must stay with the structure for 10 years. Mr. Roessler stated that it would not be monetarily feasible to determine the buildable lots in the design stage of the project. Mr. Mauer, City Engineer, concurs that the best insurance in this matter would be the FHA financing, and he confirms the strictness of FHA regulations. Carol Pelton, Park and Recreation Chairperson was present and requested that the Park and Pecreation Committee take their park dedication recom- mendation for Center Oaks II back under advisement, as all committee members were not present to discuss the City Engineer's concern about the park land chosen being a holding pond. Chairman Tourville expressed his opinion that the park land chosen by the Park and Recreation Committee in the Center Oaks II development is to low and is not a feasible piece of property for a park. He also noted that it is not feasible to have parks in all developments. City Engineer noted that if the area to the north of the Center Oaks II project were to be rezoned to single family residential in the future, the sewer system would be able to handle that area. City Engineer also noted that Center Oaks I and 13 lots in Center Oaks II are /will be served by gravity. Approximately 30 lots in Center Oaks II will be served by a lift station. Drainage problems were addressed. City engineer advised that all drainage for Center Oaks II will flow to the east and would not aggravate the possible Lino Lakes- Centerville water problem. L Page Three - Planning and Zoning Commission Meeting Minutes April 7, 1987 Discussion of a through street connecting Center Oaks I and Center Oaks II. Commission members were in favor of a through street. Commission member Welk felt that the area was to large to have a dead end street. Chairman Tourville noted that there are some citizens that would prefer a culdesac. Discussion of concrete curb and gutter in the development. Commission members were in favor of concrete curb and gutter. Commission member Buesseler did express mixed feelings regarding this matter. He felt concrete curb and gutter would be consistent with current requirements, and that a precident would be broken if it was not used in Center Oaks II. However, he noted that concrete curb and gutter does not exist in Center Oaks I. Mayor L'Allier was present and advised that the City can look at concrete curb and gutter for Center Oaks I if and when the current Center Street is reconstructed. Council Liaison Fritchie encouraged the blocking off of the current Center Street to force all development to come off 54th Street for Center Oaks II. 'r. Roessler concurs. The Commission advised that they have c'iccussed a physical barrier for this purpose and that this could be addressed in the contractors agreement. Chairman Tourville inquired about the possibility of developers using the City Engineers as their engineering firm, or using two firms, one being the City Engineer. Mr. Mauer, City Engineer, advised that he is not against this, that the City Engineers would do what is best for the City not the developer, and that the City should look at this policy. 'ir. Roessler advised that may cost the developer a bit more, but usually results in a snootier transaction. City Engineer did not feel that temporary culdesacs or T ends were needed on the ends of Mill Road in Center Oaks II, as it would he only .150 -200 feet to the ends and if needed vehicles such as snowplows could hack up that short of a distance. Discussion of whether garages will be required with each home built. Sir. Roessler asked that he be given the flexibility to offer the home to a buyer without a garage. He advised that many times it comes down to purchasing a home without a garage or no house at all, due to affordability. He also advised that many of the homeowners build a more custom garage later, as per his experience with Center Oaks I. The Commission members agreed that the majority, if not all of the homes in that development would probably have garages within 5 years. Hearing adjourned 9:00 P.M. Pursuant to due call and notice thereof, the Planning and Zoning Commission of Centerville held their regular meeting on April 7, 1987 at City Hall. Chairman Tourville called the meeting to order at 9:01 P.M. Present: Buesseler, Vermeuien, Welk, Lindgren, Council Liaison Fritchie. Motion by Buesseler, second by Lindgren to accept the minutes of the March 3, 1987 meeting, motion carried unanimously. r Page Four - Planning and Zoning Commission Meeting Minutes April 7, 1987 Appearances: Kevin Mullins, Lino Lakes, appeared before the Commission to request the furthest west section of Sorel Street be improved and brought up to City specifications. The section in question is currently an unimproved dedicated street which is part of a church /municipal parking lot. The normal sequence of events would be to ask the City Engineer to draw up plans and specifications, advertise for bids and then 100% assessment to the benefiting property owners. The benefiting property owners appear to be Kevin Mullins, 7000 West Shadow Lake Drive, Lino Lakes; St. Genevieve Church, 7087 Goiffon Street; and Ethel Woestehoff, 7067 Goiffon Street, which is a corner lot. The Commission agreed that it would be legal to assess the Woestehoff property of the construction of the Sorel Street extension, but may be difficult politically as he has not asked for it and does not appear to be in current need of this extension. It was mentioned that St. Genevieve Church may want to 'work with the Sorel Street extension project to redesign their parking area. Clerk will contact them to determine their position on this. The only other alternative would he that one property owner pays all of the costs of the extension. The most logical being Mr. Mullins as he is requesting the improvement. If the parties to be assessed agree to the assessment, a public hearing could be waived regarding the Sorel Street extension. Mr. Mullins inquired as to what type of road is required and if a gravel road would be acceptable. Chairman Tourville advised that a gravel road would present erotion problems and that as it is the City's responsibility to maintain and plow the street, it is almost necessary for a hard surface. Terry Mauer, City Engineer advised that Centerville would want something that would hold up, he would have to look into this further, but at this time recommends a 7 ton road. Buesseler expressed concern over the loss of the municipal parking lot. Commission members agreed that a new municipal parking area must be found. OLD BUSINESS Motion by Buesseler, second by Welk to recommend the City Council accept the Center Oaks II preliminary plat, with the exception of the park dedication which will be rediscussed at the next Park and Recreation meeting, motion carried unanimously. NEW BUSINESS Parn Henderson and Terry Mauer, city engineers presented the Compre- hensive Sever Plan Amendment. Centerville is currently exceeding their sewer flow and growth projections. r Page Five - Planning and Zoning Commission Meeting Minutes April 7, 1987 Commission members agreed that the Urban Service Boundary be extended to surround the most northeastern section of Industrial zoned land within the Centerville City limits, to be included as Proposed Urban Service Boundary. City engineers will do so. Buesseler expressed concern that Urban Service Boundary on the Land Use Map currently used in the Centerville City Hall and the Land Use Map being presented with the Comprehensive Sewer Plan Amendment do not coincide. The discrepancy seems to he with the Prcposed Single Fancily Residential /Conservation - Wetland Creek section off the most northeastern corner of Centerville Lake. City engineers will investigate the discrepancy. Motion by Chairman Tourville, second by Lindgren that the Planning and Zoning Commission accept the Comprehensive Sewer Plan Amendment presented by Maier Stewart and Associates and recommend it be given to the City Council for approval, motion carried unanimously. Motion by Velk, second by Buesseler to recommend that the City Council have William Hawkins, city attorney, draft a letter /form to have Planned Unit Developers currently pursuing R -2A zoning sign, releasi:ig the City of Centerville from any liability, as the R -2A zoning is pending and amendment of Ordinance #8, motion carried unanimously. Clerk advised Commission members that four public hearings have been requested for May 5, 1987 and that it is not possible to complete the preliminary preparations for all four hearings prior to the May 5, 1987 scheduled meeting. Commission members agreed to have three public hearings May 5, 1987: possible amendment of Ordinance #8, Gerry Parent " -2A rezoning request for L'Allier Estates II, and Gerry Parent preliminary plat L'Allier Estates II. Don Opp regarding straightening of lot lines will be rescheduled for a June 2, 1987 public hearing. Motion by Welk, second by Lingren to adjourn the meeting. Meeting adjourned at 10:45 P.M.
