HomeMy WebLinkAbout1987-03-03 Minutes r Pursuant to due call and notice - thereof, the Planning and Zoning Commission of Centerville held a public hearing Tuesday, March 3, 1987 at City Hall. Chairman Tourville called the hearing to order at 7:05 P.M. Present: Buesseler, Welk. Absent: Lindgren. Council Liaison Laska arrived at 7:15 P.M. The purpose was to hear all persons present regarding a request for variance to split lot 11, block 2 thereby creating two 75' X 150' lots described as lot 10 and North 1/2. of lot 11, block 2; and lot 12 the South 1/2 of lot 11, block 2. Paul and Margaret Anderson currently own lots 10 and 11. Marcel Rivard owns lot 12. The intention is for the Anderson's to obtain ownership of lot 12 and South 1/2 of lot 11, block 2, on which they would ike to build a single family dwelling. Mr. Rivard will then obtain ownership of lot 10 and North 1/2 of lot 11, block 2. The main concerns expressed by commission members were: - splitting a standardsize lot (lots 10 and 11) to make a substandard size lot - setbacks would be far enough to allow good vision to insure safety on both Sorel Street and Progress Road - would this set a precident encouraging other 3 lot sections to be split similarly or was there a peculiar circumstance Clerk pointed out that there appears to be a sewer stub to serve lot 10 and an additional sewer stub located in the South 1/2 of lot 11. There appears to be no sewer stub for lot 12, thus could make this a peculiar circumstance. Motion by Welk, second by Buesseler to recommend the City Council allow the request for variance to split lot 11, block 2 thereby creating two 75' X 150' lots described as lots 10 and North 1/2 of lot 11, block 2; and lot 12 and South 1/2 of lot 11, block 2. Also, a recommendation is to be made to the City Council to allow a variance to Ordinance #4, Section 34.01 -2 requesting a 16' setback variance off Sorel Street to accommodate the 44' house width and side yard setback. Motion carried unanimously. Required standard for variances seem to be met for split: 1.) Existing Special Circumstances- There is no sewer stub to serve lot 12 as it is now. A sewer stub does exist in lot 10 and the South 1/2 of lot 11. When split lot 10 and North 1/2 of lot 11, block 2, and lot 12 and South 1/2 of lot 11, block 2, would each be served by a sewer stub. 2.) Literal Interpretation of Provisions- There are other substandard lots in Centerville. Lot 12 being a 50' X 150' corner lot and having no sewer stub, would be difficult to build a single family dwelling on complying with setback requirements. The split does not increase or decrease resident density. 3.) Special Privileges- Other variances have been granted for Page Two - Planning and Zoning Meeting Minutes March 3, 1987 unique situations. 4.) Impair Values or Welfare of Residents- Setback on a 75' X 150' lot versus a 50' X 150' lot would improve visibility to insure safety on Sorel Street and Progress Road. Hearing adjourned at 7:55 P.M. Pursuant to due call and notice thereof, the Planning and Zoning Commission of Centerville held their regular meeting on March 3, 1987 at City Hall. Chairman Tourville called the meeting to order at 7:56 P.M. Present: Buesseler, Welk, Council Liaison Laska. Absent: Lindgren. Motion by Welk, second by Buesseler to accept the minutes of the February 3, 1987 meeting, motion carried unanimously. Kent Roessler of Kenco Construction presented a plan for Center Oaks II. A copy of the proposed plan is on file with the City Clerk. Terry Maurer, city engineer, will do a feasi- bility study of the proposed plan. Concerns he will address: - sanity sewer service -what affect will be on the commercially zoned property that abuts the east end of the project; will this project make sewer more readily available for commercial use - need of a lift station - possibility of the east section of the Center Oaks II being in a flood plane -would drainage affect future developments - feasibility of culvert size - concrete curb and gutters - street design; having a culdesac ending versus extending Center Street as a through street - financial feasibility The feasibility study will be paid for by the City of Centerville. The City of Centerville will be reimbursed for the cost of the study by Kenco Construction through a $2000.00 escrow account held by the City of Centerville. The study will take approxi- mately two weeks to complete. The Planning and Zoning Commission will hold a public hearing on April 7, 1987 at 7:30 P.M. at City Hall to discuss the results of the Center Oaks II feasi- bility study. Mr. Roessler asked if he could use the land specified as Park areas for home development. He will pay the Park Dedication Fee if the land can be used in this manner. The Planning and Zoning Commission referred Mr. Roessler to the Park and Recreation Commission for review. The issue will be addressed at the March 10, 1987 Park and Recreation Commission Meeting. The Park and Recreation Commission will be asked to respond to the Planning and Zoning Commission prior to April 7, 1987. Clerk pointed out that there is a duplicate street name on the Center Oaks II plan. It was advised that this could be changed. I 1 Page Three - Planning and Zoning Meeting Minutes March 3, 1987 Tom Louckes and Dick Wedell presented proposed changes for the Harstad project. A.copy of the proposed changes is attached and made part of these minutes. Welk expressed some opposition to the Harstad project. Concern was expressed as to whether there actually was a market in the Centerville area for smaller lots. Buesseler and Tourville endorsed the Harstad project. Motion by Buesseler, second by Welk to recommend to the City Council that they proceed with the R2 -A zoning alternative proposed by Harstad. Motion carried unanimously. If the City Council is in concurrence with the recommendation of the R2 -A zoning, a public hearing will be held Monday, April 6, 1987, 7:OOP.M. at Centerville City Hall. The city engineers are to then look into changing the MUSA line to better accommodate the north east section of the Harstad pro- ject and to expanding the capacity of the sewer system. At the April 6, 1987 hearing, Ordinance #4, Subdivision #66.02 will be addressed regarding a possible amendment, referencing initiation of such rezoning. Old Business: Terry Maurer, city engineer, presented his review of Ordinance #14. His recommendation is that Ordinance #14 should be either totally rewritten of possibly eliminated. A copy of his recom- mendation and comments is attached and made part of these minutes. Motion by Welk, second by Buesseler to submit the review to Bill Hawkins, city attorney, for his opinion, then to the City Council for appropriate action. Motion carried unani- mously. Continued dicussion of Special Use Permit for Jerry Roach, 7159 Mill Road. Finanized plan from Mr. Roach was given to the Commission. The Plan is on file with the City Clerk. Clerk will consult Bill Hawkins, city attorney, on the legality of having time limits on the remodeling of the building as is stated in #8 of the Conditions for Special Use Permit presented to Mr. Roach at the January 6, 1987 Planning and Zoning meeting. Clerk will request that Mr. Roach submit building elevations as this will be needed by the City Council. This is condition #6 for the Special Use Permit. Motion by Buesselor, second by Welk to recommend the City Council approve the Special Use Permit for Jerry Roach, 7159 Mill Road: Conditions for Special Use Permit 1. Provide year round vegetation screen from the frontline of the building to the South West corner of the lot to the north, which would block direct visual access at 5 feet in the first year and growing to at least 15 feet r Page Four - Planning and Zoning Meeting Minutes March 3, 1 987 in subsequent years. As per Exhibit A - Plot Plan. Plant materials lost in the first year must be replaced. 2. Provide a black topped parking area and access drive. 3. All applicable codes and ordinances must be met. 4. Access drive, parking area and garages will be located as per Exhibit A - Plot Plan. 5. Current parking and access drives not covered under Exhibit A will be eliminated and restored with grass or other landscaping. 6. Building will be modified as per Exhibit B - Building Elevation. 7. Letter of credit of 125% will be required for satisfactory completion of construction. Will confirm with Attorney. 8. Construction must be completed within 1 year of issuance of the building permit, except that, on application, the City Council after receiving recommendations of the Planning and Zoning may extend the permit for an additional period not to exceed 6 months. 9. These conditions apply to the present proposal to convert the current 2 unit structure to a 5 unit structure, with future expansion to a 6 unit structure as per Exhibit A. Motion carried unanimously. A memo from Peter Buesseler analyzing the Special Use Permit for 7159 Mill Drive was submitted to the Planning and Zoning Commis- sion and made a part of the January 6, 1987 minutes. This memo will be referred to the City Council to substantiate why the Commis - ion recommends approval of the Special Use Permit. Discussion as to who to recommend as the new Planning and Zoning Commission member were based on the resumes •submitted by Katrina Vermeulen and Carol Pelton. Motion by Buesselor, second by Welk to recommend that the City Council approve the appointment of Katrina Vermeulen to the Planning and Zoning Commission. Motion carried unanimously. March 3, 1987 File: 260-100 Honorable Chairman and Planning Commission City of Centerville City Hall Centerville, Minnesota 55038 RE: ORDINANCE NO. 14 Dear Commission Members: As requested by the City Clerk, we have reviewed Ordinance No. 14. After review we feel Ordinance No. 14 should be either totally rewritten or possibly eliminated. Based on our review we would offer the following comments: 1. Section 2 Definitions contains several street construction terms which are not properly defined or are too specific. They could all be eliminated and replaced with a discussion of a 7 -ton design based on native soil conditions and MnDOT criteria. 2. Section 4 Petition indicates that any proposed improvements must be by petition. This implies they would be designed by the City Engineer and constructed by the City. This seems to eliminate a developer constructing their own improvements with City review and inspection. 3. Section 8, Public Hearing references proceeding with improvements under the authority of Chapter 398 Laws of 1953. This should be changed to Chapter 429 of the current statutes. 4. Section 17 Bituminous Surfacing and Section 20 Driveways have references to MNDOT bituminous mixture 2331 which should be mixture 2341. 5. There are numerous other references which need to be revised, such as Village changed to City and Minnesota Highway Department changed to Minnesota Department of Transportation. 1959 SLOAN PLACE, ST. This would seem to indicate that Ordinance No. 14 could be eliminated. We would recommend the City Attorney be consulted concerning this matter and the ordinance be eliminated if he concurs.
