HomeMy WebLinkAbout1986-06-03 Minutes Pursuant to due call and notice thereof, the Planning and Zoning Commission of Centerville held a public hearing on June 3, 1986 at City Hall. Chairman Tourville called the hearing to order at 7 :00 P.M. Present: Murray, Lindgren, Buesseler, Welk, council liaison Fritchie. The purpose was to hear all persons present regarding an amendment to Ordinance #4 allowing "contractors yard" as a permitted use under Industrial zoning, and to add the definition of contractors yard as follows: an area where vehicles, equipment and /or construction materials and supplies commonly used by building, excavation, roadway construction and similar contractors are stored or serviced. The contractors yard includes both areas of outdoor storage and areas confined within a completely enclosed building used in conjunction with a contractors business. No one in the audience was opposed to this change. Paul Behr, 6415 Joyer Lane was in favor of the change. He and two other gentlemen would like to start a business in the Industrial park that would fit into this definition. Motion by Murray, secod by Lindgren to recommend to the City Council the following amendment to Ordinance #4: "contractors yard" be listed as a permitted use in the Industrial zone, and its definition - "an area where vehicles, equipment and /or construction materials and supplies commonly used by building, excavation, roadway construction and similar contractors are stored or serviced. The contractors yard includes both areas of outdoor storage and areas con- fined within a completely enclosed building used in con- junction with a contractors business ", be listed in its definitions, motion carried unanimously. The Planning and Zoning Commission felt this use fit nicely into the Industrial Zone and helped to clarify the uses in Ordinance #4 further. Hearing adjourned at 7:14 P.M. Pursuant to due call and notice threof the Planning and Zoning Commission held thir regular meeting on June 3, 1986 at City Hall. Chairman Tourville called the meeting to order at 7 :15 P.M. Present: Murray, Lindgren, Buesseler, Welk, council liaison Fritchie. Motion by Buesseler, second by Murray to accept the minutes of the May 6, 1986 meeting, motion carried unanimously. Chairman Tourville recessed the meeting to the 7 :30 public hearing. Present: Murray, Lindgren, Buesseler, Welk, council liaison Fritchie. r Page Two - Planning and Zoning Meeting Minutes June 3, 1986 The purpose was to hear all persons present regarding a variance request to separate the west one third of lots 7, 8 & 9 in Block 2 from lots 10 & 11 in Block 2, Centerville. Members of the audience expressed their opinion on this matter: Frank Merabella, 1046 Ohio Street, West St. Paul Earl Halley, 1740 Main Street, Centerville Harvey Cartier, 7048 Progress Road, Centerville Marcel Rivard, 7072 Progress Road, Centerville Dean Sonnek, 92 Ferndale Avenue, St. Paul Motion by Buesseler, second by Welk to recommend the City Council allow the request for variance from Ordinance #4, Section 42.02 to separate the west one third of lots 7, 8, & 9 (which run north and south with frontage on Main Street) from lots 10 & 11 (which run east and west with frontage on Progress Road) creating two separate lots, motion carried unanimously. This variance request seems to meet the required standards: 1. Existing Special Conditions and Circumstances: - lots 10 & 11 run east and west and the west one third of lots 7, 8 & 9 run north and south. - the two are separated by a permanent easement along the north side of lot 10. - there are two sewer stubs - one to the west one third of lots 7, 8 & 9 and one to lots 10 & 11. 2. Literal Interpretation of Provisions: - other 50' x 150' lots exist and are built on in the City. - the unique lot configuration causes hardship to sell as one piece. 3. Special Privileges: - other variances have been granted for unique situations. 4. Impairing Values or Welfare of Residents: - the new site of lots 10 & 11 would conform to the ordinance. - the west one third of lots 7, 8 & 9 could have restrictions on home size to conform with residences to the east. Hearing adjourned at 7 :55 P.M. Pursuant to due call and notice thereof, the Planning and Zoning Commission of Centerville held a public hearing on June 3, 1986 at City Hall. The purpose was to hear all persons present regarding a request for variance from setback requirements on the west one third of lots 7, 8 & 9, Block 2 in Centerville. r Page Three - Planning and Zoning Meeting Minutes June 3, 1986 Members of the audience expressed their opinion on this matter: Earl Halley, 1740 Main Street Harvey Cartier, 7048 Progress Road Marcel Rivard, 7072 Progress Road Frank Merabella, 1046 Ohio Street, West St. Paul Robert Brunfelt, 1108 South Lake Street, Forest Lake Motion by Buesseler, secmid by Welk to recommend the City Council allow a variance to Ordinance #4, Section 34.01 -2 requesting the setback of the west property line (off Progress Road) of the west one third of lots 7, 8 & 9, Block 2 in Centerville be no closer than 16 feet to that property line, motion carried unanimously. Required standards for variances seem to be met: 1. Existing Special Circumstances - This is a 50' lot of record next to several other 50' lots with homes on them. There is a sewer stub installed on this property. This parcel is separated from adjacent property by sewer easement. 2. Literal Interpretation of Provisions - There are many 50' x 150' lots built upon in Centerville. Other property owners have been granted variances in similar circumstances. Strict interpretation would leave this site unsaleable. There is presently a home on Progress Road with about an eight foot setback. 3. Special Privileges - Others have the right to request a similar variance. In the past other property owners have received a similar variance. 4. Impair Values or Welfare of Residents - Setback would allow good vision to insure safety on both Main Street and Progress Road. A new home would enhance the value of the other homes in the area. A 16' setback from the west property line with a 10' setback from the east property line (as required by ordinance) would allow room for a 24' home on this property (minimum width required by ordinance). The purpose was to hear all persns present regarding a request for variance from setback requirements for lot 1, block 6, Centerville to allow the construction of a one or two family dwelling. r Page Four - Planning and Zoning Meeting Minutes June 3, 1986 Members of the audience expressed their opinion on this matter: Richard Kinning, 7059 Progress Road, Centerville Walter Kuchinski, 1724 Heritage Street, Centerville Mrs. Ken Salin, 1716 Heritage Street, Centerville Marcel Rivard, 7072 Progress Road, Centerville Harvey Cartier, 7048 Progress Road Motion by Murray, second by Lindgren to recommend the City Council deny the variance request for a two family dwelling due to the size of the lot, motion carried unanimously. Required stafdards for variances do not seem to be met: 1. The construction of a two family dwelling is a result of the actions of the petitioner, not special conditions or circumstances existing which are peculiar to the land. 2. Literal interpretation would not deprive the petitioner of rights enjoyed by others. 3. The would grant a special privilege denied to others. 4. Residents are concerned with safety of cars for two families in that small area. Motion by Buesseler, second by Murray to recommend the City Council allow a variance to Ordinance #4, Section 34.01 -2 requesting the setback off the south property line (off Heritage Street) be no closer than 16 feet to that property line to allow construction of a single family home, motion carried unanimously. Required standards for variances seem to be met: 1. Special circumstances and conditions exist as this is a 50' x 150' lot of record. 2. Literal interpretation would deprive the petitioner of rights enjoyed by others as the City has granted such variances in the past. 3. Granting this variance request will not confer special privileges as similar variances have been granted in the past. 4. The proposed variance will not impair property values, public health, safety or welfare of the residents of the City. Hearing adjourned at 9:20 P.M. Chairman Tourville reconvened the regular Planning and Zoning meeting at 9:21 P.M. Discussion of commission member Buesselers progress with Ordinance #4. He will get a copy of the rough draft to the Clerk for distribution to Planning and Zoning members. r Page Five - Planning and Zoning Meeting Minutes June 3, 1986 Ordinance #4 - General Provisions section will be discussed at the next meeting.
