HomeMy WebLinkAbout1986-01-07 Minutes Pursuant to due call and notice thereof, the Planning
and Zoning Commission of Centerville held their regular
meeting on January 7, 1986 at City Hall. Chairman
Tourville called the meeting to order at 7:05 P.M.
Present: Lindgren, Murray, Buesseler, Welk, Council
Liaison Wilharber.
Motion by Murray, second by Lindgren to accept the
minutes of the December 3, 1985 Planning and Zoning
meeting, motion carried unanimously.
Appearance of Donald Opp. Mr. Opp is interested in
constructing a 17 unit apartment building in the
proximity of the existing aparLments on Progress Road
north of Main Street. His concern was whether or
not he would be able to obtain a Special Use Permit.
The Planning and Zoning Commission suggested he check
to be sure he's not in a flood plain area or a
conservation district. He was also advised to talk
with his neighbors and the Rice Creek Watershed District.
The Planning and Zoning Commission would like to see
a final drawing including driveway, parking area and
any future expansion such as addition of garages. If
requirements of ordinance #4 are met, the Commission
felt a Special Use Permit was a possibility. Clerk
will check with the City Engineer to see if sewer can
handle flow of 17 units.
Discussion on Dog Ordinance #24. Motion by Buesseler,
second by Welk to recommend to the City Council the
following changes be made to Ordinance #24:
Section IV. License Required.
Now Reads: All dogs kept or maintained by their
owner within the corporate limits of the City of
Centerville shall be licensed and registered if
over six months of age. Dog licenses shall be
issued by the City, upon payment of a fee of *7.00
for each dog, whether it be male or female, spayed
or unspayed. Such license shall continue in force
for the life of the animal provided that the owner
shows proof every two years that the dog has shots
withinthat period and provided that the address
of the owner remains the same. A certificate of
vaccination authorized by a licensed veterinarian
for rabies shots must be presented at the time
of licensing and within every two year anniversary
date thereafter.
Amended to Read: All dogs kept or maintained by

Section V. A. Issuance of Tags.
Now Reads: Upon the payment of the license fee
and presentation of a rabies vaccination certificate
the City shall issue a license to to the owner.
Duplicate tags may be issued for 81.00 in replacement
of a lost tag. Dog tags shall not be transferred
from one dog to anotner and no refunds shall be
made for any dog license fee.
Amended to Read: Upon the payment of the license
fee and presentation of a rabies vaccination
certificate the City shall issue a license tag to
the owner. Duplicate tags may be issued in
replacement of a lost tag upon payment of a fee
as set by the City Council. Dog tags shall not be transferred
from one dog to another and no refunds shall be made for any

licenses issued with the name, address and phone
number of the person to whom issued and name, age,
description of the dog and dates of rabies vaccinations.

Section X. Vicious Animals.
Now Reads: ...The quarantine required by this section
shall not be necessary and the requirements shall
be waived whenever the owner of such dog or animal,
immediately upon receipt of the notice referred
to above presents to the Centerville Police the
certificate of an authorized veterinarian that the
dog or animal was vaccinated for rabies on a date
less than one year prior to the date of such notice.
Amended to Read: ..The quarantine required by

ments shall be waived whenever the owner of such
dog or animal, immediately upon receipt of the
notice referred to above presents to the Chief
of Police the certificate of an authorized veterinarian
that the dog or animal was vaccinated for rabies
on a date less than one year prior to the date
of such notice.

Section XII. Kennels. #1.
Now Reads: 1. Payment of an annual kennel license
fee in the amount of $25.00.
Amended to Read: 1. Payment of an annual kennel
license fee as set by the City Council.
Section XV. Penalty.
Now Reads: Any person, firm or corporation violating
any provision of this ordinance shall be guilty
of a misdemeanor and upon conviction thereof shall
be punished by a fine not exceeding three hundred
dollars ($300.00) or by imprisonment not to exceed
ninety (90) days.
Amended to Read: Any person, firm or corporation
violating any of the provisions of this ordinance
shall, upon conviction thereof, be deemed guilty
of a misdemeanor as defined by state law;
motion carried unanimously.
Clerk will get extension on loan of zoning information from
the League of Cities.
Chairman Tourville attended the Annual Planning Institute
in December. He will summarize some of the high points
and distribute to Council & P & Z for their information.
Motion by Murray, second by Lindgren to appoint Peter
Buesseler as Vice Chairman to the Planning and Zoning
Commission for 1986, motion carried unanimously.
Motion by Lindgren, second by Buesseler to appoint Dan
Tourville as Chairman to the Planning & Zoning Commission
for 1986, motion carried unanimously.
Chairman Tourville complimented the other members of P & Z
on their attendance and efforts in 1985. He also sighted
ordinance update and review being one of the goals for 1986.
P & Z members expressed their desire to continue the
alternating council liaison for 1986.
Motion by Buesseler, second by Welk to adjourn meeting,
motion carried unanimously. Meeting adjourned at 10 :00 P.M.
