CITY OF CENTERVILLE CITY COUNCIL MEETING January 13, 2010 6:30 p.m. Pursuant to due call and notice thereof, the City of Centerville held their regularly scheduled meeting on January 13, 2010, at City Hall, 1880 Main Street. December 29. 2009 Council Meetine Minutes Motion by Council Member Love, seconded by Council Member Paar to auprove the December 29. 2009 Council Meetine Minutes as presented. All in favor. Successful Performance Review & Completion of Probationary Period, Mr. Mike Jeziorski, Finance Director — from Step 2 to Step 3 Motion by Council Member Paar, seconded by Council Member Fehrenbacher to approve the Consent Aeenda as amended. All in favor. Motion carried unanimously. VI. AWARDS IPRESENTATIONS(APPEARANCES Ms. Lori Bombeck. Centerville Lions — Letter of Support (EAA -Young Eaele Rally) Ms. Bombeck appeared before the City Council and stated that she has met with the Centennial Police Department, Centennial Fire Department, Anoka County Sheriff Office and several members of the EAA Benson 745 Airport, who have all reviewed the plan and are all in support of the event. Mayor Capra noted the Sheriff's safety concerns and asked about the City liability for the event. City Attorney Glaser stated that the ultimate safety and liability concerns lie with the plane company and not with the City. He added the City is just offering a letter of support. Councilmember Paar asked that all of the Staff recommendations and criteria are met. Page 2 of 5 2 City of Centerville Council Meeting Minutes January 13, 2010 Mayor Capra thanked Ms. Bombeck for all of her time spent working with Staff on this event. VII. OLD BUSINESS 1. Resolution 410 -001. Resolution Authorizing Condemnation of Private Pron_ erty for Public Trail & Sidewalk Easements City Attorney Glaser reviewed the background information, noting the addition of Exhibit A. Motion by Council Member Fehrenbacher, seconded by Council Member Paar to adopt Resolution #10 -001. Resolution Authorizing Condemnation of Private Property for Public Trail & Sidewalk Easements. All in favor. Motion carried unanimously. 2. Resolution # 10 -002. Resolution with Succession of Duties for Acting Mavor Mayor Capra stated that in the event of an emergency where the Mayor is not available and the Acting Mayor is not available, approving a succession of Councilmembers as Acting Mayor is necessary. The City Council discussed the wording details of the Resolution, with the consensus being Staff would draft the Resolution and bring back to City Council at the January 27, 2010 City Council Meeting. City Attorney Glaser suggested that Council pass a Resolution this evening in the event of an emergency between now and January 27, 2010. Motion by Council Member Paar. seconded by Council Member Fehrenbacher to adopt Resolution #10 -002. Succession of Duties for Acting Mavor. in the event of the absence of the Mavor, Mary Capra. Actine Mavor, Jeff Paar would assume the duties, in the event of his absence. Councilmember Linda Broussard Vickers would assume the duties, in the event of her absence, Councilmember Ben Fehrenbacher would assume the duties and in the event of his absence. Councilmember D. Love would assume the duties. All in favor. Motion carried unanimously. VIII. NEW BUSINESS 1. Anoka Countv Residential Recvchna Program Particination Agreement Motion by Council Member Paar. seconded by Council Member Love to aoorove Anoka Countv Residential Recvcline Program Participation Agreement. All in favor. Motion carried unanimously. 2. Bonestroo Rate Structure for 2010 Page 3 of 5 3 City of Centerville Council Meeting Minutes January 13, 2010 City Engineer Statz reviewed the background information, stating the report was informational and no action was needed. City Council thanked Staff for their time and work on this report. EAA -Young Eaele Rallv Letter of Sunoort Motion by Council Member Paar. seconded by Council Member Love to annrove EAA -Youne Eaele Rallv Letter of Sunnort, to be drafted by Staff, for their narticiaation in the Centerville Lions Fishine Contest. All in favor. Motion carried unanimously. NATOA Letter of Sunnort Mayor Capra reviewed background information. She stated she would like Planning and Zoning to review the Federal Regulations sometime in February 2010, to see what the impact on City ordinances would be. Motion by Council Member Fehrenbacher. seconded by Council Member Paar to annrove NATOA Letter of Sunnort. All in favor. Motion carried unanimously. IX. ANNOUNCEMENTS/UPDATES Citv Finance Director. Mike Jeziorski City Finance Director Jeziorski reported that he applied for the 2010 CDBG grant, which he reminded the City Council, is the grant that would help to fund about 25 residents to hook up to the City water supply and that Staff should know the status by the middle of February. He also stated the December financials are still in progress and it is planned to present to City Council in February. He stated the PCA Grant, which was submitted a few months ago, is still pending due to State budget cuts. He lastly mentioned that the audit pre- meeting was postponed until Wednesday, January 20, 2010. 2. Parks and Recreation. Mavor Capra Mayor Capra reported on Parks and Recreation, stating the first skate night would be Saturday, January 16, 2010 from 6 p.m. to 9 p.m., and that there would be a horse drawn hayride, popcorn and hot chocolate, as well as a bonfire. She also stated there are preliminary talks of putting up a volleyball court at Laurie LaMotte Park in between the skate park and the play equipment. She stated Parks and Recreation is also focusing on the 8K event that is scheduled for August 7, 2010. She stated she would ask Staff to have a preliminary talk with Parks and Recreation regarding the volleyball court, its location and the use of pea gravel to reduce the cost if necessary, noting that the cost really is not that significant. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF CENTERVILLE, MINNESOTA, 1. The individual members of the city council are hereby appointed to serve as acting mayor during the disability or absence from the city of the mayor or another acting mayor. 2. The individual members of the city council shall serve as acting mayor in successive order of their seniority in office. a. Seniority shall be calculated from the earliest date of continuous service beginning on the date each council member assumed office. b. In the event that more than one council member assumed office on the same day, the seniority of those council members shall be in age sequence beginning with the eldest. 3. Once an acting mayor enters office they shall serve as acting mayor until such time as any of the following events occur: a. Any disability or absence of the mayor is resolved, then the mayor shall resume active duties; b. Said acting mayor becomes disabled or is absent from the City, then the office of acting mayor shall vest with the most senior council member available at that time; or c. The vacant office of mayor is filled in the manner set forth by Minnesota Statute Section 412.02. 4. This Resolution shall amend and supersede any previous resolution of the city determining the appointment of an acting mayor. 5. This Resolution shall renew annually until superseded. 6. This Resolution shall be effective immediately upon approval by vote of the city council. Adopted by the Council this 27 day of January, 2010.
