Opening summary regarding nonconforming use discussion. To be read aloud at the
beginning of the "hearing."
The primary purpose of this agenda item is to solicit input from residents
that are located in a zoning district that would no longer permit the current
use. These situations are identified as "legal nonconforming uses." We are
aware that a paper was recently circulated regarding the level of Centerville
debt. We will not discuss taxes or city debt, but will adhere to the subject of
restrictions on nonconforming uses.
City Code does not permit expansion of nonconforming uses. But,
regulations do permit incidental alterations which include decks and porches
up to 100 square feet, accessory buildings up to 200 square feet and of
course, you are permitted to make necessary repairs like new roofs, siding,
window replacement and interior remodeling or redecorating. If the
nonconforming use is destroyed it may be replaced to its prior level of
nonconformity. For example, if you owned a 900 square foot, three bedroom
home that were destroyed, you could put back a 900 square foot three -
bedroom home, as long as you apply for a permit to do so within 180 days of
its destruction.
The Commission is interested in hearing from property owners regarding
what improvements that you would like to make to your home, but are not
permitted to make do to the restrictions on nonconforming uses. After we
have heard from property owners, that are directly affected, we will allow
time for the public at large to comment on this subject.
