HomeMy WebLinkAbout1996 P & Z CITY OF CENTERVILLE PLANNING AND ZONING COMMISSION DECEMBER 3, 1996 Pursuant to due call and notice thereof, the Planning and Zoning Commission of the City ofCenterville held their regular meeting on Tuesday, December 3, 1996 at the City Hall. Chairman, Dan Tourville called the meeting to order at 7:15 PM. PRESENT: Dan Tourville AI LaMotte Linda Broussard-Vickers ABSENT: Kathy Welk Tina Vermeulen STAFF/CONSULTANTS: Ry-Chel Gaustad APPROVAL OF THE MINUTES: Tourville indicated meeting minutes of June, July, September and November can not be approved as the required persons were not present for a quorum. OATH OF OFFICE: Linda Broussard-Vickers stated the oath of office being eligible to serve on the Commission of the Planning and Zoning for the City ofCenterville. NEW BUSINESS: 1. Schedule rezoning of Hensel/Leroux property for January - Tourville suggested the properties be considered as one, since there is one developer and the properties are adjoining. Tourville commented several years ago the city created a developers guide, which explained each step to be taken for a development. Further, he suggested the Planning and Zoning have adequate time to research and review this project, prior to rezoning the property and the proposed preliminary plat. Tourville asked the Planning and Zoning view the proposed sketch plans at the January 7, 1997 meeting. Tourville suggested to wait on the rezoning and preliminary plat public hearing until after Planning and Zoning has seen the sketch plans. 2. Metropolitan Council Comments - Tourville said there seems to be some concerns with the increased flowage and if the lift stations can handle the flow. Planning and Zoning discussed other issues identified in the Metropolitan Council letter dated November 12, 1996. Planning and Zoning December 3, 1996 Gaustad commented a proposed date of January 8, 1997 has been set for a Public Hearing on the City's Comprehensive Plan. Tourville mentioned everyone on the Planning and Zoning Commission planned to continue on for another year, as he had not heard differently. Gaustad mentioned an informational senior housing meeting has been set for Thursday, December 5, at 1:00 PM. Ry-Chel Gaustad, City Clerk 2 CITY OF CENTERVILLE PLANNING AND ZONING COMMISSION Pursuant to due call and notice thereof, the Planning and Zoning commission of the City of Centerville held their meeting on Tuesday, November 12, 1996 at the City Hall. Kathy Welk called the regular meeting to order at 7:00 P.M. PRESENT: Kathy Welk Tina Vermeulen Alan LaMotte ABSENT: Dan Tourville LIAISON: Tom Wilharber STAFF/CONSULTANTS: Jim March A motion was made by T. Vermeulen, seconded by A. LaMotte to approve the corrected minutes of the October 1, 1996 meeting. Motion carried unanimously. A motion was made by T. Vermeulen, seconded by A. LaMotte to recommend to the city council the appointment of Linda Broussard Vickers as a member of the planning and zoning commission. Motion carried unanimously. HENSEL/LEROUX PROPERTY Mr. Rockne Goertz presented a concept sketch plan for the Hensel and Leroux properties. The plan showed two accesses to County Road 14. The roadway also hooked up with the Centerville Road stub from the north. The plan showed 40 lots. Mr. Goertz mentioned the home values would be well into the $200's. Some of the lots were less than the 150' required depth, but all the lots met the 15,000 sq. ft. minimum area size. The lot sizes would need to be addressed with a variance. Mr. Goertz mentioned that he had shared this sketch plan with the school board. They would like to see a trail system and keep the development as shown with Centerville Road not connecting from north to south. Mr. Goertz mentioned he had already spoke with Anoka County regarding the County Road accesses. He indicated there would be no problems. Mr. Goertz also spoke with the Rice Creek Watershed District. They indicated the mitigation should not be a problem. ~ Mr. Goertz indicated that he would use private financing for the project. He anticipated the project could begin in July of 1997. Mr. Goertz would like to have a public hearing at the next possible meeting for the rezoning required. He indicated January would be fine. Mr. Goertz has also spoke with the City Engineer regarding water and sewer availability. Mr. Goertz reiterated that "we have all winter to work on this". The consensus of the commission was the sketch plan will provide the following: * allow another access to Centerville Road * will provide a buffer zone to the south properties * will be like its own community. Jim March mentioned that the City should look at requiring restrictive covenants that would assure that the homes developed would be of similar value and on the higher end of the market. Mr. Goertz mentioned he would be willing to look at this option. Mayor Wilharber read a letter from the church of St. Genevieve that relayed their ongoing planning process and their inability to commit land for senior housing at this time. Motion was made by T. Vermeulen, seconded by A. LaMotte to adjourn the meeting. Motion carried unanimously. PRESENT: Kathy Welk Tina Vermeulen Alan LaMotte ABSENT: Dan Tourville LIAISON - Tom Wilharber STAFF/CONSULTANTS: Ry-Chel Gaustad PUBLIC HEARING Erkenbrack vacation of property - Welk open the floor for discussion at 7: 10 P.M. Mr. Erkenbrack explained the property in question was a 33 foot strip ofland. Gerald Rehbein commented the purpose of the 33 foot easement was to provide an area for a trial way paths. Welk explained the area designated for trail ways was no longer needed. Vermeulen felt the piece of ground is of no value to the City. Welk closed at 7: 15 P.M. Gerald Rehbein - Preliminary plan for Willow Glen - Welk opened the public hearing at 7: 15 P.M. Welk asked if Rehbein would like to open the discussion. Rehbein said he would be developing the townhomes and commercial property next to it. Rehbein explained each resident will have 4 parking spots. Paul Backman, 1722 Unity Avenue asked if there would be sever weather shelter. Bill Henderson from Integrated Real Estate Services, Inc. said no. Welk asked if all the road ways within the association will be private drives. Rehbein yes. Cathy Rodgers of 7175 W. Robin Lane if this would be a private community within Centerville. Gary L. Hugeback, Present, of Integrated Real Estate Services, Inc. stated, only the roads are private. Rodgers asked how utilities would be billed. Dave Grimmelman Salesman for Bright Key explained each property owner would pay for their own utilities. Rodgers asked what time frame will the townhomes be built. Henderson explained they would build as they go. Rodgers asked how many bedrooms per unit. Henderson said there is two rooms with a loft for an optional third room. Craig Bortzwitz of7214 Unity Avenue, asked if the City's water supply and sewer could accommodate the new development. Wilharber stated the water is something the city is looking at some options, such as another water tower and/or an interconnect with Lino Lakes. Wilharber responded the sewer capacity is more than enough. Rodgers questioned the availability of the Police and Fire Departments. Wilharber explained the police protection will naturally go up but currently the police patrol 17 hours per day. Further, Cir-Lex Fire department is the best and has several departments for back up. Hugeback, commented this townhome development will increase the tax base to cover additional public protection. Dave Melby of 1986 72nd questioned the possible future access, east of the property. Rehbein stated nothing is proposed. Welk closed the public hearing at 8: 17 P.M. APPROVAL OF MINUTES: MOTION by Vermeulen, seconded by Welk to approve the August 6, 1996 Planning and Zoning minutes. Motion carried unanimously. MOTION by Vermeulen, seconded by Welk to table June 4, July 9 and September 3, Planning and Zoning minutes. Motion carried unanimously. UNFINISHED BUSINESS: Gerald Rehbein - Preliminary plan for Willow Glen Development - MOTION by Vermeulen, seconded by LaMotte to recommend Willow Glens Development to the City Council for preliminary plat approval consideration, addressing road width or extra parking, association agreement regarding possible rental units, facilitate some type of park in the development for grandchildren, more than one tree per unit, and have the City Attorney review the rules of the association. Motion carried unanimously. Erkenbrack vacation of property - Welk commented since there was a public hearing and there was no opposition from neighbors. MOTION by Vermeulen, seconded by LaMotte to recommend the Erkenbrack vacation of property to the City Council. Motion carried unanimously. NEW BUSINESS: Committee Report on the Comprehensive Plan Joint Meeting - Wilharber explained, some updates were done to the Comprehensive Plan. The comprehensive plan was submitted to the Met Council for preliminary approval. The Met Council will review and send it back to the City for a Public Hearing and further updates then Met council will approve the final plan. Welk questioned the flood plain map. Wilharber explained the city should be receiving the revised flood plain map from FEMA. ADJOURN: MOTION by Vermeulen, seconded by LaMotte to closed the October 1, 1996 Planning and Zoning meeting. Welk A Lamotte Tom Wilharber Jim March Ry-Chel Gaustad APPROVAL OF MINUTES: June 4, 1996, July 9, 1996, August 6, 1996 meeting minutes were not approved because there wasn't a quorum from the past meetings, UNFINISHED BUSINESS: Gerald Rehbein - Sketch plan for Willow Glen - Rehbein requested approval of a sketch plan for Willow Glen, Rehbein said there would be 96 unit townhomes. Tourville asked how many were previously presented to P&Z. March replied 84 units. March asked if this would be controlled by an association. Rehbein said yes. Wilharber asked if these would be for sale or rent. Rehbein said for sale only. LaMotte asked the price range. Rehbein said $80,000. to $130,000. Tourville asked what has been done about the drainage issue since the last presentation of the plans in this area. Rehbein said there will be minimal wetlands because he will have ponding areas. Tourville questioned the location of the proposed wetlands. Rehbein said some would be on Rocky's land but he does propose to do a small pond within the townhouse plans. Welk asked if this would be done in phases. Rehbein said he's not sure, the plans are not complete. Tourville commented builders usually have a good idea of what type of structures and time frame they're dealing with. Rehbein said he could bring in pictures of the structures. Tourville commented it appears the only off street parking is in front of the garages. Rehbein said he will have further information when they do the preliminary plats. Tourville said several townhome proposals have been proposed to P&Z but no one came to the last public hearing. Rehbein said he would like to move the property because of the taxes e.g.. Tourville commented the city utilities will have to be addressed by the engineers. Wilharber asked the width of the road. Rehbein said 24 feet on the main roads and 20 feet on side streets. Tourville questioned the off street parking accommodations. Rehbein commented the homes will have double car garages and driveways. Tourville questioned the park dedication. Rehbein said the city had requested money instead of a park. Tourville commented the city may be better offwith the money instead of the land. Tourville asked if outlots A&B were in the T.I.F district. Wilharber said yes. Rehbein said Tay-Mark walked out because of the flood zone. Tourville heard Tay-Mark didn't buy in Centerville because there was standing water on the property. Tourville questioned if there is sedimentation ponds. Rehbein said yes on the east side. Tourville questioned the high unit density for the area, he looked it up and Rehbein would be within the zoning requirements. Rehbein asked if there would still be a public hearing since Rocky already had one. Tourville stated every preliminary plat must have a public hearing. Welk suggested additional off street parking. Tourville requested no wetlands. Rehbein stated clean acres are not wetlands as far as the DNR is concerned. Tourville questioned the concept of townhomes on the property. MOTION by Welk, seconded by LaMotte to accept townhome concept. Motion carried unanimously. March commented this will be placed on the September 11, Agenda. Further, the city will send out notices and have a public hearing. Wilharber asked the following be addressed at the council meeting: Off street parking, slabs, parking, number of units, garages, width of roads, tree buffers and landscaping. Tourville requested the builders keep the same theme through out all the buildings. Rehbein said there is one theme and one association everything will be done the same. Tourville commented it meets the medium density of 5- 12 dwelling units per acre. Special Use Permit - Steve Gaustad of Integrity Systems requested a special use permit to conduct light industrial business in a commercial zoning. Gaustad intends on running a small manufacturing company which makes custom automated conveying systems. Tourville asked ifit would be like a machine shop. Gaustad replied yes. Wilharber asked about noise. Gaustad said it would be very minimal. Wilharber asked about odor or smells. Gaustad replied there shouldn't be any odor. Tourville asked if the city was aware of any complaints. Wilharber said fumes and odor. Wilharber asked if Gaustad had signed an agreement with Bob Sorgo Gaustad said it was pending, based on the special use permit. Tourville asked ifthere was any special accommodations needed. Gaustad no. Wilharber asked if Gaustad was willing to hire young people of the area. Gaustad yes. Tourville questioned the city's ability to grant a special use permit from commercial to light industrial. March replied the use is to comply with requirement for granting a special use permit in a commercially zoned area. There has to be no traffic congestion, excessive public expense or be a nuisance. Tourville referred to the ordinances which indicated light industrial/light manufacturing buildings can not exceed 4,000 square feet. March replied the building is 3,000 square feet. MOTION by Tourville, seconded by Welk to recommend to the council to consider the Special Use Permit for light industrial in a commercial zoning. Motion carried unanimously. Ordinance 4 - Tourville stated P&Z had already addressed and approved ordinance 4. Tourville suggested with the several changes, the city may want to keep track of them and have one public hearing for all the changes. Erkenbrack vacation of property - Tourville questioned the old park walkway and the possible future need for a lift station or other needs. , . . , MOTION by Tourville, seconded by LaMotte to vacate the property. Motion carried unanimously. Fences- March addressed an issue regarding South Robin Lane. A resident would like to put up a 6 foot fence with no variance since his neighbors had and asked ifP&Z was aware of this. Tourville stated no variances have been granted to his knowledge and the residents shouldn't have put up fences. Tourville requested something be done with maintenance to some of the residents homes in the area. The town seems to be getting really weedy, especially the place across from the Trio. MOTION by LaMotte, seconded by Welk to adjourn the meeting at 8:47 p.m. Respectfully Submitted, )j~ Ry-C el Gaustad City Clerk , CITY OF CENTERVlLLE PLANNING AND ZONING COMMISSION TUESDAY, AUGUST 6, 1996 PRESENT: Kathy Welk AI LaMotte ABSENT: Dan Tourville Tina Vermeulen Lloyd Drilling TIME STARTED: TIME ENDED: 7:05 p.m. 8:45 p.m. PUBLIC HEARING - Rezoning of the Hensel Property Rockey Goertz stated he re-did the sketch plan to address the concerns that were expressed at the last public hearing. The proposal of rezoning has changed in that the request is for R2 instead of R2A. A portion of the property is already zoned correctly for the project. Mr. Goertz stated having Main Street as an exit should alleviate some of the traffic concerns. Dave Nyberg stated that without doing a traffic study the flow of traffic would be hard to determine. The exit to Main Street is a good alternative, he agreed. Mr. Nyberg added that Centerville Road. should be a collector street. Don Simonson, 7263 Centerville Road, said that this proposal was an inlet to the traffic problems not an outlet. Mr. Simonson went on to say he would like to reiterate John Buckbee's comments from the last public hearing regarding bigger lots. Mr. Simonson also questioned why 60 foot wide streets and is this in the best interest of the city to run a street by a school. Mr. Nyberg stated there needs to be a collector street to the south from those homes in the northern area. And this collector is in the long range transportation plan to have Centerville Road go through. Mr. Nyberg commented that roads have to go by schools, Westview goes in front of it. Mr. Simonson stated the traffic concern is the increase of traffic that would go by the school. Tim Schweppe, 7249.Centerville Road, said the sketch planisan improvement from the .. last but does question the reason for Centerville Road being extended. It devalues the properties and is creating traffic problems. Need to do what is best for the city, Mr. Schweppe commented. Mr. Nyberg stated the city has limits for the length of cul-de-sacs and for fire protection there needs to be more than one connection. Mr. Nyberg stated the Fire Marshal needs to comment whether that would be acceptable. PZ8-6MM.WPS 1 Planning and Zoning Minutes of August 6, 1996 Drilling suggested eliminating the connection to the north and leaving the rest basically the same. And questioned whether there is a way to appease the public. . Mr. Nyberg stated that if the zoning is approved the developer would have to prepare a preliminary plat. Mr. Nyberg stated he provided three options for water service and also mentioned the sewer at CentervilIe Road is shallow and may have to look at alternate routes for a portion of the plat. Mr. Goertz agreed and stated he would probably look at getting the water from the east. Margaret Hensel asked about the concern about children walking to school. It was mentioned that the children are now being picked up by the bus. Drilling stated a portion of the proposed 60 foot road could be used for a trailway system. Mrs. Hensel questioned why everybody hates them. Drilling stated they are trying to help and that they have every right to develop their property. Bob Knabe, 6483 - 20th Avenue South, owns the property next to Hensel's and he expressed a concern for storm water runoff Mr. Knabe stated that a culvert was put in lower than Peltier Lake across Peltier Lake Drive and the detention pond is growing because the weirs are not maintained and the culvert is to low. Mr. Goertz stated that mitigation would be done for adding the road plus retention ponding on the east and south ends would probably be necessary. MOTION by Vermeulen, second by Drilling to close the public hearing on the rezoning of the Hensel property at 7: 3 5 p. m. Motion carried unanimously. Recommendation from public hearing Mr. Goertz stated the city really needs to look at the comp plan and future roads. MOTION by Drilling, second by Vermeulen to approve the rezone of the Hensel property from R3 to R2 (Single Family Residential) contingent upon preliminary plat approval. P&Z also requests that the developer look at spreading out the lots on the north side to eliminate the extension of Centerville Road; provide a future access to the south; and that P&R look at a trailway system for access to the school and playground facilities. Motion carried unanimously. Willow Glen Mr. Goertz presented a sketch plan for Willow Glen (this is the area referred to in the past as Golden Meadows). Willow Glen is proposed to be 84 townhome units, for sale and priced at $90-120,000. It would be a continued South Robin Lane as a public street with private streets to the units. The association would take care of the private roads. PZ8-6MM.WPS 2 Planning and Zoning Minutes of August 6, 1996 Drilling questioned the emergency vehicle access -- what it would look like / be constructed of and whether it would work for the Hensel property. Mr. Nyberg stated he thought it needs to be plowed in the winter but the Fire Marshal would have to make that determination. Mr. March asked if it would be phased to insure that the units would be sold. Mr. Goertz stated the project is meant for starter homes and would be built eight at a time (3 phases). The project would be a PUD and if any changes occur it would require a public hearing. Drilling stated the residents concern in the past was for rental and didn't seem to have a problem if the units would be owned. Welk questioned the number of units per acre. Mr. Goertz stated approximately 7. Mr. Nyberg stated that other public entities (police and school) do their own studies for future growth and needs. Welk expressed a concern for the number of units for the space. Vermeulen asked if the property has been considered for Senior Housing? Mr. Goertz stated he wouldn't have a problem with senior housing but that the land owners have it priced for high density. The commercial zoned property to the south is a plus for the city and the industrial is not necessarily bad. It helps being in close proximity to the freeway. Mr. Goertz stated he wasn't sure on a time frame, would like to get going on the plans to build in the spring. Drilling stated it look good and suggested the Mr. Goertz take it to the City Council. P&Z members discussed and debated the Centerville Road extension and the rate of developments in Centerville. Nelson Fence Variance P&Z d~ci4e4 th~t the main concern would be for visibility and that it doesn't appear to hinder visibility for traffic on 73rd. MOTION by Welk, second by Drilling to grant a variance allowing a 6 foot fence - as proposed - for a comer lot at 1846 - 73rd Street, as long as the set backs are met, it doesn't obstruct vision for traffic in the area and that the neighbors are also in favor of granting the variance. Motion carried unanimously. Drilling stated that this would be his last meeting and asked that staff advertise for a replacement. PZ8-6MM.WPS 3 Planning and Zoning Minutes of August 6, 1996 . Ordinance 44A MOTION by Vermeulen, second by Drilling to amend ordinance 44A as follows: NOW READS: Section 2. All buildings erected on land within the commercial and industrial zoning districts shall be of wood frame, steel, reinforced concrete, masonry or an equivalent or better material. No building shall have pole barn type construction nor an exterior wall surface of sheet metal. Exterior wan surfaces of all buildings shall be face brick, glass, stone, decorative block, architectural concrete cast in place, pre-cast concrete panel, or architectural metal panel. Wood may be used as a trim material. AMEND TO READ: Section 2. Respectfully submitted, . ~~;;N Trudi Breuninger City Clerk PZ8-6MM.WPS 4 CITY OF CENTERVILLE PLANNING AND ZONING COMMISSION JULY 9,1996 PRESENT: Dan Tourville AI LaMotte ABSENT: Tina Vermeulen Kathy Welk Lloyd Drilling TIME STARTED: TIME ENDED: 7:07 p.m. 12:40 a.m. PUBLIC HEARING - Nelson Fence Variance Request Mari and Roger Nelson, 1846 - 73rd Street, explained that the variance is for a 6 foot fence around their backyard. Because their lot is on a comer it is considered a side lot they would only be allowed to put up a 4 foot fence. The application for the variance request completed by the Nelsons explains the reasons for a 6 foot privacy fence. No residents present regarding this issue. MOTION by Drilling, second by Welk to adjourn the public hearing for the Nelson Fence variance request. Motion carried unanimously. PUBLIC HEARING - Rezoning of the Hensel Property Called to order 7: 15 p. m. The Hensel property is a 15 acre parcel that is currently zoned Conservation, Single Family Residential - Future Expansion, and Single Family Residential. Mr. Goertz stated that rezoning the property is part of the purchase agreement. ...- The portion of the property zoned for single family residential is also already in the MUSA boundaries. . The proposal is to rezone the property to high density single family (R2A). The sketch plan showed extending Centerville Road to the south with cul-de-sacs to the east and west with approximately 19 lots. Mr. Goertz stated he would petition the city for improvements. PZ7-9MM.WPS 1 Planning and Zoning Minutes of July 9, 1996 Gene Houle, 7124 Centerville Road, Q: Is it in the plan to purchase the LaRoux property. If possible, Mr. Goertz responded. Mr. Houle stated that he does not want Centerville Road to go through, does not want the traffic, and does not want city utilities. John Buckbee, 7381 Peltier Circle, Q: the traffic flow. Mr. Goertz answered: Mill Road and Peltier Lake Drive. He added that the road can't be looped to Main Street because of the wetlands and RCWD is not allowing fill in the wetlands. Mr. Buckbee questioned why high density. Mr. Goertz stated it is what is in the city's comprehensive plan and it also fits with the surrounding area. Mr. Buckbee stated that when he was on the council, they had discussed the footage requirements and did not want to see the houses close together. Mr. Goertz stated that in order to make the frontages larger and keep within the cities comp plan he would have to build town homes. Linda Drilling, 7248 Centerville Road, expressed a safety concern for pedestrians and children and also questioned if trees would be lost. Mr. Goertz stated there would be some trees lost that fall within the roadway but would try to keep as many as possible. He also mentioned that the Hensel's could cut down trees at any time because they are on their property. Tim Schweppe, 7249 Centerville Road, stated he is not opposed to the project, need to do what is best for the community. Mr. Schweppe does have a concern however for safety and traffic. Amy Ebsen, 1594 Peltier Lake Drive, expressed a concern on the impact to the whole city with all the developments and the number of homes being built. Steve Marcello, 1649 Peltier Lake Drive, also expressed a traffic concern. He stated the city needs to put in better streets. Dave Nyberg responded that the street standards are higher today. Scott Maro, 7276 Centerville Road, stated the project won't work as proposed because the maintenance of Peltier Lake Drive,nMiU Road andCentervilleRoad are PQorand the.. storm sewers are not in the right places. George Burr, 1693 Peltier Lake Drive, stated because the city wants the watermain to go through doesn't mean the residents do. He also commented that emergency vehicle routes have to be looked at. Rich Soltan, 7251 Mill Road, commented that Mill Road can't take any more traffic. Wayne LeBlanc, 1677 Peltier Lake Drive, said he used to sit on the RCWD advisory committee and doesn't think it would be that big of an issue to have a road to Main Street. PZ7-9MM.WPS 2 Planning and Zoning Minutes of July 9, 1996 Mr. Nyberg stated that if you impact wetlands you generally have to replace them at a 2 to 1 ratio. Regarding the traffic issues, Mr. Nyberg stated that it has been a long term goal to have Centerville Road develop to the north at a 9 ton road. Bonnie Larson, 1724 Peltier Lake Drive, experiences a lot of traffic from Waterworks -- drinking and driving and not aware of children. Ms. Larson stated that no thought has been put into developments in Centerville and this proposal is not ideal for this property. Tourville stated that the city will grow and doesn't feel comfortable putting up gates to keep development out. Norm Fritchie, 1637 Peltier Lake Drive, stated the traffic issue needs to be addressed. Don Moe, 1740 Peltier Lake Drive, stated the locals use Peltier Lake Drive as a cut across and also Lino Lakes residents use it to get to 35E. He also works on the fire departments and stated it is difficult to get through because of the large volume of children in the area. Need to look at the big picture -- what is best for Centerville as a whole. Mr. Buckbee stated he has a 13 acre parcel that was originally platted to have 22 homes and would like to see less density in Centerville. Would recommend not going to R2A anywhere in Centerville and would rather see R5. Ms. Ebsen said that traffic is one issue but what about crime with the limited police coverage that Centerville has. Bill LaLonde, 1687 Westview, believes it to be premature for the community and also made the comment that nobody said anything about the schools. He stated that he would not turn over his property and it would be a severe legal battle if Centerville Road was ever extended. Mr. Goertz stated he is only here with a proposal and the residents may have legitimate concerns but ultimately it affects the Hensels. The comp plan shows townhomes. .. ... Cynthia LaBlanc, .1677. Peltier Lake Drive, would recommend not allowing Centerville . Road to go through. Theresa Brenner stated she has been involved in the comp plan update and the city has held town meetings and she encourages residents to attend the public hearings. She stated she would've like to see a moratorium on development during the updating of the comp plan. Brenner finds it frustrating to look at developments while re-doing the comp plan. She also advised the residents to call her or city staff if they have any questions. Tourville stated that public input is important but very seldom do they get it until it is in the person's backyard. PZ7-9MM.WPS 3 Planning and Zoning Minutes of July 9, 1996 Karen Clearance, 1649 Heritage, said she doesn't know what a comp plan is to attend meetings. She also has a concern for the wetlands and raw sewage flowing in the downtown area. Ron Barnes, 1594 Peltier Lake Drive, said he came to Centerville for the esthetic value of the land and with the increasing traffic and crime it is dividing the community. Tom Wilharber stated that only 11 people came to the town meeting and 7 of which were from other communities. Residents have to let the council members know how they feel. Sandy Peterson, 1585 Peltier Lake Drive, expressed a concern for the shortage of school space. Questioned what happens with the school with the number of homes going up and does the developer help pay for the school. Mr. Goertz stated the developer does pay their share by paying taxes on the lots and model homes that aren't homesteaded. Mr. Goertz stated that he doesn't want controversy and he agreed to look at other options. MOTION by Drilling, second by LaMotte to close the public hearing at 8:40 p.m. Motion carried unanimously. PUBLIC HEARING,.., Eagle Pass Preliminary Plat Called to order at 8:45 p.m. Larry Olson, Midwest Land Surveyors and Gary Gorem, developer, were present to answer any questions and they described the project. Eagle Pass is a 66 acre parcel consisting of 66 single family lots, 45 detached townhomes and 38 twin homes~ detention ponding area~ park and trail system~ public streets~ private streets - maintained by an association~ and city installed improvements paid by the developer. Drilling questioned some of the lot size minimums that weren't met. Mr. Olson said the conceptofa PUD.is to preserve some of the wetlands and open spaces. Beverly Hughes, 1745 Center Street, questioned the drainage problems in the southwest comer of the development that are already existing. Mr. Olson stated the storm sewer system that would be installed should alleviate some of the drainage to the ditch. Ms. Hughes asked if the trees were going to be preserved. Mr. Olson stated a lot will be graded out for streets. They are planning on moving them and transplanting them in the development. PZ7-9MM.WPS 4 Planning and Zoning Minutes of July 9, 1996 Gary Gorem stated the project would be done in 2 phases taking approximately 3 years to develop the entire plat. The townhomes are being built with the intention that the "empty nesters" would purchase them, therefore not having a lot of children coming in. Mr. Gorem also commented that knowing the value of trees they will try to save as many as they can. Bonnie Larson, 1724 Peltier Lake Drive, stated the townhomes would appeal to single parents as well as empty nesters. Bill LaLonde, 1687 Westview, questioned the price range of the homes. Mr. Gorem said the single family homes would be $150,000+, the single family townhomes $140- 150,000+, and the twin homes around $120,000. Ms. Larson asked if they would be handicapped accessible. Mr. Gorem stated there will be some because there appears to be a market for it. Mr. LaLonde questioned if the park property was useable. And Ms. Larson asked why tennis courts. Mr. Wilharber stated the city is purchasing 11 acres from the LaMotte estate to expand LaMotte Park which will primarily be used for softball. Mr. Wilharber also stated the purpose of the park is to provide park for Center Oaks residents. Wayne LeBlanc, 1677 Peltier Lake Drive, expressed three concerns; runoff / detention ponds; additional people and amount of school space; and feels the city should require full size lots with no exceptions. Ms. Welk stated that by allowing a PUD development the project is an exception to the use of the land. Wayne Kallstrom, 6927 Ivy Court, stated he was aware that the area would be developed at some time but would like to see a traffic study done especially for Center Street. Cindy illshafer, 1825 Center Street, expressed a concern for the runoff because the pond is also in her backyard; it fills up in the spring and fall. Mr. Olson stated the field crew was out and will be looking at it, but that they would hope to make the ditch drain better. Amy Ebsen, 1594 Peltier Lake Drive, questioned who would be maintaining the trailways. ....__Mr. Olson stated a portion of them would be maintained by the association. Murray Wilke, 1809 Center Street, stated the drainage ditch has helped immensely and would like to be reassured that it would not be altered. Mr. Wilke also expressed a safety concern for the ditch being next to the proposed park. Mr. Wilke also questioned the number of associations, the area which would be under them and what control they would have. Mr. Gorem stated the association basically tells them what they can and cannot do. Residents pay association dues for the maintenance, garbage, etc. Mr. Gorem stated the residents are the association and the city does review the association documents and they will be recorded with the final plat. PZ7-9MM.WPS 5 Planning and Zoning Minutes of July 9, 1996 LaMotte stated the southwest comer of the plat is showing what can be put in the areas but it also limits that property owner. Mr. Nyberg stated that if builders buy lots from Gorem Development, they would need to make it clear where the house needs to be placed. Mr. Gorem stated they don't just sell to builders, they work with a set of them and they are made aware of the plats exceptions. Mr. March stated the plat could be approved with a lot of contingencies, such as road realignment/traffic issues and all the items listed in MSA's letter. APPEARANCES Jim Nelson, TEA Group, explained that he was proposing to mount 3 groups of 3 antennas on the catwalk of the watertower. Centerville's watertower is a primary site, Mr. Nelson stated. Mr. March stated TEA Group is proposing a rental rate of $9,000 a year. Permits for this use can be issued by the Public Works Director according to city ordinance #60. The permit fees have not been set that are mentioned in this ordinance. Drilling questioned the maintenance agreement. Mr. March stated the attorney's opinion was that the agreement was written in the interest of the city. Tourville questioned the appearance of the antennas. Mr. Nelson stated they would be painted to match the water tower. Mr. Nelson also explained the power boxes or cabinets located on the ground would be secured andin a locked fence. Orville Hughes, 1793 Center Street, asked if it would interfere with Anoka County's tower. Mr. Nelson stated they would have to do an interference study but could assure that it wouldn't. Mr. Nelson stated that the antennas would be up as long as the tower is standing. Mr. Nyberg stated it would be around for another 5 years but in 20 years - probably not. PZ7-9MM.WPS 6 . Planning and Zoning Minutes of July 9, 1996 Drilling mentioned how can a preliminary plat be approved with 40 issues. Nyberg stated that many of the issues are minor. What is going to happen in the south west comer? Units on the east boundary, beyond the wetlands need to be or could be included in the plat. The right of way needs to be shown for the exception property near the entrance on the west. Nyberg suggested the preliminary plat be approved with contingencies. Discussion occurred on the north boundary abutting Tourville's property, the road would come through and go out to the west in the future. Covenants would be written so that the 4 units could join the association in the future. The road is beneficial by abutting the property line so that the future Tourville development could access the streets. No problem on grading plan according to Mr. Gorem. Trails through backyards is an issue. Trails should not run through a corridor, maybe need to run to the road. The trail could be re-routed to include sidewalks along south loop to the east to hook up to Clearwater Meadows. Tourville mentioned he feels over a barrel. Would his property be assessed? No, not until units would be built and then utilities would be put in. Tourville would like to reserve the right to review the by laws affecting homes on his property. This doesn't appear to be a problem as long as they know what language he would require. Wilharber stated the Fire Chief has concerns on the narrow private roads being 20 foot wide. Convenants could address parking on one side only. Is there off street parking in association areas? Yes, 15-16 along private streets. The purpose of the meeting was to discuss issues affecting both committees: Eagle Pass Development and combining of committees. March explained the issues at hand regarding the placement of the park for the Eagle Pass development. If there were an emergency situation on a weekend there would be a parking conflict with the fire department and city hall. March also stated during a recent discussion with Berkley, the city's insurance provider, he advised not to put a city park on the creek because of the liability. And finally, the purpose of a park in the area is to also service the residents in the Center Oaks Development. Wilharber also commented that the Fire Chief expressed some concern for the park being on the creek and the parking issue. Wilharber suggested moving the park inland, closer to Center Oaks. Fogerty stated that the wetlands in the proposed park are useless. First questioned that needed to be answered is: What type of park is needed or wanted? Johnson suggested something similar to Tracy McBride park, a neighborhood children's park. Fogerty stated he would like some structured ball facilities. Larson commented that they are planning a ball complex at LaMotte Park. Tourville suggested installing tennis courts and a place where younger kids can play close to home. Larson stated the park in Acorn Creek is planned to be a "social" park with barbecue pits, tot lots and sandboxes. Emrich stated there would be a small amount of children generated from this development. Therefore he suggested a land dedication of the required amount and then they would develop the park. Double tennis courts and small play equipment would fit on 2-3 acres of land, which would be the 5% land dedication. PZ6-17MM.WPS I Joint Meeting Minutes - Planning and Zoning / Park and Recreation Wilharber stated that the quality and specs of the equipment would be set in the developers agreement and set in agreement with the developer and the city. General consensus to move the park to where the proposed lots 21-27 of block 5 Gust above Center Oaks) are located. The developer will provide a park of 2-3 acres in size and develop the park with a double, fenced in tennis court and small play equipment. There was some discussion as to the density of the project and ifit meets the PUD section of Ordinance 4. Concluded that ordinance 4 had been modified to provide residential density that exceeds 125% of the proposed residential density of the entire PUD. The rezoning and preliminary plat public hearing was scheduled for July 9, 1996. (Note: No quorum present for either committee. Present: Tourville, LaMotte, Johnson and Fogerty.) Those present discussed the possibility of combining the two committees or to have joint meetings every once in a while. Staff will check the state statute regarding combining committees. The pros and cons were discussed as to dealing with the smaller issues such as the hockey rink. These could handled by the Public Works Director or a paid coordinator could be hired to take care of the rink and attendants. Tourville would not like to see a 7 member committee unless it is necessary. In combining the committees it would possibly create a more stabile committee with less turn over. Roles and definitions would have to be made, but the overall operation of the committees is to provide communication, planning of the city, and ideas and input to the council. Chairman Tourville called the regular meeting to order at 7: 07 p.m. PRESENT: Tourville Welk Vermeulen ABSENT: Drilling LaMotte PUBLIC HEARING - VARIANCE REQUEST FROM MELINDA HUGHES, 7187 W. ROBIN LANE Ms. Hughes is requesting to erect an attached single car garage (14'X25') for storage and car. The garage would encroach on the side yard set back by 4 feet. Ms. Hughes stated that the only change from the time of application is that the garage depth would be 25 and was put on the application at 24 feet. Tourville questioned the position of the windows for the house next to hers and she felt that it shouldn't be a problem. No residents were present to oppose or comment on the request and none were received by staff prior to the hearing. MOTION by Welk, second by Vermeulen to close the public hearing at 7:10 p.m. APPROVAL OF MINUTES The minutes for May 7, 19~6' were tabled due to lack of quorum present for that meeting. PZ6-4MM 1 " Planning & Zoning Minutes of June 4, 1996 Motion carried unanimously. APPEARANCES Randy Neugent could not appear due to other commitments. ROCKEY GOERTZ - HENSEL PROPERTY PROPOSAL Mr. Goertz presented a proposal for the Hensel property. He is requesting to rezone the property except for the C1 district to R2A. The sketch plan he provided he said was just that because the boundaries of the C1 district are unclear. Mr. Goertz pointed out that the property adjacent to this property (on the other side of the creek) is also zoned R2A. Mr. Goertz is proposing high density single family homes, although he stated he could easily get in 18 townhomes. Other comments regarding proposal: - He would keep the existing home there and do a lot split selling the home on a 4.9+/- acre parcel. - Would extend Centerville Road to the south. He did comment that he has been trying to located the property owner for the property to the south of Hensels (LeRoux) to see if they would be willing to sell. Although about the only property that is "up" land is in the area of the Centerville Road line; he may perhaps be able to get a cul-de-sac to the east just like what is proposed now. - Water and sewer - city installed improvements. - It would bea nice blend with the current area. - 19 lots including the existing house. - lots would be higher that Clearwater Meadows. P&Z discussed the lots directly to the north that are 350 feet deep but are only 90 feet wide. This area is zoned R1 and should be rezoned to feet the lot sizes in the area. Mr. Goertz stated that his purchase agreement with the Hensel's is contingent upon rezoning the property by the end of July. Tourville stated. that there h.as been someuudfscussion in the past about Centerville Road continuing. He added that this would alleviate some of the traffic from Mill Road once it ran all the way through. Tourville stated, and Mr. Goertz agreed that it would be handled in the same manner as Clearwater Meadows - - - The rezoning going through contingent upon approval of the final plat. P&Z rescheduled their July 2nd meeting for July 9th and directed PZ6-4MM 2 " Planning &, Zoning Minutes of June 4, 1996 staff to schedule a rezoning public hearing. EAGLE PASS Trudi Breuninger informed p&Z that the developer is looking to schedule the preliminary plat / rezoning public hearing for June 25th. There were some issues that needed clarification from staff and the engineer regarding the plat. P&R had some questions also as to the proposed park property. P&Z discussed cluster home developments, open space (likes and dislikes) and carne to the consensus to discuss the project in more detail at the July meeting. Tentatively scheduling the public hearing for the August 5th meeting. ACORN CREEK OUTLOT Vermeulen questioned the new home that is being built on an outlot in Acorn Creek whether a retaining wall was required. Staff will investigate. FENCES Vermeulen questioned if an orange snow fence is legal fencing. There is a home on Peltier Lake Drive that still has this type of fencing up and would like a letter sent to the homeowner with a copy of the ordinance pointing out that this is not a suitable fence material. Jim March introduced himself to P&Z and addressed them regarding the fence section of ordinance 4. As per March's memo dated June 4, 1996, issues that he would like to see P&Z request: Is six feet adequate for a security fence in an industrial district? More that likely any security fence in the industrial park would be a standard 8' fence. As development occurs, every fence would probably require a variance. A paragraph should be added to reflect fences used as part of a recre~~JC:>IlaJ sport. This type.. of fence should be allo!led contingent upon securing a building permit and approval by planning and zoning. In my opinion, this type of fence should not require a variance based on the fact that the City would probably require a fence for safety purposes on a site that is allowing (volleyball, softball, etc....). Mr. March pointed out that the Council is reviewing the fence issue at Kelly's Korner currently. Tourville agreed that a variance should not be required when it is PZ6-4MM 3 Planning & Zoning Minutes of June 4, 1996 for a safety or security reason. Mr. Bisek's board fence has been there for a number of years and just installed the volleyball courts last year, Tourville added. Tourville stated that the fence section is fairly new and should be addressed as a future agenda item. ORDINANCE 4 Tourville stated that once the Comprehensive Plan is complete that he would like to have Dean Johnson assist in revising Ordinance 4. Mr. Barott is requesting that each home be split off to its own. parcel number. His intent is to sell 7121 Main Street. P&Z questioned the engineer's comment regarding drainage and utility easements as per his letter dated April 18, 1995. P&Z requested that MSA be contacted to determine the location of these particular easements. Mr. Barott also expressed concern for a storm sewer outlet that runs down. a portion of the vacated road and empties on the lake side (property owned by St. Paul Water Dept.). These properties currently don't have any drainage problems -- the back drains towards the lake and the front towards the street. Mr. Donald Opp, 1554 Holly Drive, questioned if the apartment building was on a lot by itself Mr. Barott replied no and added that the St. Paul Water Dept. owns most of the lakeshore. APPEARANCES PZ5-7MM.WPS 1 Planning and Zoning Minutes of May 7, 1996 Joe Kaim - Mini Storage Proposal Joe Kaim has submitted a proposal for mini storage on lot 6 of the industrial park. Mr. Kaim was present along with Real Estate Agent Kris Krengel. Their proposal is for six (6) - 30 x 150 buildings (4500 square feet each). Both Mr. Kaim and Mr. Krengel questioned the need for a sprinkler system with these comments. 1. Buildings are not for certificate of occupancy purposes. 2. Mr. Kaim made 17 random call to other mini storage sites and none are sprinkled. Staff was requested by P&Z to get clarification from Mr. Patzer on sprinklers. Other comments Mr. Patzer made on his review of the plans: the use is not permitted as a principal use or with a special use permit. Metal walls are still questionable according to the ordinance, it has been stated in the past and to previous developers that this is not allowed. And due to the soil conditions a floating slab would not be suitable, a continuous footing would have to be installed. Mr. Krengel commented that some cities don't include this as a permitted use in their ordinance anywhere because it is a new phenomenon. Visibility and exposure is very important, that's why the site on Main Street was chosen. Mr. Kaim provided pictures of existing buildings similar to his proposal. He stated that his intent was to put up a quality project and not to throw up a pole building. There would be no outside storage. Mr. Kaim questioned whether fire barrier walls could be installed for buildings that are used for storage only. Once again staffwill check with the building inspector. The building would be of steel frame work with the look of a concrete flush end. The sides would be architectural metal panels along with the roof and doors. They also added that there is 200 feet of green space in the back which is used for drainage and wetlands. Total number of proposed units - 180-200. Mr. Wilharber questioned if there would be an on site manager - NO. Questioned if there would be bathroom facilities - NO. Mr. Wilharber stated that there would be no use for city water or sewer. Mr. Kaim stated that it would be on a call for an appointment basis. Keyless entry with a keypad and security codes for the users. Planning and Zoning comments: Tourville: The zoning is industrial but the ordinance would have to be changed for the use. PZ5-7MM.WPS 2 . . Planning and Zoning Minutes of May 7, 1996 Welk: The particular siding proposed is not allowed. Tourville added that the ordinance does address how much of a building can be metal. Tourville: The city has discussed running water and sewer for businesses that employ people and the tax: base would service the community. Tourville stated he doesn't disagree that it is needed, but suggested looking at another site within the city. Mr. Krengel stated that the visibility off the freeway is way the site was chosen. Mr. Kaim stated the it would be a 2 phase project with 3 buildings in each phase. Total project cost $400,000+. Mr. Krengel stated the industrial property is the most conducive to new projects and is the most likely zone for such a project. Tourville stated that the TIP district was established to help bring in businesses and employment to the city. P&Z referred this issue to the EDC committee for comment. It would then go before the Planning Commission once again for ordinance 4 discussion. David Route stated that he has been looking for a site for mini storage also. Lino Lakes has not been receptive to the idea. The occupancy rate is at 90% or better throughout the metro area. Mr. Route added that it is very rare to have facilities on site. Melinda Hughes, Garage Variance Ms. Hughes stated that the builder must have received a variance to build the home with a 13 foot front setback and requested that this variance be grandfathered in the same one. She would like to build a single car attached garage infiinging on the side yard setback by 4 feet. Tourville stated that they have granted other variances in the same neighborhood for garages. Not concerned about the front setback, that is pre-existing but stated a variance would be needed for the side yard setback. Public hearing for such a variance request to be scheduled for June 4, 1996 at 7:00 p.m. Utility and drainage easements for this property are to be researched. Randy Neugent, Fence Variance Mr. Neugent had to leave the meeting due to previous commitments but P&Z did discuss the issue briefly. Mr. Neugent will be asked to the next P&Z meeting. PZS-7MM.WPS 3 Planning and Zoning Minutes of May 7, 1996 OLD BUSINESS Barott Lot Split / Variance Tourville commented that the county already has the comer lot and would be opposed to selling the existing homes to the county and giving up a beautifullakeshore site for a home. Tourville also added that he would like to see the area turned back into a beach again. Mr. Barott stated that he is being cautious on selling is that Mr. Ivan Barott would have to pay capitol gains on property sold. There was some discussion on the history of the homes on Main Street. MOTION by LaMotte, second by Welk to approve the Barott lot split and necessary variances, contingent upon clarification of the city engineer regarding the drainage and utility easements. Motion carried unanimously. Ordinance 4 & 44A P&Z discussed Mr. Patzer's memo on minimum area of structures. Tourville stated that he had spoke to Dean Johnson about working on this ordinance once the comp plan is complete. P&Z concluded that back a number of years ordinance 4 went through a similar amendment phase but that public hearings were never held to make changes. Staff is requested to research this to find the marked up copy of ordinance 4. MOTION by Tourville, second by LaMotte to table Ordinance 4 and 44A. Motion carried unanimously. NEW BUSINESS Safety Concern - Aerator Trudi Breuninger described the complaints that were filed last fall regarding the aerator keeping the pond open, keeping kids from ice skating. The city does not have any easements along the pond or to the pond. Because the entire pond is on private property - each lot owning a portion of it, it would be the Attorney's position not to get involved. This would just put the city into liability. Wilharber added that it may be an issue under the nuisance ordinance, but stated his opinion a judge would throw it out. PZ5-7MM.WPS 4 . . Planning and Zoning Minutes of May 7, 1996 Consensus ofP&Z that the city should not be involved due to the pond being on private property. Telecommunications The city has received two requests for antennas. One from Sprint Spectrum to put an antenna on the water tower. And one from TEA Group to erect another antenna tower adjacent to the existing tower. It was mentioned that the existing tower was a hot issue, a couple of public hearings were held in order for them to build it. Wilharber added that the civil defense was turned down for their alarm because it would have caused interference with the telecommunications. Tourville stated that if it were a whip antenna to be installed on the water tower that he would not have any objections. Welk stated that the request for the new tower and water tower specifics are to vague to make a recommendation. P&Z request that staff obtain more information. MUSA Application Dean Johnson, Resource Strategies prepared an application for MUSA expansion to put the entire Eagle Pass Development of 66 acres into MUSA. Mr. Johnson is confident that Met Council will approve. LaMorte stated that the lot sizes still bugs him (smaIl lot sizes). Welk added that she like the open spaces. APPEARANCES - Eagle Pass The following appeared before the commission regarding the Eagle Pass concept plan: Rick Harrison - Designer Tony Emrich - Owner Mike Quigley - Owner Rep. Gary Gor-em - Owner Larry Olson - Engineer/Surveyor Mr. Harrison started by describing what the development contains: 48 - single family townhomes, 34 _ twin townhomes, 62 single family lots. He stated that this concept is very preliminary, they need to establish the wetland areas yet. This concept provides open spaces and not looking at another home provides the illusion of additional open space. Mr. Harrison said the secret to the illusion of a big lot is not where the house sits on the lot but how far away the surrounding homes are. Staggering the townhomes give more views to the owners and not having the garage doors face the street will provide a cleaner look when driving on the street. Mr. Harrison also added that the single family lots in Center Oaks won't be crowded by the townhomes. Typically cities do not like to maintain private drives. Private drives would only be for the twin homes and be maintained by dues. Mr. Emrich estimated the cost of the single family homes to be $130-170,000. ~ PZ4-2MM.WPS 1 Planning and Zoning - April 2, 1996 Meeting Minutes Tourville: would like to see tot parks or neighborhood parks installed. Wilharber: concern for the park proposed on the north along the creek, water attracts children. Centerville residents don't like the greenway concept for the creek. Another concern for the roadway on the southwest comer with the abutting property. Otherwise likes the basic idea and concept. Mr. Emrich stated they will get input from the committee and council and have the soil borings done prior to preliminary plat. MOTION by Welk, second by Vermeulen to accept the sketch plan of Eagle Pass a Planned Unit Development (PUD) consisting of single family lots, single family townhomes and twin homes. To start phase one of the project contingent upon adjusting the MUSA boundaries. Vermeulen expressed a concern for the fast growth and how it would affect the limited school space already available. P&Z discussed the Centennial School District, what it has to offer and where the revenue is received and how much. LaMotte Park Property / City Administrator Wilharber provided P&Z with an update on the status of the park acquisition and also on the administrator. Motion carried unanimously. Pawn Shops Drilling stated that the legislature is passing a bill that has already been through the house and the senate. This bill will address pawn shop fees, merchandise, length of hold, etc. Currently there are no state laws that regulate pawn shops it has been left up to the discretion of the city. The decision on the bill won't come through until April, therefore this issue will be table until such time. NEW BUSINESS On-Site Sewage Treatment P&Z requested that more information be gathered to answer the following questions: PZ3-19MM. WPS 1 Planning and Zoning Meeting Minutes of March 19, 1996 What are the state requirements? -- How are inspections done? -- What is the cost of the inspection? Staffwill gather more information and return to P&Z when it has been obtained. PUBLIC HEARING The public hearing on the preliminary plat for Clearwater Meadows was called to order at 7:25 p.m. Rockey Goertz stated that the main difference in the preliminary plat from the first one shown to the commission is the realignment of the southern portion. Goertz also presented a colored map showing the retention ponds that would hold water and those that won't. Mike Johnson, 7046 Brian Drive questioned the drainage and utility easement for lot 21 and also mentioned that his driveway will still be over the property line by 2 feet. Goertz responded that if they would move the property line over any further a variance would be needed for that lot -- it would not meet the city ordinance requirements. The Johnson's home would still meet the set back requirements of the ordinance. Kathy Johnson stated that the property was obviously sold to them fraudulently. Although the preliminary plat offers them a better resolution than the previous plat she still is disappointed. Goertz stated that the ditch behind the homes on the east side of Brian Drive would be regraded and the trees on his property would come out. It will be a wide swale easement. Gerry Peterson, 7080 Brian Drive agreed with Dan Tourville when he stated that the trees are so grown up that if they are not disturbed there would be little or no erosion. Mr. Peterson stated that the ditch is currently 3-3.5 feet deep. Kevin Fogerty, 7088 Brian Drive questioned the drainage flow. Goertz confirmed that it would be further east in the regraded swale area. Tourville stated that the berm area would still be included but would be on private property. Goertz confirmed that and switched the focus to the retention ponds. The retention pond to the north would be used for storm water and would flow out at a certain level that would be lower that the basement levels. This pond would be owned by the property owner and would be noted on the deed that they cannot fill it in or build with that area. Goertz stated that he should have a grading plan approved by RCWD for the city counc~ meeting next week. PZ3-19MM.WPS 2 Planning and Zoning Meeting Minutes of March 19, 1996 Rehbein would be responsible for the retention pond by the creek which would actually be a part of the creek and would just widen in that area. Utility services would be provided at the back of the lots for both sides of Brian Drive. During construction the normal street pattern will be followed. Brian Drive with be used for the extention of that and the new street will be used for those homes. No alternate street will be installed. Goertz stated that he realizes that it is contingent upon the flood levels going through. He feels that FEMA is really close and that the city should hear something within a week or two. Leon L'Allier, 1973 Main Street stated when Comer Express was permitted to be built there was a stipulation put on by the county that traffic was suppose to enter into the lot from Main Street and exist off of 20th. With the added traffic of additional houses Mr. L'Allier would like to see this stipulation re-enforced. Councilmember Helmbrecht asked that it be put on the next city council agenda. Chairman Tourville called the public hearing to order at 7:09 p.m. PRESENT: Tourville Welk Vermeulen LaMotte ABSENT: Drilling PUBLIC HEARING - CLEARWATER MEADOWS REZONING Rockey Goertz explained that the area of the project that needs to be rezoned consists of the area south of Brian Drive, which is in the MUSA, currently zoned R-3 and on the east side of the project approximately an 85 foot strip of commercial property to residential. Kathy and Mike Johnson, 7046 Brian Drive expressed some concerns regarding lot 21, of block 2, because the front of their house would face the side of the new house. The commission and Mr. Goertz went over the MSA letter dated February 6, 1996 regarding the preliminary plat and grading plan review. 1. Both filling and excavation are proposed within the floodway limits of Clearwater Creek. Typically, a City administering the floodplain management program will not allow fill within the floodway, except in minimal amounts. Goertz: They have applied for a permit with Rice Creek Watershed District. And Rice Creek is handling this item. 2. A proposed drainage and utility walkway easement is shown, but it is not clear how access across the creek will be provided. Goertz: Asked P&R for participation and P&R chose cash in lieu of a bridge or trail. 3. The grading plan should clearly show the minimum building elevations based on the floodplain maps. Elevations should be shown for both the residential area and the commercial (Outlot D) area. Goertz: 905 elevation needs to be shown, not a problem. PZ2-6MM.WPS 1 Planning & Zoning Commission -- February 7, 1996 Minutes 4. The grading plan shows Clearwater Creek widened south of Outlot D. A low flow channel should be maintained through this area. Goertz: This will be taken care of by Rice Creek and the Engineers before the permits are issued. 5. Slopes along the north property line of Outlot D are steeper than 4: 1. Goertz: The slopes are steep and will be seeded with wild grass seed. Intentionally made them that way. 6. A berm is shown between the residential development and Outlot D and the commercial lot north of Outlot D. However, no landscaping plan for this berm is shown. If the City will require landscaping, this should be shown on the plan. Goertz: The berm is not required but would be more attractive an alternative would be a redwood fence, which would look nice for the first two years. The berm is 8-10 feet. The upkeep is not the residents responsibility it would be the property owner of Outlot Donee they come before the city with a proposal. 7. The proposed pond on the northwest comer of Outlot D outlets to the east, into a ditch. However, the ditch appears to be very flat. The ditch slope at this location should be adequate to drain water from the pond to the 20th Avenue ditch and to Clearwater Creek. Goertz: Wrong. It flows west not east, and will talk with Dave Nyberg about it. 8. A drainage swale will carry stormwater through the back yards of Lots 24-27, Block 2. The slope through this area is approximately 0.3%. The slope should be increased to at least 1% to provide better drainage. Also, the swale should be movedfarther from the proposed houses. Goertz: Will deal with even if the houses have to be raised. 9. The proposed housedfor Lots 23 through 26 are shown with 5.0 feet of depth between the garage floor elevation and the walk-out elevation; however, for other houses, the difference is 3.5 feet. No explanation of this difference is shown. Goertz: Complying with the minimum basement floor. Difference is so that the driveways would not be flat. 10. Two sedimentation ponds are shown to provide stormwater treatment before discharging stormwater to Clearwater Creek. The ponds should be designed to provide for erosion control for both the design storm and the 100-year event. PZ2-6MM.WPS 2 Planning & Zoning Commission -- February 7, 1996 Minutes Goertz: Rice Creek requested and will comply with their requirements. 11. Overflaw swales should be shawn over each storm sewer pipe, from the street to the ponds. Goertz: Not a problem. 12. The sediment pond shawn near Lots 21,22, and 23, Block 2, encroaches on the backyards of the lots. The pond should be moved closer to the creek to provide for increased area in the backyards. Goertz: Rice Creek issue. 13. Lots 1 though 5, Block 1, do not indicate the style of home to be constructed Goertz: Not a problem. Was not a aware it was required. 14. Catchbasins should be provided at the intersection of the west cul-de-sac and Brian Drive to collect stormwater from the street that will be extended to the south. Goertz: Questionable if it is required because Brian Drive is not a curbed street. 15. The berm and ditch along the backs of Lots 15-18, Block 2, encroach onto the backyard areas. The berm slope appears to be near a 2: 1 slope. The Developer's agreement for the project should include a minimum 25-foot setback from the house to the toe of the berm. Goertz: Intended not to grade the area because of the grown trees. Kevin Fogerty, 7088 Brian Drive, the ditch needs to be maintained. Goertz: If the ditch needs to be graded the trees will come down to create a swale, currently not proposing regrading of the ditch. ** Need alternatives from the engineer. 16. The contours on Lot 2, Block 2, are drawn incorrectly. 17. The contours on Lots 14 and 15, Block 2, are drawn incorrectly. Goertz: Not a problem. 18. Anoka County has indicated that 120 feet of right-of-way will be necessary for reconstruction purposes. The plat should be revised to shaw the required side lot drainage and utility easements if the 120 feet of right-of-way are ever acquired PZ2-6MM.WPS 3 Planning & Zoning Commission -- February 7, 1996 Minutes Goertz: Simple fix. 19. Adequate drainage and utility easement should also be providedfor any proposed widening of County Road 54. 20. The Developer should indicate to the City who will be deeded each Outlot shown on the preliminary plat. Goertz: OK 21. The drainage, utility, and walkway easement across the creek is not adequate for a trail easement. A separate trail easement will need to be dedicated at the time of plat approval. An alternative would be for the City to require access through an outlot. The outlot would also have 5-foot drainage and utility easements along the abutting property lines. Goertz: Has a question as to how adequate the easement needs to be. Will discuss with Dave Nyberg. 22. Lots 25, 26, and 27, Block 2, do not have adequate rear yard drainage easements for the swale shown on the grading plan. Goertz: OK, even if the houses have to be raised. 23. Lots 1 through 5, Block 1, do not have adequate rear yard drainage easements for the swale shown on the grading plan. Goertz: The swale should be centered on the property line -- i.e. five feet on each side. Should not be required to put the entire drainage easement on the plat. 24. A 20-loot wide drainage and utility easement should be provided on the north side of Lot 1, Block 1, for a connection to the watermain system. Goertz: Again the easements should be shared between the two lots, not putting the full easement on one property. Questioned whether Brian Drive residents have any easements? 25. A width of 15 feet is shown for the creek, but it is unclear if this is a separate easement from the drainage and utility easement. The current creek right-of-way is 60 feet. Goertz: Wasn't sure how to show easements, not a problem to fix. 26. Lots 7 and 9, Block 2, do not meet the minimum width at the building setback. Goertz: Lines will pivot, it is an adjustment that can be made in the computer. PZ2-6MM.WPS 4 Planning & Zoning Commission -- February 7, 1996 Minutes 27. The Developer should provide documentation that the north branch ditch extending through Outlot D does not have Anoka County easements or right-of-way. Goertz: Rice Creek issue. 28. The plat shows Outlot E designated as a drainage and utility easement. Outlot E should be shown as a landscape easement for the berm shown on the grading plan. Goertz: Would like to see the berm stay, there are way of making something grow. 29. All property lines along the Olson property should be provided with 10-/oot wide drainage easements, rather that 5-/oot wide easements. Goertz: OK 30. The cul-de-sac length to the center of the cul-de-sac is 790 feet. The length to the back of the curb is 835 feet. According to City Ordinance, cul-de-sacs shall have a maximum allowable length of 800 feet. Goertz: Assumed it was measured from the center of the street as done in other cities. Centerville's ordinance is vague. Could loose 2 lots if variance is needed and not granted. Tourville questioned the drainage easements. Goertz replied that the drainage easements are always on the perimeter of the lots. To establish better drainage they could raise Brian Drive to pick up more drainage or put in a catch basin. Goertz added that the ponding areas are designed to be dry unless it rains considerably. There are however two larger retention ponds. The Watershed doesn't want deeper ponds. K-G Development had anticipated deeper ponds therefore they will be short on dirt -- about 21,000 yards short. The reason for not having deeper ponds was that Rehbein is required to have a certain amount of mitigation area because of other areas where he has brought in a considerable amount of fill. Sedimentation ponds may not be required. They are hard to maintain and whenever they can be eliminated they will be. Fogerty asked about the sanitary sewer and water system. Goertz answered that they will be looping the water lines. Tourville made comment to the scope in the feasibility study and asked Goertz to comment also. Goertz stated he can't imagine why it is there. The sentence in question: An estimated cost was also determined for the reconstruction of Brian Drive between the north property line of the development and Main Street. PZ2-6MM. WPS 5 Planning & Zoning Commission -- February 7, 1996 Minutes Goertz stated that if residents have a complaint about a mess left in the street that they should call the developer or city hall and they will clean it up. Discussion regarding traffic management. The feasibility study states that access during construction of the site will be from Main Street and 20th Avenue. The City should consider requiring the Contractor to cross the creek to access the area south of Brian Drive, rather than travel along Brian Drive. Goertz stated that this is not really feasible. Rice Creek would not allow a temporary road over the creek for the entire time of construction because it may take up to 2 years to develop houses. Goertz confirmed that the development is based upon on new flood plain numbers once they are approved by FEMA. The proposed elevation would be 905, the existing elevation is 908 and the development does not work at that elevation. Question was raised as to what costs may effect the current Brian Drive residents -- road work, water, etc. And Fogerty also asked ifthere are any plans to widen old Brian Drive to match the new one. Wilharber answered that unless the citizens petition for the reconstruction or road work to be done that it would not. As for the costs to Brian Drive residents, those residents on the west side of the street will have water lines running down the back side of their property. Therefore the would incur a hook-up charge when they choose to connect to city water. Tourville commented that the city may want to look at doing street work to Brian Drive. Because in the future people would use Brian Drive as a short cut to Main Street from, for example Center Oaks. Question as to how much work has been done to Brian Drive in the past. Fogerty said that Brian Drive is original but that it may have been top coated. Discussion of assessments as noted on pages 5 & 6 of the feasibility study. The cost that could be assessed to the residents is an estimated rate of $2445.30. Fogerty expressed a concern for water supply to the residents on the east side of Brian Drive, he doesn't want them to become an island without service. In the future then when they would want city water the assessments for those 6 homes would be high. Goertz stated that it was discussed and the best way would be to rip up the street and run water down Brian Drive. (This may require those residents to petition for utility and street improvement). An alternative to provide water to those residents on the east side would be to provide a larger "T" in back of their property off the develop to allow more home to hook up. Goertz stated he would comply with the request to check with the county on the driveway to lot 2, block 2. PZ2-6MM.WPS 6 Planning & Zoning Commission -- February 7, 1996 Minutes Mr. Johnson asked about the designs and cost of the homes proposed in the development. Goertz stated that the styles would be split entry or two stories and would be approximately $150,000 with lots selling at about $30,000. Mr. Johnson raised another concern for the home on lot 21, block 2. Because the property boundaries in which the Johnson's own was mislead to them. Mr. Johnson stated he is opposed to plat for only that reason. And although they appreciate having outlots b and c deeded to them the concern for the house that would be on lot 21 would be really close to their already existing home. Goertz stated it is hard to determine what kind of house goes on a lot and if to many restrictions are put on a lot it makes if very difficult to sell. Goertz suggested that the garage be put on the north side instead of the house. Tourville stated that this issue should be finalized prior to approval of the preliminary plat. Wilharber queried the commission regarding any concerns for rezoning the commercial property . LaMotte asked about where the responsibility would lie for maintaining the berm. Goertz replied that Rehbein is going to retain the title for that portion of the plat. When the commercial site plan is brought before the city that new owner would be notified of the responsibility. Outlot D has 100,000 square feet of buildable area, that is after the mitigation and easements. APPEARANCES RECOMMENDATION FOR REZONING FOR CLEARWATER MEADOWS Discussion of Ordinance 8, page 7 regarding the definition of a cul-de-sac and where the measurements should be taken from -- needs to be clarified. PZ2-6MM.WPS 7 Planning & Zoning Commission -- February 7, 1996 Minutes Welk stated that the berm would be a good buffer between the commercial property and the residential and with the wetlands and mitigation area required the strip of commercial property is non-buildable. The effects for Eagle Trucking are minimal because even though they would like to expand the existing building is non-conforming. Tourville agreed with the committee that the berm is good but would like to see it landscaped with bushes or evergreens. Goertz stated that it is possible for them to put evergreen on outlot E but when outlot D goes to develop that new owner should be responsible for landscaping. Tourville stated that he has no problem with the rezo~ng and commented that the city should be flexible to make things work. Wilharber commented that the city has very little commercial base and is not if favor of rezoning the commercial property to residential. Summary of the issues: water to existing residents on Brian Drive, development of the tree farm and ditch issues. Wilharber stated that no way anyone can get in to clean the ditch and when homes are built it will make it more difficult for upkeep. Fogerty stated he would rather see homes behind him rather than commercial or industrial. Fogerty also commented on the ditch, it is currently not in the right spot and although he would hate to see the tree go the drainage ditch needs to be corrected. Wilharber expressed concern for the loss of 80 feet of commercial property. P&Z feels 80 feet would not impact the development of Outlot D. Tourville asked ifit is possible to shorten the street so that the commercial property would not have to be rezoned. Goertz stated he would lose 10-12 lots because the lot size requirement would not be met. MOTION by Welk, second by Vermeulen to recommend the rezoning of the commercial and R3 district to accommodate the Clearwater Meadow project for the reasons mention above with the contingency of the preliminary plat approval. Therefore if the plat is not approve the property will not be rezoned. Motion carried unanimously. ORDINANCE 4: MINIMUM AREA OF STRUCTURES Vermeulen stated that they have discussed this previously and determined what the intentions were. Tourville stated that he would like the wording then clarified to meet those intentions. PZ2-6MM.WPS 8 ~ Planning & Zoning Commission -- February 7, 1996 Minutes Discussion on styles of homes and what the square footage is and what rooms or where the dimensions should be taken from. The committee also compared examples from other cities requirements. Consensus of the committee to change the ordinance to be like Lino Lakes. "Minimum outside dimension, floor area". A public hearing is required to change ordinance 4, therefore at the next meeting they will look at other items they would like to see changed prior to the public hearing. SNOWMOBll..E ORDINANCE Tourville stated that it is not really a P&Z issue it is more of a P&R issue. Fogerty stated that the trail association is very active as far as contacting the county for trails in the ditches and also the private property owners. Tourville stated that the hot spot issue is on Main Street. One to be able to use Main Street and also to be bi-directional. Tourville also noted that trails are not groomed on lakes and that trails are negotiated yearly by associations and clubs. Fogerty stated that snowmobilers would prefer a trail versus riding on the street because it is very hard on the machine to be drive on blacktop. And also added that until the sub- committee come to P&Z or P&R with a proposal there isn't much to discuss. Welk stated that the association/clubs needs to get together a proposal for the council to look at. Vermeulen agreed. Tourville stated that Lino Lakes and Centerville have similar ordinances and that they should be they same as long as the state statutes are being followed. Tourville also mentioned that snowmobilers are using his property without permission. This does put limitations on the use of his property as far as what crop can be put in the ground in the spring, when they to "trespass". However he stated that he would be willing to work with them. Councilmember Buckbee noted that Lino Lakes has a good description in their ordinance. Buckbee also added that the size of the lot determines the size of the building in some cities. Rockey Goertz, Klosner-Goertz Homes, Inc., stated that he has a couple of pole barn buildings in Lino Lakes used for commercial/industrial and when Lino Lakes changed their ordinance 8-10 years ago to exclude pole buildings, Mr. Goertz said it was the best thing they have done. Goertz still has his buildings their but due to the change in ordinance they buildings in the surrounding area are of concrete and have increased the value of property. Goertz also noted that Blaine is very vague on their description of building type but are real thorough with a site plan review, therefore controlling what comes into their city. APPEARANCES Rockey Goertz, Klosner-Goertz Homes, Inc., appeared before the planning and zoning commission with a concept plan for Clearwater Meadows. A single family housing development with 32 homes. The discussed the wetland mitigation area being used as a sedimentation pond. Mr. Goertz would like to berm the area butting the commercial zone. This would be landscaped and used as a buffer zone between the two, this would also be a noise barrier. Mr. Goertz has started the process with Rice Creek Watershed District and has spoke with Kate Drury. The area zoned R-3 is already within the MUSA boundary and was stated that was an area that may have been missed when completing the zoning map. The outlots B & C would be deeded over to the property owner that is currently using the space. This area was no use to Mr. Goertz and as he says, it makes the plat cleaner. Mr. Goertz described his idea for a trail easement. Because there was not land set aside for a park, he offered his suggestion for a foot bridge between lots 12 & 13 and lots 23 & 24. CounciImember Buckbee stated she would be in favor of a bridge - it adds charm and character. Mr. Goertz stated they have looked into many different styles and the cost would be approximately $20,000. The Planning and Zoning Commission said that the park dedication and trail system would have to be determined by the Park & Recreation Committee. The lots that have the mitigation area in their backyard would have a wetland easement. Meaning it would be the responsibility of the property owner to maintain the area but that nothing could be built on that area. This would be made know to each buyer and also written in the title work. Mr. Goertz stated his motivation for developing in Centerville is because Lino Lakes is becoming to expensive. Mr. Goertz currently has project in Pheasant Hills, Birchwood Acres and in Blaine (between 85 & 95 on the west side of the freeway), to name a few. Mr. Goertz stated the lots would sell for 29,000 - 30,000 and homes would vary from $115,000 to $150,000. Discussion of Brian Drive - at the end of the road would need to "T" off or have a temporary cul-de-sac. PZI-9MM.WPS 2 P&Z meeting minutes - January 9, 1996 Discussion of utilities: There is water available on Main Street and also behind City Hall. They would be able to loop the water system through the cul-de-sacs between the same lots mentioned above for the trail easement. A. LaMotte stated that he doesn't see any reason why it can't be rezoned and stated that the concept was good. K. Welk stated that this plan blends better with the pre-existing homes than the previous concept plans brought before them. MOTION by Tourville, second by LaMotte to approve the concept plan for Clearwater Meadows project. Motion carried unanimously. P&Z scheduled the re-zoning hearing and preliminary plat hearing for February 6, 1996. It was suggested that P&R be called for a special meeting to discuss the park dedication. ORDINANCE 4 - MINIMUM FLOOR AREA Tourville stated that Paul Palzer came to him for clarification of the minimum square foot floor requirements. Example: the 1200 square feet - Is that for each level or a total? What is the intent of the ordinance? There was discussion on what size the house would be in order to make the minimum square footage of each district and would the roof meet the requirements also. P&Z requests that Paul Patzer provide a written recommendation on how he feels it should be defined. The interpretation to be the same for all districts. ORDINANCE 44A - BUILDING DESIGN MOTION by Tourville, second by Welk to table ordinance 44A. SNOWMOBILE ORDINANCE There was discussion of the snowmobile complaints being received. Tourville stated that Centerville should organize their own club to establish trails. Tourville stated that if the Council allows the snowmobiles to go on Main Street then the police will have to enforce that to keep them out of the yards. LaMotte stated that the same should apply for ATVs. Four-wheelers used for plowing should be able to drive down the street to get gas or even to plow out a friend or relative. Staff is to check into what Lino Lakes has for ATVs. Tourville stated he has no problem with granting snowmobilers to drive on Main Street as long as it is enforced. CITY SIGN Tourville explained the city sign proposal brought before EDC. The sign would be made of injection mold plastic with the city logo and a reader board. This would be a lighted sign. Tourville asked ifP&Z would be willing to provide some funds to pay for the sign. Welk stated she would like to see a sign on the edge of the city saying "Welcome to Centerville" . Tourville commented it meets the medium density of 5- 12 dwelling units per acre. Special Use Permit - Steve Gaustad ofIntegrity Systems requested a special use permit to conduct light industrial business in a commercial zoning. Gaustad intends on running a small manufacturing company which makes custom automated conveying systems. Tourville asked if it would be like a machine shop. Gaustad replied yes. Wilharber asked about noise. Gaustad said it would be very minimal. Wilharber asked about odor or smells. Gaustad replied there shouldn't be any odor. Tourville asked if the city was aware of any complaints. Wilharber said fumes and odor. Wilharber asked if Gaustad had signed an agreement with Bob Sorgo Gaustad said it was pending, based on the special use permit. Tourville asked if there was any special accommodations needed. Gaustad no. Wilharber asked if Gaustad was willing to hire young people of the area. Gaustad yes. Tourville questioned the city's ability to grant a special use permit from commercial to light industrial. March replied the use is to comply with requirement for granting a special use permit in a commercially zoned area. There has to be no traffic congestion, excessive public expense or be a nuisance. Tourville referred to the ordinances which indicated light industrial/light manufacturing buildings can not exceed 4,000 square feet. March replied the building is 3,000 square feet. Dave Grimmelman Salesman for Bright Key explained each property owner would pay for their own utilities. Rodgers asked what time frame will the townhomes be built. Henderson explained they would build as they go. Rodgers asked how many bedrooms per unit. Henderson said there is two rooms with a loft for an optional third room. Craig Bortzwitz of7214 Unity Avenue, asked if the City's water supply and sewer could accommodate the new development. Wtlharber stated the water is something the city is looking at some options, such as another water tower and/or an interconnect with Lino Lakes. Wilharber responded the sewer capacity is more than enough. Rodgers questioned the availability of the Police and Fire Departments. Wilharber explained the police will naturally go up but currently the police patrol 16 hours per day. Further, Cir- Lex Fire department is the best and has several departments for back up. Hugeback, commented this townhome development will increase the tax base to cover additional public protection. Dave Melby of 1986 72nd questioned the possible future access, east of the property. The roadway also hooked up with the Centerville Road stub from the north. The plan showed 40 lots. Mr. Goertz mentioned the home values would be well into the $200's. Some of the lots were less than the 150' required depth, but all the lots met the 15,000 sq. ft. minimum area size. The lot sizes would need to be addressed with a variance. Mr. Goertz mentioned that he had shared this sketch plan with the . .-----school board. They would like- to see a trail system and keep-the development as shown with Centerville Road not connecting from north to south. Mr. Goertz mentioned he had already spoke with Anoka County regarding the County Road accesses. He indicated there would be no problems. Mr. Goertz has also spoke with the Rice Creek Watershed District. They indicated the mitigation should not be a problem. Mr. Goertz indicated that he would use private financing for the project. He anticipated the project could begin in July of 1997. Mr. Goertz would like to have a public hearing for the rezone required for at the next possible meeting. He indicated January wo~ld be fine. Mr. Goertz has also spoke with the City Engineer regarding water and sewer availability. Mr. Goertz reiterated that "we have all winter to work on this." The consensus of the commission was that the sketch plan will provide as follows: * allow another access to Centerville Road * will provide a buffer zone to the south properties * will be like its own community. Jim March mentioned that the City should look at requiring restrictive covenants that would assure that the homes developed would be of similar value and on the higher end of the market. Mr. Goertz mentioned he would be willing to look at this option. Mayor Wilharber read a letter from the church of St. Genevieve that relayed their ongoing planning process and their inability to commit land for senior housing at this time. Motion was made by T.
