HomeMy WebLinkAbout2003-09-02 P & Z CITY OF CENTERVILLE PLANNING AND ZONING COMMISSION September 2, 2003 Pursuant to due call and notice thereof, the Planning and Zoning Commission held their regularly scheduled meeting on September 2, 2003, at 6:30 p. m. PRESENT: Commissioner Brian Hanson Commissioner Tom Wilharber Commissioner Jennefer Klennert Hunt Commissioner Michelle Lakso Commissioner David Kilian Commissioner John McLean ABSENT: Commissioner Ray COUNCIL: Council Member STAFF: Ms. Moore-Sykes, City Administrator I. CALL TO ORDER 1. Roll Call The meeting was called to order at 6:35 p.m. II. PUBLIC HEARING(S) 1. Mr. & Mrs. Richard Paulsen, Sr., Street Easement Vacation 1764 & 1744 Main Street Chair Hanson opened the public hearing at 6:54 p.m. Ms. Moore-Sykes explained that 1764 and 1744 Main Street have asked for a vacation of the street easement intended for future construction of a road that is no longer needed due to the build out of the Eagle Pass development. Motion was made by Commissioner Wilharber and seconded by Commissioner Kilian to close the public hearin2. All in favor. Motion carried unanimously. Chair Hanson closed the public hearing at 6:56 p.m. Page 1 of 5 Planning & Zoning Connnission September 2, 2003 Meeting Minutes Council Liaison Broussard Vickers asked how the property would be split. Commissioner Wilharber indicated the City's Ordinance dictates that the property be split 50/50. Motion was made by Commissioner Wilharber and seconded by Commissioner McLean to recommend to Council approval of the request to vacate the Clearwater Road easement as requested. All in favor. Motion carried unanimously. Chair Hanson indicated this matter would be on next Wednesday's Council meeting agenda. 2. Mr. Glenn Rehbein Lot Split/Lot Combination (Mound Trail) Chair Hanson opened the public hearing at 6:57 p.m. A representative of Mr. Rehbein addressed the Commission and explained that the request is to split off a small section from Lot 10 and attach it to Lot 9 to preserve some mature trees. He further explained that Lot 10 would no longer have its own access to the lake but would use the shared access with the other interior lots. Commissioner Wilharber asked if Mr. Rehbein still owns lot 10. The representative indicated that he did. Ms. Moore-Sykes indicated that both lots would meet the City's Ordinance requirements. Commissioner Wiharber asked if 1405 would have proper access to Mound Trail. The representative indicated that it would. Commissioner Wilharber indicated there was a concern with the property at 1405 that they have access to Mound Trail. The representative ensured the Commission that 1405 would have proper access. Motion was made by Commissioner Wilharber and seconded by Commissioner Lakso to close the public hearin2. All in favor. Motion carried unanimously. Chair Hanson closed the public hearing at 7:03 p.m. Motion was made by Commissioner Wilharber and seconded by Commissioner Lakso to recommend to Council approval of the lot split/lot combination as requested. All in favor. Motion carried unanimously. Chair Hanson indicated that this matter would be on next Wednesday's Council Meeting agenda. Sedona Homes Variance Request (7035 20th Avenue) Chair Hanson opened the public hearing at 6:36 p.m. Chair Hanson asked if Staff had taken a look at another development built by Sedona Homes and the parking lot situation. Ms. Moore-Sykes indicated that Staff had toured another development and the lot was 2/3 full. Chair Hanson asked how many parking spaces that development had compared to the proposal. Mr. Kel1ier, Sedona Homes, addressed the Commission and explained that the development toured is 17 units with 131 total parking spaces. He then said that the square footage of that development is approximately 2,576 and the one proposed for Centerville is 2,400. The Commission discussed the parking lot requirements and determined that it was appropriate to use the ground floor square footage when determining the parking lot requirements. Commissioner Wilharber asked what would be on the second floor. Mr. Kel1ier indicated the second floor is 1200 square feet for a second story of the main floor office not residential housing. The Commission agreed that no variance for the parking lot is needed. Commissioner Kilian questioned whether the City needed to account for the upper floor square footage for parking spaces. The Commission discussed it but determined, due to ADA requirements, that there would not be office space on the second floor and that it does not warrant parking spaces for that upper floor square footage. Chair Hanson asked if the outlot is to be wild or mowed grass. Mr. Kel1ier indicated the area is a drainage and utility easement. He then said it would be left as wild grass and not maintained because there are times when it is wet but said the landscaping would continue to the edge with trees planted to provide a screen between the building and the pond. Chair Hanson expressed concern with drainage and discussed with the developer the elevations of the property and whether there is potential for water runoff to adjoining parcels. Mr. Kel1ier indicated that the site would be graded according to the requirements and a holding pond created on site. Chair Hanson asked if the developer discussed a dual entrance with the County. Mr. Kel1ier indicated he had asked them but was told no so he plans to have a wider entrance Page 3 of 5 Planning & Zoning Connnission September 2, 2003 Meeting Minutes with a landscaped curb to separate the entrance and exit. He then indicated that he had reviewed the plan with the Fire Chief and he had no issues with it other than the wish to have a fire hydrant on the way into the development. Chair Hanson asked when construction would start. Mr. Kel1ier indicated they plan to plat the units on the north side of the entrance drive and begin this fall. He then said they would build out the other units as the market dictates. Ms. Moore-Sykes asked who would be responsible for maintaining the landscaped island. Mr. Kel1ier indicated the association would be responsible for that. Motion was made by Commissioner Wilharber and seconded by Commissioner Kilian to close the public hearin2. All in favor. Motion carried unanimously. Chair Hanson closed the public hearing at 6:53 p.m. Motion was made by Commissioner Wilharber and seconded by Commissioner Kilian to recommend to Council approval of the site plan and indicate the Commission has found no need for a parkin2 lot variance based on usin2 the 2round floor square foota2e. All in favor. Motion carried unanimously. Ms. Moore-Sykes indicated this matter would be on next Wednesday's Council agenda. III. APPEARANCES 1. Mr. John Thill (1375 Mound Trail) Concept Plan/Garage This item was removed from the agenda as Mr. Thill was not in attendance. IV. OLD BUSINESS None. V. NEW BUSINESS 1. Ordinance #5 Firearms/Language Amendment Proposal Ms. Moore-Sykes indicated the Police Chief and the Fire Chief have asked for this amended language to allow them to destroy confiscated firearms. She then indicated the City Attorney has reviewed the language and his comments are provided. Commissioner McLean asked what the police department is doing now with confiscated weapons. Ms. Moore-Sykes indicated the police department is storing them in the evidence room. Page 4 of 5 Planning & Zoning Commission September 2, 2003 Meeting Minutes Chair Hanson asked if language should be added to allow for the destruction of other dangerous weapons. Council Liaison Broussard Vickers suggested amending the wording to firearms and/or dangerous weapons. Ms. Moore-Sykes indicated there would be a public hearing on this matter. Council Liaison Broussard Vickers asked that this come to Council for discussion prior to the public hearing. Commissioner Kilian expressed concern with allowing destruction after 60 days because it may take more time than that to locate a stolen weapon's owner. He then asked Staff to look into how long other types of personal property are held. Ms. Moore-Sykes indicated that she would ask the police chief to come to a meeting to answer questions. Ms. Moore-Sykes indicated that she would look into whether it was necessary to add other weapons or whether the ordinance already covers that. VI. DISCUSSION ITEMS Commissioner Wilharber asked that swimming pool fencing and the other Issues associated with Ordinance #4 be added to an upcoming agenda. VII. CONSIDERA TION OF MINUTES 1. August 5, 2003, Planning and Zoning Meeting Minutes Motion by Commissioner Wilharber, seconded by Commissioner Kilian to approve the minutes of AU2ust 5, 2003, as presented. All in favor. Motion carried unanimously. VIII. ADJOURNMENT Motion by Commissioner Klennert Hunt, seconded by Commissioner Kilian to adiourn the AU2ust 5, 2003 Plannin2 Commission meetin2 at 7:15 p.m. All in favor. Motion carried unanimously.
