CALL TO ORDER Mayor Capra called the April 14, 2010, City Council meeting to order at 6:30 p.m. II. PUBLIC HEARING(S) None. III. APPROVAL OF AGENDA Mayor Capra made the following additions/corrections to the Agenda: Consent Agenda, move Item 5, Parks & Recreation Committee Recommendation to Amend Their 2010 Budget as Presented by Finance Director to Old Business Item #3 Consent Agenda, move Item 6, Parks & Recreation Committee Recommendation to Council to Authorize Bonestroo Engineering to Commence Bid Process to Construct a Pergola at Corner Stone Park (Containing Options for Wood Timber or Concrete Posts) to Old Business Item #2 Consent Agenda, Item #1, added Page 7a, (Check # 25334–25345) New Business, added Item #6, Page 53, Transient Sales Permit, Window Concepts of MN - April 15-May 15, 2010 City of Centerville Council Meeting Minutes April 14, 2010 City Council to reconvene after the Closed Executive Session to discuss Parade and Planning. Motion by Council Member Love, seconded by Council Member Paar to approve the agenda as amended. All in favor. Motion carried unanimously. IV. APPROVAL OF COUNCIL MINUTES 1.March 24, 2010 City Council Meeting Minutes Motion by Council Member Broussard Vickers, seconded by Council Member Paar to approve the March 24, 2010 City Council Meeting Minutes as presented. All in favor. Motion carried unanimously. V. CONSENT AGENDA 1.City of Centerville March 25, 2010 through April 14, 2010 Claims (Check #25285 – 25333) & (Check # 25334–25345) 2.Centennial Fire District Claims through March 31, 2010 (Check #4222– 4251) 3.Centennial Police Department Claims through April 8, 2010 (Check #7731–7771) 4.Mr. Jason Whitney Request for Encroachment Agreement to Construct Fence within the Drainage/Utility Easement of 7224 Mill Road Motion by Council Member Broussard Vickers, seconded by Council Member Paar to approve the Consent Agenda as amended. All in favor. Motion carried unanimously. VI. AWARDS/PRESENTATIONS/APPEARANCES 1. Mr. Tom Nelson, Cub Scout Rocket Launch, June 5, 2010 – Laurie LaMotte Memorial Park Mr. Tom Nelson, Cub Scouts, appeared before the City Council and stated that the Cub Scouts have held their Rocket Launch for the past four years at Laurie LaMotte Memorial Park and they’d like to continue to hold it there this year. Mayor Capra mentioned the City has always waived fees for non-profit organizations. Motion by Council Member Broussard Vickers, seconded by Council Member Paar to approve the use of Laurie LaMotte Memorial Park, June 5, 2010, for the Cub Scout Rocket Launch. All in favor. Motion carried unanimously. VII. OLD BUSINESS 1. Resolution #10-009 – Requesting MNDOT & Anoka County for a Speed Study Along Main Street Page 2 of 7 City of Centerville Council Meeting Minutes April 14, 2010 City Administrator Larson reviewed information from the Staff speed study that was conducted, stating the results collected deem Staff to believe the speed limit would not be increased subsequent to an “official speed study.” Staff feels the speed limit would most likely remain the same or be lowered if the State Department of Transportation were to conduct a speed study. The City Council discussed concerns including the County may decide to study the entire street rather than just the area that the City requests and the chance of the speed limit being increased instead of lowered. It was noted that businesses surveyed in the community asked for a speed study, knowing there is the risk of a higher speed limit. It was noted that Anoka County had committed not to request a speed study, unless the City of Centerville wished to do one. It thus follows that they would not request a speed study on a greater segment of the roadway than requested by the City Council. Motion by Council Member Paar, seconded by Council Member Love to adopt Resolution #10-009 – Requesting MNDOT & Anoka County for a Speed Study st along Main street, between Mill Road going east and 21 Avenue. Motion carried (3/2). (Councilmembers Broussard Vickers and Fehrenbacher opposed.) 2.Parks & Recreation Committee Recommendation to Council to Authorize Bonestroo Engineering to Commence Bid Process to Construct a Pergola at Corner Stone Park City Engineer Statz reviewed background information stating he would recommend the City Council authorize bidding only the concrete posts, stating the City could decide to change after seeing samples if they wished. It was the consensus of the Council for Staff to proceed with the bid process for concrete posts for the pergola in Corner Stone Park. 3.Parks & Recreation Committee Recommendation to Amend Their 2010 Budget as Presented by Finance Director Motion by Council Member Love, seconded by Council Member Paar to Table Parks & Recreation Committee recommendation to Amend their 2010 Budget as presented by Finance Director. All in favor. Motion carried unanimously. VIII. NEW BUSINESS 1. Authorization to Proceed with Water Service Connection Project – Bonestroo City Administrator Larson reviewed background information. Page 3 of 7 City of Centerville Council Meeting Minutes April 14, 2010 Mayor Capra stated she is grateful to be able to provide water services to twenty-five homes in the City, all who qualify as low to moderate income, which has never been done before. She asked that Staff send a letter of thanks to the Anoka County Board. Motion by Council Member Broussard Vickers, seconded by Council Member Paar to authorize proceeding with Water Service Connection Project – Bonestroo, not to exceed $9300.00. All in favor. Motion carried unanimously. 2. Maintenance Agreement – Stormwater Management Facilities (RCWD & City) City Administrator Larson reviewed the background information. Motion by Council Member Broussard Vickers, seconded by Council Member Paar to authorize Maintenance Agreement – Stormwater Management Facilities (RCWD & City). All in favor. Motion carried unanimously. 3. Lease Agreement for City Owned Property Located at 1737 Main Street City Attorney Glaser reviewed the lease agreement for the City owned property. Motion by Council Member Paar, seconded by Council Member Love to authorize lease agreement for City owned property located at 1737 Main Street. All in favor. Motion carried unanimously. 4. Proposed Amendment to City Code, Chapter 91, Prohibiting the Use of Coal Tar- Based Sealer Products within Centerville City Administrator Larson reviewed background information stating the amendment would eventually be required of the City. In being proactive, Staff recommends the amendment to the City Code be implemented now. The City Council discussed their concerns including, enforcement of the Ordinance, retailers can continue to sell the product currently and private contractors not being required to use a new product yet. After discussion it was the consensus of the Council to direct Staff to review ways to educate the public via the City website and newsletter. Assisting the residents with a list of sealer products that would be in accordance to the upcoming Ordinance was also suggested. Motion by Council Member Fehrenbacher, seconded by Council Member Paar to table consideration of an amendment to City Code, Chapter 91, Prohibiting the Use of Coal Tar-Based Sealer Products within Centerville, until the April 28, 2010 City Council Meeting. All in favor. Motion carried unanimously. 5. Request for Raffle Permit St. Genevieve’s Catholic Church – Golden Boys Benefit, July 25, 2010 City Administrator Larson reviewed background information. All in favor. Motion carried unanimously. 6.Transient Sales Permit, Window Concepts of MN – April 15 - May 15, 2010 City Administrator Larson reviewed background information. Motion by Council Member Fehrenbacher, seconded by Council Member Paar to authorize Transient Sales Permit, Window Concepts of MN – April 15 to May 15, 2010. All in favor. Motion carried unanimously. 7.Parade and Planning (Held after Closed Executive Session) IX. ANNOUNCEMENTS/UPDATES 1.City Administrator Dallas Larson City Administrator Larson reported the Clearwater Drive pavement issue needs to be addressed, asking if Council would like to schedule a work session with the contractor to discuss a course of action. City Council discussed and determined it would be best to meet at the site, April 28, 2010, at 5:30 p.m., with the contractor. City Administrator Larson also reported on Corner Express’s interest in connecting the restaurant, liquor store, and gas station to City water and asked what the cost would be. It was noted the car wash would remain on the well. The City Council discussed the original unit formula cost and today’s unit cost, with the consensus being that since City water wasn’t originally available to the business, the connection fee formula to be used should be the original formula. It was also decided if the car wash were to connect to City water now, the original formula would also be used; however, if the car wash were to connect in the future, the current formula would be used. 2. Mayor Capra (Fete des Lacs Parade, Flea Market/Good Turn Event, Census) Mayor Capra reported the Fete des Lacs Parade would be taking place and thanked Councilmember Paar for his help. She stated that Parks and Recreation would be sponsoring the Flea Market. Good Turn Event will take place on April 24, 2010 through May 7, 2010, with the event happening on May 8, 2010. Mayor Capra also reported on Park and Recreation events, stating they are currently looking for music groups for the Music in the Park, the 8K run is still planned, Movies in the Park is being considered and a concession stand fundraiser is being discussed. It was also mentioned that free skate night passes were still available. Earth Day clean-up has been moved to Thursday, April 22, 2010, at 6 p.m., stating those interested in helping with the clean-up could meet at City Hall. Planning and Zoning Councilmember Love reported that a Darren Mosher was appointed as Chair, Tom Woods was appointed as Vice Chair, and there is an open seat on the Planning Commission. The issue of nonconforming uses was discussed at the meeting. 4. Centennial Lakes Little League Councilmember Paar thanked the Centennial Lakes Little League for their recent participation in cleaning the area baseball parks including those in Lino Lakes, Blaine and Centerville. X.CLOSED EXECUTIVE SESSION 1. Review of the City Administrator At 7:35 p.m. Council went into Closed session for the purpose of conducting its annual review of the City Administrator. Present were Mayor Capra, Council members Fehrenbacher, Vickers, Paar and Love. Also present were City Attorney Glaser and Administrator Dallas Larson. The Council discussed the review process and the forms that have been used in the past. Council member Fehrenbacher suggested doing a different process that solicits input from staff and peers. Council member Love shared his experience with 360 reviews. The consensus was that the process for this review should be the same as last year, but that Council would look at alternatives for next year. The Council received copies of the review form and agreed to continue the closed session after the next regular meeting to complete the administrator’s review. The meeting was reopened to the public at 8:15 p.m. Council member Vickers left at this point in the meeting. XI. PARADE AND FETE DES LACS PLANNING. The Council discussed the annual Fete des lacs events. Mayor Capra and Council member Paar have been working on planning the parade and fireworks. Staff was instructed to check on insurance coverage for the City’s involvement in the events. Draft letters to parade participants were reviewed. Only one or two parade entries will be offered compensation this year in order to make funds available to have a fireworks display.
