CITY OF CENTERVILLE
PLANNING AND ZONING COMMISSION
May 11, 2010
Pursuant to due call and notice thereof, the Planning and Zoning Commission held its regularly
scheduled meeting on May 11, 2010, at 6:30 p.m.

I. CALL TO ORDER
The meeting was called to order by Commissioner Mosher.

II.PUBLIC INPUT/HEARING
A public hearing was held relating to the proposed change in City Code, Chapter 156,
Sections 156.006 and 156.107. The Commission reviewed the proposed change. The most
significant element of the proposed change would allow garages to be set 5 feet from a property
line rather than the current 10 feet. Other minor changes in text and limits to size of accessory
buildings were also in the draft. The following persons spoke with regard to the proposed
amendments:
Olaf Lee, 1724 Heritage Street. Mr. Lee indicated that he would like to see
more flexibility in the location and amounts of accessory building space that
can be constructed.
Kurt Frieson, 6913 Sumac Court. Mr. Frieson would like to be able to add to
the side of his garage, thus the proposed five foot setback is needed and he
supports the change.
Everyone who wished to do so was given the opportunity to speak with regard to the proposed
amendment.

Motion by Commissioner Larson, seconded by Commissioner Wood that the
Commission close the public hearing. All in favor. Motion carried
unanimously.
The Commission discussed the proposed amendments at length. After considering the impacts of
the various changes, the consensus was that the five foot setback is too close to the property line
for an attached garage. The text was modified to change maximum allowed accessory building
space and locations as follows:
156.006 DEFINITIONS
ACCESSORY BUILDING.
A subordinate building or portion of the main
building which is located on the same lot as the principal structure, the use of
which is incidental and accessory to that of the principal structure.
YARD, REAR.
The portion of the yard on the same lot with the principal building
located between the rear line of the building and the rear lot line and extending for the

§ 156.107 ACCESSORY STRUCTURES AND USES.
(A) Accessory Structures – Residential Uses
(1) No more than two detached accessory buildings are permitted
on any single-family, detached dwelling parcel located in any
district except R-1. Combined aggregate square footage for
detached accessory structures shall not exceed 2% of the lot area,
except if the lot has no attached garage, the largest detached
structure may not exceed the footprint of the dwelling.
(2) In no event may any accessory building exceed the square
footage of the main level of the principal structure, except in the R-
1 District.
(3) No accessory structure may be constructed on a parcel without
a principal structure.
(4) No accessory structure shall be erected or located within any
required yard other than the rear yard.
(5) Detached accessory buildings must have a minimum of
a 5-foot interior side setback and a 10-foot rear setback. Where a
rear or side yard abuts a street, an accessory building shall be set
back a minimum of 20 feet from the street property line. No
structure may be placed in an easement except bridges by written
permit approved by the City Council. Where a lot line easement

exists, the building overhang may not extend into the easement
except where approved by the City Council.
Motion by Commissioner Wood, seconded by Commissioner Lange that the
Commission approve the findings in favor of the changes to Chapter 156 and
recommend their adoption by the City Council. All in favor. Motion carried
unanimously.
III.OLD BUSINESS

1.
Comprehensive Plan-Zoning Modifications
Motion by Commissioner Larson, seconded by Commissioner Wood that the
Commission request a joint meeting between Council and P&Z to discuss the
changes identified in the Comprehensive Plan. All in favor. Motion carried
unanimously.
2.
Downtown Nonconforming Uses
The Commission reviewed a draft of Code changes that would implement the
changes they requested at the last meeting. The changes would permit a 33%
increase in building foot print and permit accessory buildings and decks to the same
degree as permitted in the R-2 zoning district.
Motion by Commissioner Larson, seconded by Commissioner Lange that the
Commission hold a public hearing at its next meeting to consider adoption of
the changes to the City Code relating to downtown area nonconforming uses.
All voted in favor. Motion carried unanimously.
IV.NEW BUSINESS.
1.
Proposed Modifications to Chapter 156 Relating to Residential Accessory
Structures
(Acted on at the close of the public hearing.)
V. CONSIDERATION OF MINUTES
Motion by Commissioner Wood, seconded by Commissioner Larson to approve
minutes from March 2, and April 6 meetings. All in favor. Motion carried
unanimously.

VI. PLANNING AND ZONING COMMISSION MEETING ADJOURNMENT
Motion by Commissioner Wood, seconded by Commissioner Larson to adjourn the
meeting at 8:35 p.m. All in favor. Motion carried unanimously.
