PLANNING AND ZONING COMMISSION
April 6, 2010
Pursuant to due call and notice thereof, the Planning and Zoning Commission held its regularly
scheduled meeting on March 2, 2010, at 6:30 p.m.

I. CALL TO ORDER
The meeting was called to order by Commissioner Mosher.

II.PUBLIC INPUT/HEARING
None
Olaf Lee, 1724 Heritage Street. Mr Lee indicated that he and his family would like to
construct a sun room, a bedroom and a garage. The home in currently about 2900
square feet. Would like the zoning changed back until a developer buys the property.

A.Appointment of a chair and vice-chair.
Motion by Commissioner Parrucci, seconded by Commissioner Lange that the
Commission appoint Darin Mosher as chair of the P&Z. All in favor. Motion
carried

Motion by Commissioner Parrucci, seconded by Commissioner Larson that
the Commission appoint Tom Wood as vice-chair of the P&Z. All in favor.
Motion carried
B. Residential Accessory Structures and Setbacks. The Commission reviewed a draft
code change that would allow accessory buildings to be 5 feet from interior side lot
lines. Definitions would change to treat attached garages in the same manner as
detached garages for the purpose of interior side-yard setback. The Commission felt
other restrictions that accessory buildings be limited to 2% of total lot area or 200
square feet is too restricted and should be removed. The primary restriction on
accessory building (attached or detached) would be that the combined square footage
could not exceed the footprint of the main floor of the dwelling. The Commission
determined that the roof overhang should not be permitted to encroach into the five-
foot setback, if a drainage easement existed along the property line.
Motion by Commissioner Wekseth, seconded by Commissioner Lange that the
Commission hold a public hearing to consider the code changes at the next
meeting and that notice be given accordingly. All in favor. Motion carried
C. Nonconforming uses. The Commission discussed the input that was received from
the public this evening. The Commission reviewed a memo from City Attorney Glaser
outlining possible actions to permit more flexibility for nonconforming uses. The
suggestion was that an increase in the use be permitted to 25% of the footprint of the
dwelling as existed on May 23, 2006, which is the date that the downtown plan was
approved and the current zoning districts were established. Olaf Lee, 1724 Heritage
Street was present. Mr. Lee suggested that 25% isn’t high enough. After some
discussion the Commission suggested 33%. Some changes were suggested to the
accessory building regulations. It was then suggested that nonconforming uses be
allowed to construct accessory buildings as would otherwise be allowed if the property
was in a R-2 zoning district.
Motion by Commissioner Wood, seconded by Commissioner Lange that the
Commission draft a proposed ordinance amendment that would implement a
33% expansion of nonconforming uses and would allow accessory buildings
per residential R-2 regulations. All in favor. Motion carried
B.Zoning to conform to Comprehensive Guide Plan.
The Commission reviewed a memo from Tina Goodroad, Planner for Bonestroo,
suggesting certain zoning changes to conform to the new Comprehensive Plan.
Specifically, the plan directs that certain areas be changed from low to medium density

residential, low density residential to mixed use, other areas to high density residential
and another area from industrial to Commercial Business.
Some members continued to express concerns that the change from industrial to
business may adversely affect certain industry owners.
Motion by Commissioner Lange, seconded by Commissioner Wood that the
Commission table this matter until the next meeting. All in favor. Motion
carried

VI. PLANNING AND ZONING COMMISSION MEETING ADJOURNMENT
Motion by Commissioner Mosher, seconded by Commissioner Pangel to adjourn the
meeting at 8:30 p.m. All in favor. Motion carried unanimously.
