PLANNING AND ZONING COMMISSION
March 2, 2010
Pursuant to due call and notice thereof, the Planning and Zoning Commission held its regularly
scheduled meeting on March 2, 2010, at 6:30 p.m.

I. CALL TO ORDER
The meeting was called to order by Commissioner Wood, Vice-
Chair of the Commission.

II.PUBLIC INPUT/HEARING
The Commission held a fact-finding inquiry to consider the
impacts of the nonconforming zoning designation. The nonconforming designation
impacts properties in the M-1, M-2 and B-1 districts. The City Council directed that P&Z
take comments from the public to determine if property owners are being denied the
opportunity to expand or improve their properties. The following persons expressed their
views on the matter:
Olaf Lee, 1724 Heritage Street. Mr. Lee indicated that he and his family would like to
construct a sun room, a bedroom and a garage. The home in currently about 2,900
square feet. Would like the zoning changed back until a developer buys the property.
Randy Knadke, 1751 Main Street. Mr. Knadke would like to add two rooms or about
15% additional square feet of home.

Pat Camp-Baron, 7121 Centerville Road. Ms. Camp-Baron doesn’t have any
expansion plans, but dislikes the restrictions on her property that were imposed by the
zoning.
Wendy Brilowski, 7124 Main Street. Ms. Brilowski was not sure if she was in a
nonconforming use situation. It was pointed out that the Comprehensive Plan guides
her property to mixed use, which would dictate a rezoning to M-2, putting her property
in a nonconforming use.
Bryce Wasiloski, 1688 Heritage Street. His family had prepared a plan for a
replacement of the garage and for some decks and a porch.
LyNae Marshall, 7216 LaValle Drive. She is not in a nonconforming use, but feels it is
unfair to deny property owners the right to do as they please with their property.
D. Love, Council Member, explained why the City was requesting comments from the
public.
Paul Burke, 1683 Lakeland Circle, owns property at 7105 Main Street. Plans to
construct town homes in the longer term, but isn’t going to do anything now.
Erick Marshall, 7216 LaValle Drive. Would like the see the zoning downtown changed
back to the way it was before.
After everyone who wished to speak was given an opportunity to do so, the public
inquiry was closed.
III.OLD BUSINESS

IV.NEW BUSINESS
A.Appointment of a chair and vice-chair.
Motion by Commissioner Mosher, seconded by Commissioner Pangell that the
Commission table the decision on a chair and vice-chair. All in favor. Motion
carried
B.Zoning to conform to Comprehensive Guide Plan.
The Commission reviewed zoning guidance of the Comprehensive Plan. Specifically,
the plan directs that certain areas be changed from low to medium density residential,
low density residential to mixed use, other areas to high density residential and another
area from industrial to Commercial. It was noted that the City has approximately one
year from adoption of the plan to make the zoning consistent with the Plan.
Some members expressed concerns that the assumptions in the plan may have been
faulty, that Centerville may not attain the population densities that were projected.

Also, concern was raised over creating more nonconforming uses in the City. Staff
was directed to come up with code language to implement the medium and high
density zoning areas identified in the plan.
C. Nonconforming uses. The Commission discussed the input that was received from
the public this evening. City Attorney Glaser will investigate possible options and will
report back in writing before the April meeting. The Commission discussed the
possibility of a joint work session with the City Council for April or May, 2010.
D. Residential Accessory Structures and Setbacks. Resident Kurt Frison had
requested that P&Z consider reducing the side-yard setback for garages and accessory
buildings. Staff confirmed that several neighboring communities have a five-foot
setback as compared to Centerville’s 10 foot requirement. Those with a five-foot
setback include White Bear Lake, Vadnais Heights, Lino Lakes and Blaine. The
Commission discussed some adverse impacts of a reduced setback. Among those are: a
narrower setback would make it impossible for the property owner to get a vehicle to
the rear yard along that side; if two garages on neighboring parcels faced one another,
the buildings would be ten feet apart, even less if measured at the roof overhang;
drainage swales along that side of the property would be more difficult with the
reduced distance. Staff was directed to prepare draft code language that would
implement the reduced setback but taking into account the adverse impacts mentioned.
V. CONSIDERATION OF MINUTES
1.December 1, 2009, Meeting Minutes (January meeting cancelled) February
meeting lacked a quorum)
Motion by Commissioner Pangell, seconded by Commissioner Wood , to approve the
December 1, 2009, minutes as presented. All in favor. Motion carried.
VI. PLANNING AND ZONING COMMISSION MEETING ADJOURNMENT
Motion by Commissioner Mosher, seconded by Commissioner Pangell to adjourn the
Meeting at 9:10 p.m. All in favor. Motion carried unanimously.
