CITY COUNCIL MEETING
July 14, 2010
6:30 p.m.
Pursuant to due call and notice thereof, the City of Centerville held their regularly scheduled
meeting on July 14, 2010, at City Hall, 1880 Main Street.

I. CALL TO ORDER
Mayor Capra called the July 14, 2010, City Council meeting to order at 6:47 p.m.

III. APPROVAL OF AGENDA
Mayor Capra made the following additions/corrections to the Agenda:
Consent Agenda, Item 41, added Page 7a, (Check 4 25572-25598)
New Business, Item 5a, added Pages 96a -h

New Business, Item 9, added Pages 106-110
Motion by Council Member Love, seconded by Council Member Broussard Vickers
to approve the agenda as amended. All in favor. Motion carried unanimously.

to approve the June 23, 2010 City Council Meetin-2 Minutes as presented. All in
favor. Motion carried unanimously.

Motion by Council Member Fehrenbacher, seconded by Council Member
Broussard Vickers to approve the June 23, 2010 City Council Work Session Meeting
Minutes as presented. All in favor. Motion carried unanimously.

Motion by Council Member Broussard Vickers, seconded by Council Member
Fehrenbacher to approve the Consent Agenda. All in favor. Motion carried
unanimously.
VI. AWARDS/PRESENTATIONS/APPEARANCES
Captain Ron Nelson, Centennial Lakes Police Department — Presentation of 2009
Annual Department Report
Captain Ron Nelson presented the 2009 Annual Department Report and gave a
comprehensive overview of the activities performed by the police department. He
highlighted the alcohol and tobacco compliance checks that were performed in
Centerville and indicated the department will continue to work with the businesses for all
business to be compliant in this process. He added Night to Unite was held last August
and is a great opportunity for officers to go out into the community. This year's Night to
Unite is August 3, 2010.

VIII. NEW BUSINESS
1. Parks & Recreation Committee Request for Council's Consideration of Including
Hidden Spring Park as Part of the Storm Water Reclamation Project
City Engineer Statz reviewed information from the Parks & Recreation Committee to
consider including Hidden Spring Park as part of the storm water reclamation project.
He indicated the cost to explore Hidden Spring Park being included in the storm water
reclamation project would be about $500.
Councilmember Broussard Vickers expressed concern with spending the additional
money at this time. Councilmember Love agreed with Councilmember Broussard
Vickers.
Motion by Council Member Fehrenbacher, seconded by Council Member Paar to
approve the Parks & Recreation Committee recommendation to include Hidden
Sprint Park as Part of the Storm Water Reclamation Proiect. All in favor. Motion
carried 3 — 2 (Councilmember Broussard Vickers and Love opposed).
2. Adopt Revised Water Supply Plan
City Administrator Larson reviewed background information and indicated the revised
Water Supply Plan makes changes required by the DNR. It specifically delays DNR's
requirement to monitor the water table drawdown on the wells until the next time the
pumps are pulled out for maintenance, or approximately seven years.
Motion by Council Member Love, seconded by Council Member Fehrenbacher to
adopt the Revised Water Supply Plan. All in favor. Motion carried unanimously.
3. Consider Bids for 2010 Seal Coat Project
City Engineer Statz reviewed information regarding the bids for the 2010 Seal Project.
Motion by Council Member Broussard Vickers, seconded by Council Member
Fehrenbacher to approve Bids for the 2010 Seal Coat Proiect. All in favor. Motion
carried unanimously.
4. Consider Bids for CDBG Water Service Line Project
City Engineer Statz reviewed information regarding the bids for the CDBG Water
Service Line project, noting the bids came in significantly higher than projected. He
suggested the City act as the general contractor for the project to reduce some of the
costs.
City Administrator Larson indicated that staff met with a local contractor to try to

determine if a different means of completing the project would be more cost effective.
Staff will report back to the Council in about a month with a recommendation.
Council consensus was reached to table this item.
Consider Bids for Trail Link Project
City Engineer Statz reviewed information regarding the bids for the Trail Link Project
which also came in much higher than projected.
The Council discussed revising the plan and sending it out for bid later this summer or
early fall.
Motion by Council Member Love, seconded by Council Member Broussard Vickers
to Reiect the Bids for the Trail Link Proiect because they are much hither than
proiected. All in favor. Motion carried unanimously.
6. Planning & Zoning Commission's Recommendation to Adopt Ord. 4036, Second
Series, an Ordinance Amending Chapter 156, Section 156.051 & Section 156.052
City Administrator Larson reviewed background information regarding adopting
Ordinance 436, Second Series an Ordinance Amending Chapter 156, Section 156.051 and
Section 156.052.
Motion by Council Member Love, seconded by Council Member Fehrenbacher to
approve the Planning & Zonin-2 Commission's Recommendation to Adopt
Ordinance #36, Second Series an Ordinance Amending Chapter 156, Section
156.051 & Section 156.052. All in favor. Motion carried unanimously.
7. Special Events Permits for Fireworks & Parade (Fete des Lacs)
City Administrator Larson reviewed background information regarding the special events
permit for fireworks and parade (Fete des Lacs).
Motion by Council Member Broussard Vickers, seconded by Council Member Paar
to approve Special Event Permits for Fireworks and Parade (Fete des Lacs), subiect
to the approval of the Police and Fire Department. All in favor. Motion carried
unanimously.
Resolution 410-017 Appointing Election Judges for the Upcoming Primary &
General Elections & Interim Deputy Clerk
City Administrator Larson reviewed background information regarding Resolution 410-
017, Appointing Election Judges for the Upcoming Primary & General Election and
Interim Deputy Clerk.

Motion by Council Member Broussard Vickers, seconded by Council Member
Fehrenbacher to approve Resolution #10-017 Appointing Election Judges for the
Upcoming Primary General Elections and Interim Deputy Clerk. All in favor.
Motion carried unanimously.
9. Planning & Zoning Commission's Recommendation to Approve Proposed lot Split
(120' x 65') from 1988 Main & add to parcel 1990 Main
City Administrator Larson reviewed background information regarding Planning &
Zoning Commission's recommendation to approve proposed lot split (120' X 65") from
1988 Main and add to parcel 1990 Main. The Planning & Zoning Commission has
recommended approval of the lot split, subject to the condition that the owner combine
the split portion with the adjoining commercial strip mall property.
Motion by Council Member Love, seconded by Council Member Paar to approve
the Planning & Zoning Commission's Recommendation to Approve the proposed
lot split (120' x 65') from 1988 Main and to add that portion to 1990 Main Street.
All in favor. Motion carried unanimously.
IX. ANNOUNCEMENTS/UPDATES
1. City Administrator Dallas Larson
City Administrator Larson stated nothing to report.
2. Mayor Capra reminded residents of the upcoming parade on July 31, 2010.
3. Centennial Lakes Police Department — (Tobacco & Alcohol Compliance Checks)
It was noted that letters of congratulations have been forwarded to the establishments.
CLOSED SESSION — Attorney/Client Discussion Regarding Pending Litigation
The City Council met in a closed session on Wednesday, July 14, 2010, at 8:30 p.m. in
Council Chambers. Present were Mayor Mary Capra, Council members Linda
Broussard -Vickers, Ben Fehrenbacher, D. Love and Jeff Paar. Also present were City
Attorney, Kurt Glaser, Engineer, Mark Statz and Administrator, Dallas Larson. The
purpose of the closed meeting was to discuss pending litigation regarding the special
assessments related to the 21" Avenue/Backage Road Project.
Attorney Glaser reported on an offer of settlement. Consensus of the Council was that
the offer is insufficient and unacceptable.
The meeting was reopened to the public at 8:42 p.m.
