CITY OF GEM LAKE RESOLUTION NO. 200442 21 June 2004 RESOLUTION OF THE CITY OF GEM LAKE, .MINNESOTA CONSOLIDATING CERTAIN IMPROVEMENT PROJECTS WHEREAS,the City of Gem Lake (the "City") previously instituted proceedings for the following public improvements: (a) Pursuant to Resolution No. 2004-05 adopted by the City Council. (the "City Council") of the City on .May :24,2004 (the "Resolution2004-05"), the City ordered sanitary sewer improvements (the "Original 2004 Improvements") for homes abutting Scheuneman Roadleading upto a single family residential development to be constructed by McNulty Construction (the "Development") and in. the Development; and (b) Pursuant to Resolution No. 2004-11 adopted by the City Council on the date hereof ("Resolution 2004-11"), the City ordered sanitary sewer improvements for homes abutting Scheuneman Road commencing at the intersection with Kahl Circle and thence northerly approximately 1,000 feet to the intersection of Scheuneman and.. Otter Lake Roads (the `Additional 2004 :Improvements"); and W IIEREAS,the City Council held an improvement hearing for the Original 2004 Improvements on May 24, 2004 prior to adopting Resolution 2004-05 that ordered the improvements described as the Original 2004 Tmprovements; and WHEREAS, the City Council held an improvement: hearing for the Additional 2004 Improvements on the date hereof prior to adopting Resolution 2004-11 that ordered the improvements described as the. Additional 2004 Improvements; and WHEREAS,the City Council has determined that the various components of the Original 2004 Improvements and the Additional 2004 Improvements may be more economically completed if consolidated and joined as one project, as authorized under Minnesota Statutes, Section 435.56,. as amended. Now, Therefore Be It. RESOLVED,that the City Council .of the City of Gem Lake acknowledges and orders as follows: I. The Council hereby consolidates and joins. the Original 2004 Improvements and the Additional '2004 improvements as a single consolidated project for all purposes under Minnesota Statutes, Section 435.56, as amended, and Chapter 429, as amended. All proceedings in connection with each component of the Original 2004 Improvements and the Additional 2004. Improvements shall be deemed instituted and conducted as one proceeding. 3.. The project consolidating the Original 2004 Improvements and the Additional 2004 .Inprovements is designated as the "`Public improvement .Project No. 2004-01".
