CITY OF GEM LAKE <br />MINUTES OF PUBLIC HEARING <br />Additional Public Improvements For Project No. 2004-01 <br />20 December 2004 <br />A Public Hearing for the purpose of receiving public comment on an proposed additions to Public Improvement <br />Project No. 2004-01 including reconstruction of Scheuneman Road from it's intersection with Otter Lake Road as the <br />north terminus and it's intersection with State Highway 6 i as it's south terminus. Said work has been reviewed by the <br />Gem Lake City Council, Planning Commission, Zoning Administrators, Engineer and Project Manager and has been <br />found necessary at the additional costs shown. <br />Clerk Magnuson reported that all affected property owners have been properly notified by both direct mail and in <br />the City's legal publication. Following Mayor- Emeott's request for additions, deletions, or corrections, and on Motion <br />by Igo and Second by Birkebak, the Agenda for the Public Hearing was unanimously approved. <br />Clerk Magnuson then explained that two previous Public Hearings have been held on Public Improvement Project <br />2004-01 including the first hearing at which statements of need and finding of facts were presented to Scheuneman Road <br />property owners from Kahl Circle to the south (old) Hillary Farm entrance and the second hearing at which similar <br />statements and findings were presented to Scheuneman Road property owners from Kahl Circle to Otter Lake Road. <br />Subsequent to these two public hearings, the project proceeded with the understanding that a grant of $170,000 from <br />Ramsey County would cover one -hundred (100%) percent of the road reconstruction costs, a benefit to all Scheuneman <br />Road and Kahl Circle property owners. Due to design changes, sub -surface geo-technical findings and other <br />considerations, the final cost of the road was determined to be $58,618 greater than originally budgeted. Based upon <br />amendments to Gem Lake ordinances which provide for assessment of benefitted property owners, 16 additional <br />benefitted property owners were identified as those property owners south of the Hillary Farm entrance (1) and those <br />property owners on Kahl Circle (6). Hence it is determined that the fair and equitable method of assessing these <br />improvements was to split sewer and road reconstruction with the appropriate number of benefitted parties participating <br />in each. Based upon data provided by City Financial Consultant Ehlers, Inc., a copy of which is attached, the following <br />will be the likely distribution of assessments: <br />SEWER DEVELOPMENT $ 477,716 65 participant shares $ 8,027 per share $521,775 Assessment <br />ROAD RECONSTRUCTION $ 58,618 77 participant shares $ 834 per share $ 64,225 Assessment <br />Mayor Emeott then asked if the Councilors present had any questions of staff or professionals present. None were <br />asked as the Council had already discussed and reviewed the material for the proposed project addition. <br />Mayor Emeott then requested comments from those present asking that those who have not been heard previously <br />be recognized first and that comments be limited to 3 minutes each.. Mr. Hurt, Mr. Hanson, Mr. Weber and Mr. Lindner <br />all had questions or comments, none of which opposed the project. Mr. Hurt and Mr. Hanson share some concern <br />regarding driveway/roadway entrance elevation problems which will need to be addressed with the final paving course. <br />Mr. Weber expressed concern regarding the golf course share due to the extreme levels of traffic to the golf course and <br />felt that increased share should be born by the golf course when the assessment hearing is held. <br />Mayor Emeott then thanked all those present for appearing this evening and indicated the matter would be <br />considered by the City Council later in the evening. There being no further business, Motion to adjourn the hearing by <br />Igo and Second by Bosak was unanimously approved.
