name of the City to abate and enjoin the further continuation of said nuisance. (Ordinance <br />16, §7, 6/17/1969) <br />Section 13. Abatement of Nuisance by Council, <br />13.1. Normal procedure, If, after such service of notice, the person served fails to abate <br />the nuisance or make the necessary repairs, alterations, or changes in accordance with the <br />direction of the Council, the Council may cause such nuisance to be abated at the expense <br />of the Council and recover such expenditure, plus an additional twenty-five percent <br />(25%) of such expenditures, by civil action against the person or persons served; orif <br />service has been had upon the owner or occupant by ordering the Clerk to extend such <br />sum, plus twenty-five percent (25%) thereof, as a special tax against` the property upon <br />which the nuisance existed and to certify the same to the county auditor of Ramsey <br />County, Minnesota, for collection in the same manner as taxes and special assessments <br />are certified and collected. (Ordinance 16, §8, 6/17/1969) <br />13.2 Summary enforcement. Incases where the delay in abatement required to <br />complete the notice and procedure requirements set forth in sections 12 and 13.1 will <br />permit a continuing nuisance to unreasonably endanger public health, safety or welfare, <br />the Council may order summary enforcement and abate the nuisance. The officer <br />charged with enforcement shall determine that a public nuisance exists or is being <br />maintained on premises in the City and that delay in abatement ofthe nuisance will <br />unreasonably endanger public health, safety or welfare. The enforcement officer shall <br />notify in writing the occupant or owner of the premises of the nature of the nuisance and <br />of the City's decision to seek summary enforcement and the time and place of the council. <br />meeting to consider the question of summary enforcement. The council shall determine <br />whether or not the condition identified in the notice to the owner or occupant is a <br />nuisance, whether public health, safety or welfare will be unreasonably endangered by <br />delay in abatement required to complete the procedure set forth above, and may order <br />that such nuisance be immediately terminated or abated. If the nuisance is not <br />immediately terminated or abated, the Council may order summary enforcement and <br />abate the nuisance. <br />13.3 Emergencies. The city may, without notice or other process, immediately abate <br />any condition which poses an imminent and serious hazard to human life or safety. <br />13.4 Responsibility for cost. In cases of summary or emergency enforcement, the <br />owner of premises on which a nuisance has been abated by the city shall be personally <br />liable for the cost to the city ofthe abatement, including administrative costs. The clerk <br />shall prepare a bill once costs have been determined and present it to the owner, due and <br />payable immediately. <br />
