3.3 The Clerk shall forward the completed application to the Planning <br />Commission for review and recommendation to the. City Council. The City <br />Council shall hold a public hearing on the application. Notice of the hearing shall <br />be mailed, at least ten days prior to the date of the hearing, to the owners of all <br />properties located within 350 feet of any lot line of the property on which the <br />pawnbroker operation is proposed. The notice shall also be published in the <br />official newspaper at least ten days prior to the date of hearing. After conducting <br />the hearing, the City Council may grant or refuse the application in its discretion. <br />3.4 All licenses shall expire on the last day of December of each year. Each <br />license shall be issued for a period of one year except that if a portion of the <br />license year has elapsed when the application is made, a license may be issued for <br />the remainder of the year for a pro rata fee. In computing such fee, any unexpired <br />fraction of a month shall be counted as one month. <br />3.5 Each person holding a pawnbroker license shall apply to the City Clerk each <br />January for renewal. Prior to issuance of a license renewal, the City Clerk shall <br />determine that all licensing conditions and city ordinances are being met. <br />SECTION 4. Conditions Upon Licenses. <br />4.1 Before any person shall be licensed as a pawnbroker under this ordinance, <br />such applicant shall file with the City Clerk a bond in the sum of five thousand <br />dollars ($5,000.00) with a duly licensed surety company as surety thereon, with <br />such surety bond to be approved by the City Clerk and such bond to be approved <br />as to form and execution by the City Attorney. Conditions of such bond shall be <br />that the licensee shall observe the sections of this Ordinance or other city <br />ordinances in relation to the business of the pawnbroker and that such licensee <br />will conduct such business in conformity therewith and will account for and <br />deliver to any person legally entitled thereto any goods, wares or merchandise, <br />article or thing which may have come into the possession of such licensee as <br />pawnbroker or, in lieu thereof, such licensee shall pay in money to such person <br />the reasonable value thereof. <br />4.2 The pawnbroker's pretnises must be in compliance with all applicable zoning, <br />building and fire codes. <br />4.3 If a pawnbroker shall receive notice through publications, advertisements, or <br />any other means that any goods, articles or things in the licensee's possession are <br />lost or stolen, the licensee or an agent thereof shall immediately give information <br />to either the City Clerk or the Ramsey County Sheriffs Department that the items <br />are in the licensee's possession. The licensee shall not thereafter dispose of the. <br />goods, articles or things except upon written authority from the City Clerk or <br />Ramsey County Sheriff. <br />
