CITY OF GEM LAKE, RAMSEY COUNTY, MINNESOTA <br />ORDINANCE NO. 106 <br />AN ORDINANCE AMENDING ORDINANCE NO. 69 REGULATING THE <br />KEEPING OF ANIMALS INTHE CITY OF GEM LAKE <br />THE CITY COUNCIL OF THE CITY OF GEM LAKE ORDAINS: <br />SECTION I. AMENDMENT. Section 2.3 of Ordinance 69 is amended, as follows: <br />Dangerous Dog: Arty dogthat has committed any of the acts setforth below: <br />(I) Without provocation, inflicted substantial bodily harm ona human <br />being on public or private property; <br />(2) Killed a domestic animal without provocation while off the <br />owner's property; or <br />(3`) Been found to be potentially dangerous, and after the owner has <br />notice that the dog is potentially clantrerous the dog aggressively <br />bites, attacks, or endangers thesafety of humans or domestic <br />animals. <br />Potentially Dangerous Dog: Any dog that has committedany of the acts set <br />forth below: <br />(l) When unprovoked, inflicts bites on a human or domestic animal on <br />public or private property; <br />(2) When unprovoked, chases or approaches a person upon the streets, <br />sidewalks or any public property in an apparent attitudeof attack; <br />or <br />(3) Has a known propensity, tendency, or disposition toattack <br />unprovoked, causing iniury or otherwise threatening the safety of <br />humans or domestic animals. <br />Provocation: An act that an adult could reasonably expect may cause a dog to <br />attack or bite. <br />Secure Enclosure: "Secure enclosure" means securely confined indoors or in a <br />securely enclosed and lockedpen or structure suitable to prevent.. the animal from <br />escaping and providing protection from the elements for the dog. A secure <br />enclosure does not include a porch, patio, or any part of a house, garage, or other <br />structure that would allow the dog to exit ofits own volition, or any house. or <br />
