Residential. Premises for long-term human dwelling. <br />Office. Non-residential premises used for administrative, clerical, professional <br />or similar activities. Office as used in this section includes medical and dental offices <br />used by five (5) or fewer medical principals (doctor, dentist, chiropractor or similar <br />professional), <br />Retail. Premises' for the sale of merchandise and food service. For purposes <br />of this Section, banks with teller .service are considered "retail" instead of "office." <br />Athleticclubs and fitness centers that are not the primary use of the building space arc <br />considered a "retail" use. Certain personal service businesses are considered "retail" if <br />not the primary use.: of a building: barbershop/beauty salon; clothing :rentaland dry <br />cleaning pickup (but not on -site processing); and tailor shops. <br />Commercial. Premises for the conduct of the following activities, which are not <br />included within the meaning of "office or "retail" for purposes of this Section:.Ath- <br />letic club/fitness center (when primary or only use of buildingspace); business school <br />or trade school; veterinary clinic; funeral home;. hotel; recreational primary use (such as <br />a bowling alley); cabinet and carpentry shops, heating,.plutnbing. or electricalsales and <br />service; printing shop, upholstery shop, warehousing. Conditional uses of space as- <br />signed as "commercial" are: automotive repair and service (including gas stations); car <br />wash; light industrial uses: which manufacture, process, store and distribute foods and <br />materials not likely to create offensive noise, odors, vibrations, dust smoke, heat, glare <br />or other: objectionable influences: and are in general dependent upon raw materials re- <br />fined elsewhere. <br />B) Accessory and Alternative Uses. Figures 16 and 17 provide charts stating the compati- <br />bility oflisted accessory- uses and variations on categorical primary uses (such as restricting <br />residential usc to Senior.Ilousing) with each Building 'rype. The items listed in Figure 16 <br />and 17 further refine the general definitions stated above, andany perceived conflict should <br />be resolved in favor of Figures 16 and 17. Placement of accessory buildings is generally <br />noted on the Building Type Template and is also governed by the Design Standards: <br />C) Uses designated 'as • "conditional" or •"CUP" Within this Section,. on a Building Type <br />Template or within Figures 16 and 17. shall require a. Conditional Use Permit, following the <br />existing:procedures in Section 17:4 of the Zoning:Ordinance. <br />D) Certain uses of land whichare not necessarily related to a building aregenerally permit- <br />ted within the Gateway District by conditionaluse permit: <br />Essential Service Structures <br />Planned Unit Development <br />Institutional Overlay <br />E) Nothing in this Section or its attachments shall be construed toprevent the application <br />of other Gem Lake ordinances pertaining: to types of uses (including, but not limited to, the <br />Adult Use Ordinance and the Pawnbroker Ordinance) or to city licensing of businesses and <br />activities in general. <br />INN) If a use or structure is not listed or included among thedefinitions herein, the Building <br />Type Templates, or Figures 16 and 17, then it is prohibited within the Gateway District. <br />Genic Lake Gadewny Desdiict .l)evelopm e d Cade <br />May .19, 2009 - Page 15 <br />
