nI1EMORANDUM <br />TO; <br />FROM: <br />DATE: <br />SUBJECT: <br />REQUEST: <br />PLANNING COMMISSION <br />TOM RIEDESEL <br />OCTOBER 5, 2011 <br />GARAGE CONSTRUCTION <br />SPECIAL USE PERMIT TO CONSTRUCT AN OVERSIZED <br />GARAGE <br />LOCATION: 5 HILLARY FARM LANE <br />APPLICANTS: GREG SMITH / MELISSA GELLER <br />Mr. Smith and Ms. Geller are requesting approval of a Conditional Use Permit <br />which, if approved, would allow construction of a 1,250 square foot (25' x 50') 4 <br />stall garage. The garage is planned to replace a garage which burned down <br />several years ago, prior to the applicants purchase of the property. <br />Section 4.5(5) of Ordinance No. 43G (the Hillary Farm Zoning Ordinance), limits <br />accessory buildings which includes a garage, to a total of 1,000 square feet <br />except by special use permit. The City Council may grant special use permits <br />and may in the granting of the special use permit, impose conditions and <br />safeguards which promote the guidelines set forth in the Comprehensive <br />Municipal Plan and which are in harmony with the general purpose and intent of <br />the Ordinance. This is stated in Section 5.5(1) of Ordinance No. 43k. <br />Prior to approval of a special use permit, the City Council must determine that the <br />use: 1) will not be detrimental to the public health, safety and general welfare; 2) <br />is in harmony with the general purpose and intent of the Comprehensive <br />Municipal Plan, 3) is in compliance with the ordinance. In addition, general <br />standards which should be considered (and are considered general standards for <br />approving a conditional use permit) include: the structure shall be compatible <br />with surrounding uses and the architectural character and design standards of <br />existing uses and development; shall meet or exceed performance standards <br />established in the Zoning Ordinance, and the structure shall not generate such <br />additional traffic associated with the use that would over burden or exceed the <br />capabilities of streets and other public services and facilities including, but not <br />limited to parks, schools and utilities serving the area. <br />The garage is proposed to be detached initially, but plans are to join the structure <br />to the house by constructing a breezeway in the future. The garage is proposed <br />to be constructed on the north side of the house and will be screened from other <br />residences in the area by vegetation or the Smith/Geller house, The architectural <br />design of the garage is consistent with the house. <br />The use as proposed, appears to meet the standards: set forth by the Zoning <br />Ordinance to approve the special use permit as requested. <br />TR/psw <br />cc:add.fife. <br />b;smith-2 <br />
