a. The City of Gem Lake shall prohibit the operation of a cannabis business within 1,000 feet <br />of a school. <br />b. The City of Gem Lake shall prohibit the operation of a cannabis business within 500 feet <br />of a day care. <br />c. The City of Gem Lake shall prohibit the operation of a cannabis business within 500 feet <br />of a residential treatment facility. <br />d. The City of Gem Lake shall prohibit the operation of a cannabis business within 500 feet <br />of an attraction within a public park that is regularly used by minors, including a <br />playground or athletic field. <br />e. Pursuant to Minn. Stat. 462.357 subd. 1e, nothing in Section 4.1 shall prohibit an active <br />cannabis business or a cannabis business seeking registration from continuing operation at <br />the same site if a school/daycare/residential treatment facility/attraction within a public <br />park that is regularly used by minors moves within the minimum buffer zone. <br />2. Zoning and Land Use <br />a. Cannabis Cultivator. Cannabis businesses licensed or endorsed for cultivation are <br />permitted as a conditional use in the following zoning districts: <br />i. Gateway District – Neighborhood Center (NC) <br />b. Cannabis Delivery Service. Cannabis businesses licensed or endorsed for delivery service <br />are permitted as a conditional use in the following zoning districts: <br />i. Gateway District – Neighborhood Center (NC) <br />c. Cannabis Event Organizer. Cannabis businesses licensed or endorsed for cannabis event <br />organizing are permitted as a conditional use in the following zoning districts: <br />i. Gateway District – Neighborhood Center (NC) <br />d. Cannabis Manufacturer. Cannabis businesses licensed or endorsed for cannabis <br />manufacturing are permitted as a conditional use in the following zoning districts: <br />i. Gateway District – Neighborhood Center (NC) <br />e. Cannabis Mezzobusiness. Cannabis businesses licensed or endorsed for a cannabis <br />mezzobusiness are permitted as a conditional use in the following zoning districts: <br />i. Gateway District – Neighborhood Center (NC) <br />f. Cannabis Microbusiness. Cannabis businesses licensed or endorsed for a cannabis <br />microbusiness are permitted as a conditional use in the following zoning districts: <br />i. Gateway District – Neighborhood Center (NC) <br />g. Cannabis Retailer. Cannabis businesses licensed or endorsed for a cannabis retailer are <br />permitted as a conditional use in the following zoning districts: <br />i. Gateway District – Neighborhood Center (NC) <br />h. Cannabis Testing Facility. Cannabis businesses licensed or endorsed for cannabis testing <br />are permitted as a conditional use in the following zoning districts: <br />i. Gateway District – Neighborhood Center (NC) <br />i. Cannabis Transporter. Cannabis businesses licensed or endorsed for cannabis transporting <br />are permitted as a conditional use in the following zoning districts: <br />i. Gateway District – Neighborhood Center (NC) <br />j. Cannabis Wholesaler. Cannabis businesses licensed or endorsed for cannabis wholesaling <br />are permitted as a conditional use in the following zoning districts: <br />i. Gateway District – Neighborhood Center (NC) <br />k. Low-Potency Hemp Edible Manufacturer. Businesses licensed or endorsed for <br />manufacturing low-potency hemp edibles are permitted as a conditional use in the <br />following zoning districts: <br />i.
