7 <br />be necessary, in the opinion of the City, for the Developer to take or perform in order to <br />obtain such certification. <br /> <br />ARTICLE IV <br /> <br /> The Developer will construct and install, at Developer’s expense, the following improvements <br />identified under Parts A and B (“Developer’s Improvements”), according to the terms and conditions <br />stated herein. <br /> <br />Developer’s Improvements (Part A) Exhibit B <br /> <br /> Section 4.1. Site Grading. The Developer shall do all site grading associated with the <br />construction plans approved by the City. Upon completion of all grading, Developer’s engineer shall <br />certify in writing that the site it graded to the approved plans. Also, the Developer agrees prior to <br />commencement of grading to call a pre-construction meeting between the City, Developer and <br />contractors for the site grading. <br /> <br /> Section 4.2. Soil Erosion and Tree Protection. The Developer shall control soil erosion <br />ensuring: <br /> <br /> (a)Erosion and siltation control measures shall be coordinated with the different stages <br />of development. Appropriate control measures, as required by the City, shall be installed prior <br />to development when necessary to control erosion. <br /> <br /> (b) Land shall be developed in increments of workable size such that adequate <br />erosion and siltation controls can be provided as construction progresses. The smallest <br />practical area of land shall be exposed at any one period of time. <br /> <br /> Section 4.3. Iron Monument Placement. The Developer shall place iron monuments at the <br />west terminus and east terminus of the common boundary line be established between parcel A and <br />B. An iron monument shall be placed after all street/utilities (public and private) and lawn grading <br />has been completed. in order to preserve the lot markers for future property owners. <br /> <br /> Section 4.4. Street and Storm Sewer Maintenance. The Developer shall be responsible for <br />street and storm sewer maintenance, including curbs, boulevards, sod, street sweeping and storm <br />sewer cleaning until 100% of the homes within the development are constructed upon the lots. The <br />City’s Consulting Engineering will conduct site visits to ensure compliance. Staff will contact the <br />Developer in writing and give a reasonable timeframe to meet compliance. If this is not met, the City <br />will sweep the streets and invoice the Developer for time spent. Warning signs shall be placed when <br />hazards develop in streets to prevent the public from traveling on same and directing attention to <br />detours. If and when the street becomes impassable, such streets shall be barricaded and closed. In <br />the event residences are occupied prior to completing streets, the developer shall maintain a smooth <br />driving surface and adequate drainage on all temporary streets. Performance shall be guaranteed by <br />the financial guarantee recited herein. <br /> <br /> Section 4.5. Storm Water Infrastructure. The Developer shall construct and dedicate all <br />storm water infrastructure required by the City. The Developer shall be responsible for storm sewer
