7 <br />City, the City will furnish the Developer with an appropriate instrument so certifying (the <br />Certificate of Completion). Such certification by the City shall be a conclusive <br />determination of satisfaction and termination of the agreements and covenants in the <br />Agreement with respect to the obligations of the Developer and its successors and assigns, <br />to construct the Improvements and the dates for the beginning and completion thereof. <br />Such certification and such determination shall not constitute evidence of compliance with <br />or satisfaction of any obligation of the City to any Holder of a Mortgage, or any insurer of <br />a Mortgage, securing money loaned to finance the Required Improvements, or any part <br />thereof. <br /> <br /> (b) If the City shall refuse or fail to provide any certification in accordance with <br />the provisions of this Section, the City shall, within thirty (30) days after written request <br />by the Developer, provide the Developer with a written statement, indicating in detail in <br />what respects the Developer has failed to complete the Required Improvements in <br />accordance with the provisions of the Agreement, or is otherwise in default, and what <br />measures or acts will be necessary, in the opinion of the City, for the Developer to take or <br />perform in order to obtain such certification. <br /> <br />ARTICLE IV <br /> <br /> The Developer will construct and install, at Developer’s expense, the following improvements <br />according to the terms and conditions stated herein. <br /> <br />Required Stormwater Facility Improvements <br /> <br /> Section 4.1. Site Grading. The Developer shall do all site grading associated with the <br />Construction Plans approved by the City. Upon completion of all grading, Developer’s engineer shall <br />certify in writing that the site is graded to the approved Construction Plans. Developer and City <br />acknowledge that, prior to commencement of grading, Developer and City held a pre-construction <br />meeting between the City, Developer and contractors for the site grading. <br /> <br /> Section 4.2. Soil Erosion and Tree Protection. The Developer shall control soil erosion <br />ensuring: <br /> <br /> (a) Erosion and siltation control measures shall be coordinated with the different <br />stages of development. Appropriate control measures, as shown in the Construction <br />Plansrequired by the city , shall be installed prior to development when necessary to control <br />erosion. <br /> <br /> (b) Land shall be developed in increments of workable size such that adequate <br />erosion and siltation controls can be provided as construction progresses. The smallest <br />practical area of land shall be exposed at any one period of time. <br /> <br /> Section 4.3. Iron Monument Placement. The Developer shall place iron monuments at the <br />west terminus and east terminus of the common boundary line be established between Parcel A and <br />Parcel B. An iron monument shall be placed after all street/utilities (public and private) and paved <br />areas have been completed in order to preserve the lot markers for future property owners. <br />Commented [AR2]: Review this language with Justin
