Ordinance No. 64F Municipal Sanitary Sewer System Page 9 of 10 <br /> <br />2. Any person, firm, corporation or voluntary association which violates or refuses to comply with any of the <br />pro visions of this Ordinance shall be guilty of a misdemeanor, and upon conviction thereof be subject to a <br />find of not more than One Hundred Dollars ( $100.00) and cost for every offense or to imprisonment not <br />exceeding ninety (90) days. Each day that a violation is permitted to exist shall constitute a separate <br />offense. <br /> <br />Section 27. Appeals. <br />1. Application. Application to appeal a sewer bill shall be made on forms provided by the City Clerk, who <br />shall forward completed applications that include the required information to the City Council, which shall <br />act as the Board of Appeals for review. <br /> <br />2. Deadline for Application. Appeals must be made in writing and submitted to the City Clerk within 15 <br />business days of the date the sewer bill was placed in the United States Mail by the City. <br /> <br />3. Review Process. The City Clerk shall refer the Applications to the City Council and establish a date for <br />hearing on the Application. All Applications shall be processed within 30 days of receipt of the <br />Application by the City Clerk. <br /> <br />4. Notice. Notice of the purpose, time and place of a hearing shall be mailed at least 10 days before the date of <br />the hearing to the Applicant. <br /> <br />5. Decision. The decision of the City Council acting as Board of Appeals to grant or deny the appeal requires <br />majority vote of the members present. Decisions of the City Council on appeals shall be final. <br /> <br />Section 29. Severability. It is hereby declared to be the intention of the City of Gem Lake that the provisions of this <br />Ordinance are severable. If any provisions or the application thereof to any Person or circumstances is held to be <br />illegal or invalid, such illegality or invalidity shall not affect other provisions of this Ordinance or the application of <br />said provisions to any other Person not specifically included in said determination. To this end, the provisions of this <br />Ordinance and the various applications thereto are declared to be severable. <br /> <br />Section 30. Repeal of outdated Ordinance. This Ordinance supersedes, replaces and repeals all prior Ordinances <br />relating to the same subjects contained within this Ordinance. Any portion of such prior Ordinances not incorporated <br />within this Ordinance is expressly repealed. <br /> <br />Section 31. Enactment.
