Municipal Water and Sanitary Sewer Ordinance Review <br />Gem Lake City Council Meeting 6/17/2025 <br />June 11, 2025 <br />Page 2 <br /> <br /> <br /> <br />PROPOSED UPDATES <br /> <br />Municipal Sewer Ordinance No. 64F <br />Below is a summary of the changes to the sewer ordinance. <br />• Revised formatting throughout to be consistent with formatting of other ordinances. <br />• Updated definitions. <br />• Updated language regarding connections, permits, and sewer availability charges (SAC) in order to be <br />consistent with city and Metropolitan Council Environmental Services (MCES) practices. <br />• Combined language and requirements from Ordinance Nos. 64 and 129 regarding sewer. Reviewed <br />language between 64 and 129 and removed any inconsistencies and conflicting requirements. <br />• Reviewed requirements for licensing and charges with city staff. <br />• Reviewed requirements for materials and construction requirements with Building and Engineering <br />Department staff. <br />• Updated references to state or MCES rules/requirements. <br /> <br />Municipal Water Ordinance No. 129 <br />Below is a summary of the changes to the water ordinance. <br />• Revised formatting throughout to be consistent with formatting of other ordinances. <br />• Created a definitions section, defined terms used throughout the ordinance. <br />• Reviewed requirements for connections and charges with city staff. <br />• Move permitting and licensing fees to the Fee Schedule. <br />• Move sections regarding municipal sewer to Ordinance No. 64. <br />• Updated the water use charge payment deadline, as advised by city staff. <br />• Updated the language for delinquent payments. <br />o The ordinance currently states, “The City reserves the right to shut off water service if the account <br />is delinquent for an unreasonable length of time as determined by the City Council.” <br />o Proposed language reads, “The City reserves the right to shut off water service, given the City <br />provides the property owner with a 30-day notice, if the account is delinquent for an unreasonable <br />length of time as determined by the City Council. A water shut off/turn on fee will be incurred for <br />shut off due to delinquent payment. The property owner may request a hearing to appeal the <br />disconnection or request a payment plan. Minnesota State Statute provides regulations on when <br />water shut offs are permitted and prohibited. The City of Gem Lake abides by Minnesota State <br />Statutes 216B as amended from time to time.” <br /> <br />Fee Schedule <br />In addition to the changes above, staff recommends moving any fees or charges out of these ordinances and into <br />the city’s fee schedule.
