Updated January 2025 – Gem Lake Consolidated Land Use Ordinance No. 131 143 <br /> <br />4. Trees and Boulevard Sodding. <br /> <br />1. Where street trees do not exist, trees having a trunk diameter of not less than two (2) inches, measured <br />twelve (12)inches above the ground, shall be planted on both sides of all streets in the subdivision in <br />locations approved by the Planning Commission, but no more than sixty (60) feet apart. Trees of equal <br />standard shall be planted in the required front yards at an average minimum density of one (1) tree per <br />forty (40) feet of right-of-way. <br /> <br />2. Tree species shall be as approved by the Planning Commission and must survive one full growing season <br />or be replaced at the subdivider’s expense. <br /> <br />3. Boulevards shall be sodded as required by the Planning Commission in conformance with generally <br />accepted standards and specifications. <br /> <br />5. Street Signs, Lighting and Driveways. <br /> <br />1. Street signs, of suitable design approved by the City Council, shall be installed at each street intersection. <br /> <br />2. Driveway approaches and sidewalks of standard design or pedestrian pathways, as may be required by the <br />City Council, shall be installed. <br /> <br />3. Street lighting fixtures, as may be required and approved by the City Council, shall be installed. <br /> <br />6. Sanitary Sewer and Water Distribution Improvements. <br /> <br />1. Sanitary sewers and water facilities shall be installed in accordance with standards and specifications as <br />required by the City Council and subject to the approval of the City Engineer. <br /> <br />2. Where City sewer and water facilities are not available for extension into the proposed subdivision, the <br />Council may permit the use of individual water and sewer systems in accordance with all appropriate state <br />and local regulations. <br /> <br />7. Public Utilities. <br /> <br />1. All new electric distribution lines (excluding main line feeders and high voltage transmission lines), <br />telephone service lines, Cable TV and other services constructed within the confines of and providing <br />service to customers in a newly platted residential area shall be buried underground, unless the City <br />Council specifically shall find, after study and recommendation of the Planning Commission that: <br /> <br />1. The placing of utilities underground would not be compatible with the development planned; <br /> <br />2. Topographical, soil or any other conditions make underground installation unreasonable or <br />impractical. <br /> <br />2. Where telephone, Cable TV, electric and/or gas service lines are to be placed underground entirely, <br />conduits or cables shall be placed within easements or dedicated public ways, in such a manner so as not <br />to conflict with other underground services. <br /> <br />3. All drainage and other underground utility installations that cross privately owned property shall be <br />protected by easements. <br /> <br />4. All utility lines for telephone and electrical service shall be placed in rear line easements when carried on <br />overhead poles. The Planning Commission may recommend, and the City Council require, that the type of <br />overhead pole used be of a quality and durab ility aesthetically in conformance with the nature of the <br />residential development. <br /> <br />5. The subdivider is responsible for complying with the requirements of this section, and shall submit to the <br />Zoning Administrator a written record from the utilities showing that the necessary arrangements with the <br />utility involved for installation of said facilities have been made. <br /> <br /> <br />
