Conditional Use Permit Request for 1599 County Road E East <br />Gem Lake City Council 8/19/25 <br />August 13, 2025 <br />Page 3 <br /> <br /> <br />EVALUATION OF REQUEST <br /> <br />Signs <br />Ordinance No. 131, Consolidated Land Use Ordinance, regulates signs in Section 19. Wall signs, such as the <br />sign proposed, require a sign permit. It states that, “No sign shall be erected, altered, reconstructed, maintained <br />or moved in the City without first securing a permit from the City. The speech content of the sign shall not be <br />considered when approving or denying a sign permit; however, the content must be submitted to properly <br />evaluate the signage area, design and placement. A proposed sign with a structure requiring a building permit or <br />electrical permit must obtain those permits in addition to a sign permit .” <br /> <br />The applicant has applied for the sign permit and will need to apply for an electrical permit as well. The proposed <br />sign meets the requirements of the Ordinance; however, the illuminated feature requires review for a CUP. <br /> <br />Section 19.5.2.4 states that, “In districts where illuminated signs or electronic signs are permitted, the use of <br />lighting, electronic message center, or dynamic display as an element of a sign is a conditional use. Application <br />for approval of lighting or electronic features shall be made in the manner of a conditional use permit, using the <br />procedure stated at Section 17.5 of this Ordinance.” <br /> <br />This section continues and states that, “Internally illuminated signs are permitted in the Neighborhood Mixed-Use <br />and Neighborhood Center subzones only. Externally lit signs shall use lighting that is directed downward and way <br />from adjacent properties and rights-of-way. Lights used for external illumination shall be shielded or screened <br />from any roadway, and shall not be visible from the roadway or sidewalk.” <br /> <br />The applicant is requesting approval for an internally illuminated sign, illuminated by “Konlite T8 8’ Ballast Bypass <br />LED Tubes”. The applicant states that these are “soft, low lumen, LED lamps.” See Figures 3 and 4 for drawings <br />of the proposed sign, provided by the applicant. <br /> Figure 3: Dimensions of the proposed sign and a description of the lighting mechanism, provided by the applicant <br /> Figure 4: An image of the outside of the building with the proposed sign shown and the store front length as 42 feet long. <br /> <br />“Store front is <br />42 feet long”
