2016 JPA with <br />Prior Amendments <br /> <br /> 5 <br />(k) “Local Water Management Plan” - Ameans a plan adopted by the each of the <br />membersMembers pursuant to Minnesota Statutes, SectionMinn. Stat. § 103B.235 <br />and Minn. R., part 8410.0160. <br /> <br />(l) “Member” – Each local governmental unitmeans each of the cities and the town that <br />is a partyare parties to this Agreement. <br /> <br />(m) “Special Legislation” means 2008 Minn. Laws Chap. 366, Art. 6, Sec. 47. <br /> <br />(n) “Storm Sewer Utility” or “SSU” means the public utility established by VLAWMO <br />pursuant to the Special Legislation. The Board establishes and certifies to the <br />County for collection within the Area a Storm Sewer Utility fee for the management <br />of surface water. <br /> <br />(o) “Technical Commission” – Aor “TEC” means the commission established herein <br />that is composed of a technically skilled personpersons, appointed by each Member. <br /> <br />(p) “Vadnais Lake Area Watershed” – Theor “Watershed” means the area contained <br />within a line drawn around the extremities of all terrain whose surface drainage is <br />tributary to Vadnais Lake or as described in Appendix Aas shown on the official <br />watershed map incorporated herein by reference. <br /> <br />(q) “VLAWMO” – The abbreviated name of the organization created by this <br />Agreement, the full name of which ismeans the “Vadnais Lake Area Water <br />Management Organization”.” that is reestablished and continued pursuant to this <br />Agreement. <br /> <br />(r) “Watershed Management Plan” - Ameans a plan adopted by VLAWMO pursuant to <br />Minnesota Statutes, SectionMinn. Stat. § 103B.231. <br /> <br />SECTION III <br /> <br />SECTION IV <br />ORGANIZATION OF VLAWMO; RESPONSIBILITIES OF MEMBERS <br /> <br />3.1 Subdivision 1. Board of Directors. The governing body of the VLAWMO shall be itsthe <br />“Vadnais Lake Area Water Management Organization Board of Directors.” The Board of <br />Directors is comprised of a total of six (6) Directors. The parties hereby reaffirm the <br />establishment and continued operation of the Board of Directors, which shall carry out the <br />purposes and have the powers as provided in this Agreement. <br /> <br />Subdivision 2. Appointment of Directors. Each Member shall appoint one representative , who <br />must be an elected official, to the Board, and said representative shall be called a “Director”. to <br />serve as the Member’s Director on the Board. The appointment process shall follow Minnesota <br />Statutes, Sectioncomply with the requirements in Minn. Stat. § 103B.227, Subdivisions 1 and 2. <br />
