2016 JPA with <br />Prior Amendments <br /> <br /> 17 <br />6.2 Funding. The annual operating budget may beis funded by one or more of the following: <br /> <br />(a) An authorized special tax levy authorized by the StateThe primary source of <br />Minnesotafunding for the annual budget is the SSU charges imposed on properties <br />within the Watershed each year pursuant to the Special Legislation. <br /> <br />(b) Member contributions toward specific capital improvement projects. <br /> <br />(c) VLAWMO may also receive grants to help fund specific capital improvements . <br /> <br />(d) If the funds collected from the SSU charges and grants are not sufficient to fully fund <br />an amount approved by the budget, the Board may exercise any other authority <br />available to it under law to fund the budget including, but not limited, Member <br />assessments. <br /> <br />6.3 Member Assessments. <br /> <br />1)(a) Authorized. A Member assessment may be imposed to cover an anticipated <br />shortfall in VLAWMO’s annual budget. A Member assessment amount shall be <br />calculated using the formula set out in this section. At least 10 days prior to the <br />meeting at which the Board considers acting on a proposed Member assessment, <br />VLAWMO shall provide each Member written notice of the proposed Member <br />assessment that identifies the amount to be paid by each Member. Members; shall be <br />given an opportunity to be heard at the meeting before the Board acts on the Member <br />assessment. A Member assessment must be approved by at least a majority of the full <br />Board by no later than July 1st for collection in the following year. If approved, <br />VLAWMO shall notify each Member in writing of the approved Member assessment <br />amount. <br /> <br />(b) VLAWMO operates Storm Water Utility authorized byFormula. To the State of <br />Minnesota and approved by the Members; <br /> <br />(c) Annual payment from each governmental unit party to this agreement and other entities <br />based on an annual extent a Member assessment as determined in Subdivision 2 in this <br />Section; and <br /> <br />(d) Service fees, grants, interest or other funding sources as available. <br /> <br />Each Member shall pay its annual assessment in the following manner: <br /> <br />1) The entire amount shall be due by January 31st of the year due; or <br /> <br />2) One-half (1/2) of each Members entire amount shall be due by January 31 of the year due <br />and the second one-half (1/2) of the entire amount shall be due by August 31 of the year <br />due. <br />
