Consolidated Land Use Ordinance No. 131 Update <br />Gem Lake City Council 8/19/25 <br />August 13, 2025 <br />Page 3 <br /> <br /> <br /> <br />Ordinance 131 Proposed Changes <br />While many changes were made to primarily update outdated language or formatting, below is a table of the more <br />significant changes. <br /> <br />Section Pdf Pages Change <br />Section 4 9 Addition of Figure 1c, Table of Uses <br />Sections 5, 6, 7, 8 <br /> <br />14, 17, 20, <br />23 <br />Essential services and essential service structures are permitted as <br />primary or accessory structures in all residential zones <br />Sections 5, 6, 7, 8 14, 17, 20, <br />23 <br />The private swimming pool accessory use now includes “non-commercial” <br />to ensure it is differentiated from the private and commercial use permitted <br />in the RX zone. <br />Sections 5, 6, 7, 8 14, 17, 21, <br />24 <br />The keeping of agricultural animals on lots greater than 1 acre is now <br />conditional use in all districts, where previously it was only permitted in the <br />RO and RS <br />Section 5, 6, 7, 8 14, 17, 20, <br />23 <br />Within the list of conditional use agricultural structures, bird structures and <br />apiaries have been added. <br />Section 5, 6, 7, 8 16, 19, 22, <br />25 <br />The provisions regarding fences have been moved to the general <br />standards section for simplicity and ease of reading. <br />Section 5, 6, 7, 8 16, 19, 22, <br />25 <br />The setbacks regarding barns and stables have been moved to the <br />yard requirements section for clarity. They have also been updated to read <br />“setback at least 50 feet from any property line and at least 100 feet from <br />any neighboring principal structure”, rather than 100 feet from any property <br />line, with exceptions. <br />Section 5, 6, 7, 8 16, 19, 22, <br />25 <br />Accessory structures are required to meet the setbacks of the zoning <br />district at this time. Proposed is a 10-foot rear yard setback. Currently <br />sheds are permitted in the setback. <br />Section 5, 6, 7 16, 19, 23 Accessory structures are not permitted in front yards. Proposed, only in <br />the RE, RX, and RO districts are 4 conditions that must be met to allow a <br />front yard structure: <br />1. The City Council approves the building location. <br />2. The structure meets all setbacks. <br />3. The structure is located no closer to the road right-of-way than <br />one-half (1/2) the distance between the principal structure, as <br />measured from the point of the structure closest to the road to the <br />closest location of the road right-of-way. <br />4. The structure is screened in accordance with City policies, where <br />appropriate. <br />Section 6 17 The conditional use, “Country clubs, golf courses and other private <br />commercial recreation areas and facilities, including swimming pools; <br />provided that any principal building or swimming pool shall be located not <br />less than fifty (50’) feet from any other lot in an “R” District” is now only <br />permitted in the RX zone and removed from the RE zone. <br /> <br />
