Updated June 2025 – Gem Lake Consolidated Land Use Ordinance No. 131 75 <br /> <br />8. Farming Operations. <br /> <br />1. All farms in existence upon the effective date of this Ordinance and all farms which are brought into the City by <br />annexation shall be a permitted use where the operator can conduct a farming operation. However, all regulations <br />contained herein and other City Ordinances as in effect shall apply to all changes of the farming operation which <br />will cause all or part of the area to become more intensively used or more urban in character. See Residential <br />Zoning Districts for additional regulations of agricultural buildings. <br />2. Structures in which farm animals or fowl are to be housed shall require a setback of one hundred (100’) feet of any <br />lot line except where the following conditions may provide for easing the restriction: <br />i. The structure shall be partially screened from the views from neighboring houses, with said screening to <br />be existing or planted and maintained vegetation or the natural topography of the lot and surrounding land <br />and with the amount of screening to be measured at full growth in the summer season; <br /> <br />ii. The structure shall be at least one-hundred (100’0”) feet from any well, ISTS or neighboring dwelling; <br /> <br />iii. The drainage characteristics of the land shall be such that the concentration of animals and animal waste <br />shall not cause real or potential pollution or nuisance problems; <br /> <br />iv. The design and construction materials of the structure shall be consistent with the main dwelling on the <br />property; <br /> <br />v. Such other factors as may be deemed material by the City. <br /> <br />9. Essential Services. <br /> <br />1. Essential services shall be permitted as authorized and regulated by state law and ordinances of the City of Gem <br />Lake. <br /> <br />10. (Deleted) <br /> <br />11. (Deleted) <br /> <br />12. Relocation of Dwelling Units. <br /> <br />1. It shall be the stated policy of the City of Gem Lake to maintain a harmonious and high standard of residential <br />development and to protect residential areas from deleterious effects through insuring that both new and relocated <br />dwellings form other areas, both within the City of Gem Lake and from outside, shall meet specified requirements. <br />Such relocation of dwellings as stated above must conform to all regulations of the Building Code and shall be <br />permitted in the zoning district where all necessary specifications as to lot sizes, setbacks, type of use, height <br />regulations and all other conditions as laid down in this Ordinance are met. <br /> <br />2. In addition, such relocations shall require a Conditional Use Permit from the City Council wherein the following <br />procedures shall be followed and provisions shall be met: <br /> <br />1. Application shall be made on forms provided by the City Clerk; <br /> <br />2. A fee for the Relocation of Dwelling Units shall be required in an amount established by resolution of the <br />City Council at its first meeting in January of each year. Further, the City may impose additional fees <br />including, but not limited to, engineering costs, attorney’s fees, expert opinions and publishing costs <br />payment of which may also be required of the applicant as part of the process. The building mover shall <br />meet all requirements for licensing and insurance as required by Minnesota Statues 221.81 and as from <br />time to time amended. <br /> <br />3. The application shall be referred to the City Council, who shall set a time and place for a public hearing <br />giving at least ten (10) days’ public notice of such hearing. <br /> <br />4. At least ten (10) days before such hearing, the Council shall mail a notice of said hearing to property <br />owners within three-hundred fifty (350') feet of the relocation premises. Failure of the Council to mail the <br />notice, or failure of the title holder to receive the notice shall not invalidate the proceedings.
