Lower level walkout design features may be included only in areas where natural topography provides for <br />the design and no artificial topographical build up or grading in excess of four (4’0”) feet collectively is <br />required or created; and, <br /> <br />5. Whenever a side or rear elevation exceeds the allowed height for the district, the structure must be further <br />setback from the sire and rear lot lines by the standard setback distance plus two (2’0”) feet for every one <br />(1’0”) foot above the standard front height; and, <br /> <br />6. Such other factors as the City may determine based upon the special or unique conditions and <br />circumstances of the lot and its surroundings. <br /> <br />5.6. Area, Frontage and Yard Requirements. <br /> <br />1. That portion of a lot considered as the front yard shall be as determined by the City Council. <br /> <br />2. All Residential structures shall be setback at least one-hundred (100’) feet from the ordinary high water <br />level of the lake. The ordinary high water level of the lake shall be as determined by the City Council. <br /> <br />2. The following structures can be erected with setbacks as long as no part of the structure is closer to the front of the <br />lot than the rear of the principal structure: <br /> <br />1. Fences. <br /> <br />1. Fences may only be placed directly on the property line with the written permission of the <br />adjacent property owner and when maintenance free materials are used; and, <br /> <br />2. All other fences may only be installed with adequate setback from adjacent property lines to <br />provide for owner maintenance; and, <br /> <br />3. All fences installed within the setback area must provide for a finished facade facing adjacent <br />property. <br /> <br />2. Patios, fireplaces, sheds and pools. <br />
