No person shall introduce or cause to be introduced any water to a depth of more <br />than eighteen (18") inches into the shallowest portion of any swimming pool newly constructed or being <br />constructed until such time as the Building Official authorizes the filling of such pool with water. Such <br />authorization shall be withheld until, as a minimum, the permittee has caused such pool to be <br />completely enclosed by a swimming pool construction fence. Said construction fence shall: <br /> <br />1. Be of snow fence like of similar design and be securely anchored in place; <br /> <br />2. Be constructed with its base flush to the ground; <br /> <br />3. Be at least four (4'0") feet in height and have supportive posts placed no more than eight (8'0") <br />feet apart; <br /> <br />4. Remain in place until a permanent fence completely enclosing the swimming pool is installed. <br /> <br />4. All outdoor Spas shall either have a fence as described in this section for outdoor swimming pools or a <br />latchable cover. The cover should be constructed of a material impenetrable by toddlers and subject to <br />inspection by the City building Official. <br /> <br />4. Miscellaneous Requirements. <br /> <br />1. All back-flushing water or pool drainage water shall be directed to be on the property of the owner or on <br />approved drainage ways. Drainage onto public or private streets or other public or private drainage ways <br />shall require a permit from the City Building Official. <br /> <br />2. Any outdoor lighting of the pool shall not be permitted to spill or shine upon adjacent properties. <br /> <br />3. All electrical installations shall comply with the State Electrical Code. <br /> <br />4. Precautions during construction: <br /> <br />1. Avoid damage, hazards or inconvenience to adjacent or nearby prope rty; <br /> <br />2. Assure that proper care shall be taken in stockpiling excavating materials to avoid erosion, dust <br />or other infringements upon adjacent property; <br /> <br />3. All access for construction shall be over the owner’s land and due care shall be taken to avoid <br />damage to streets and adjacent private or public property. <br /> <br />5. Nuisance. The conduct of persons and the operation of pools shall be the responsibility of the owner and any <br />tenants thereof and such conduct of persons and operation of the pool shall be done in a manner so as to avoid any <br />nuisance or breach of the peace, and it shall be unlawful to allow loud noises to go beyond the boundaries of the <br />property upon which the pool is located to adjacent property. <br /> <br />15. Land Reclamation. <br /> <br />1. Under this Ordinance, Land Reclamation shall be defined as the reclaiming of land by depositing of material so as <br />to elevate the grade. In all Zoning districts, Land Reclamation shall be permitted only upon issuance of a Special <br />Use permit. Any lot or parcel upon which an aggregate amount of four hundred (400) cubic yards or more of fill is <br />to be deposited shall be defined as Land Reclamation. The request for a Land Reclamation permit shall contain at <br />least the following: <br /> <br />1. Completed Special Use Permit form and necessary fees; <br /> <br />2. Survey of the site where Land Reclamation is to occur showing land contours before and after Land <br />Reclamation. This survey shall be large enough in scale to allow for at least the inclusion of the <br />immediate adjacent parcels of land. <br /> <br />3. A sketch showing current water drainage from/to the site and any modifications of such drainage after <br />Land Reclamation is complete.
